If you work for uber, lyft or another gig economy company, get ready for changers. There was a bill passed that stirred up a lot of controversy surrounding the idea of reclassifying independent contract workers as employees. Alyana gomez joins us live with more on this big decision. Reporter uber came right out in front of it today, and with a response expressing their disappointment while also saying they will not reclassify their drivers as employees, once the bill takes effect in january, saying the legislation does not require them to do so. It requires companies to be tested to determine whether a worker is an independent contractor or an employee. The bill called ab five will be classified as gig economy workers, so instead of independent contractors, they will actually be employees, and that means benefits. Thats the real thing. For example rideshare drivers have to pay to maintain their cars and pay for their own healthcare, but this bill would change that, requiring some Large Companies like uber, lyft and door dash, to flip the bill for those costs and benefits. Thats problematic because uber and lyft have never really been profitable. They negotiated in good faith and their offer gave drivers access to sickleave and injury detection among other things. Establishing for the first time ever, a guaranteed minimum earning standard that would provide stability for drivers while allowing them the flexibility to earn more, and to work whenever, wherever, and for whomever they choose. West tells us that the vast majority of its drivers dont want to be employees, and that they are disappointed they couldnt come to a compromise with the state. If Governor Newsom signs the bill, which he is expected to do, it would go into effect in january 1. Uber says they will comply with the law, but will not automatically reclassify drivers. The school has released a statement in the last 20 minutes saying in part the fact that there are more the industries carved out of a beat 5 is very telling. We are fully prepared to take this issue to the voters of california to preserve the freedom and access drivers and riders want and need. Uber and lyft plan to Work Together on a statewide Ballot Initiative in 2020 and they have already put 60 million into a Campaign Committee account to get voters on their side. So it will be a long battle i had. I had. That work will have serious applications for the economy. Tom vacar joins us live from our newsroom after talking with three different experts that it will have on both employees as well as Business Owners. All of them agree that this is a tectonic shift in what is actually going on. Directly or indirectly, all of us get information and services from geek workers. Back in the 1920s, jazz musicians called any job a gig. Today it pretty much means any selfemployed worker who does not have a regular paying job, giving rise to the term gig economy. Labor lawyer of San Franciscos Duane Morris Law Firm is also a former director of the california edd. Its really a new standard for how you classify workers between independent contractors and employees, and its really as big as anything weve seen. Conservatively, it will directly impact 3 million workers out of the total California Labor force of 19 million workers. So theres 1. 5 million who do this for a primary income, but theres roughly an equal amount, another 1. 5 million, who do this to supplement their income. Faced with the higher coursed that fulltime employees bring, employers can choose to convert them to employees, or convert some of them to employees and layoff the rest, or punt. In some cases, and we dont know how large, the companies will cease operation. Who will become an independent contractor will be determined by the abc test. Spent that letter a factor is the right of control, does the employer have a right of control over the person . At the b factor, which is the most significant change, is the independent contractor cannot be performing the same services that are the Core Services of the company that they are providing. And the c factor, which is becoming more and more important, the independent contractor must actually operate their own business. Though Government Agencies can enforce the law, its most likely that the thousands of trial lawyers will do most of it with flurries of lawsuits. I think companies that are built to model with contractors as their primary labor pool, arguably are most susceptible to seeing some shifts and how they are structured overall. Mind you, geek workers and not just uber drivers, they are found in each and every business. To make makeup artists, physicians, surgeons, dogmas, travel agents, just a range of occupations and sectors. The three biggest sectors, construction, healthcare, as well as professional and business services. Now the thing that it is important to recognize, by this goes into effect on the first of the year, there is a lot of work going on behindthe scenes, there could be amendments and additional laws to clarify this and cut out even more people. Its one of the hottest political battles that has ever been waged in the capital. It seems like there is still a lot to clarify with this legislation. Tom, thank you so much. Lawmakers have also approved a bill that would allow athletes at california colleges to make money from advertisers who use their image or likeness. The bill will affect around 24,000 College Students from 54 schools. The measures earned a lot of support from professional athletes like lebron james and tremont green. But the members of the ncaa sport of governor say the law is a slippery slope. The state will give california schools and unfair recruiting advantage, meaning those schools could no longer compete in ncaa competitions. This bill is now in Governor Newsoms desk, but he has not indicated if he supports it. A fire on a small jetta forced Oakland Airport to reroute some airtraffic this afternoon. San Francisco City leaders are going to be taking a closer look at how shows and games at chase center and oracle park are impacting commuters. Tuesday nights Dave Matthews concert at chase center coincided with a giants home game. In an effort to accommodate the crowds, leaving those two events, muni canceled some of the eight bayshore buses at that service the southeast part of San Francisco. I was promised increased buses and shuttle service, we were promised increased train service, what we got was decreased service for lines that affect these districts. Primarily low income communities and communities of color. The larger issue is our concern with operator availability. In no way do we pull service that was already existing. We just were not able to fill runs that were already open due to a shortage of operators. Muni said about 10 buses were impacted by operator shortages but the impact to commuters was minimal and the agency is committed to making sure riders can depend on mass transit. The supervisor and Transit Agency officials met today to discuss this issue going forward. It is starting to look like a full pattern, with a lot of activity up in the aleutian islands. And then youve got this ridge over us. The ridge is building in rapidly, after this goes through, the high jumps in and we are starting to see that air, with no fog, winds are light and unusual at this time, but thats indicative of the highpressure establishing itself. The groundlevel ozone interacts with the car emissions, but im trying to say it is a spare the air day tomorrow, and probably will be again on friday. Much warmer as we head into friday.
