In a case like this, would you try and separate the husband and wife and maybe get the wife to turn on the husband . That would be tough. Most of the time, everybody turned to the husband and said you were the mail and the strong one and why didnt you control this. The wife will say, he made me do this. If i were representing the wife, i would look for Something Like that to point at the husband. I dont think that will work for the husband. If the case goes to trial, which we are assuming it might unless there is a plea deal, would the kids be called to testify x if you are the defense attorney, how would you handle asking questions of the kids . You have to be careful. I have done it for a long time when i was a District Attorney and i prosecuted a lot of rape cases and some cases like this. You cant attack. I have been called a pitbull in the courtroom. I laser in on people. In this case, you have to become gentle and ask questions softly and get them to convey what they can to the jury and it will take a lot of witness preparation and it will take the victim witness unit of Riverside County to work with the kids to get them to come out of the shell. This type of depravity and torture not only does physical damage but it leaves deep, deep psychological scars that will last a lifetime pick they will be lucky if they get better behind this and are able to lead a full life. The prosecution would try to be very gentle. Right. Cross examining. Same thing. Can go after them. What do the kids have to do with it . They are the victims you may have to go after some of the das expert if they put an expert on but you cannot go out after the kids. There has been a few cases in my career and i have done it for 35 years where i have turned people away and said what you did is so depraved, i will not defend you or give you my skills. As an attorney, we have an ethical obligation to defend people. We dont have to defend everybody but people say how can you do that or how can you do that . Someone in their family or someone they love is accused and all of the sudden the light goes on and they get it. In a case like this, you want to make sure the District Attorneys office does not go like a runaway train and abuse their rights for their civil rights or whatever rights they have in a case like this. In a case like this, it will be difficult. They better do a lot of talking with the District Attorneys office to see if they can bring the years down. Im sure they will be able to but to what end . 20, 30, 40 years in prison suspect do you think it will go to trial . I think that will be a plea deal. This would be a train wreck if it went to trial and we call it a slow play. You go to trial and it you know that we have no real defense. They will have the kids to put up. The study seem to show that for impact that some cases traumatic brain injury occurred and in other cases it didnt. This is important because it means that you probably shouldnt use concussion as a sole criteria for determining injuries to protect the athletes. I am not an md but what it seems and diet the hallmarks from this disease which is the purging that surround the neuron goes rogue and doesnt want to be there and comes up and accumulates around vessels and you get these tangles of bad stuff. Think of a collects cable that collapses. We have a study that shows this lack of connection between concussions and cte and where do we go from here . There is things one can do. One of the things is a localized loading is responsible for the concussion which is different from a global loading. Your head is globally loaded where impact is local and that gave rise to the concussive things that we saw and consistent with the experimental observations. One could develop mitigating strategies to redesign and deal with concussions. The development of traumatic injury is a separate issue. That is acceleration based. Whether it is impact our blast, the head acceleration gives rise to the condition. How do you minimize that . That is tough.
