Firefighters there in hawaii continue to battle flames this morning as officials have now confirmed that at least 96 people have died. The wildfire now ranks as the deadliest in modern United States history, surpassing 2018s campfire in california which killed 85. Hawaii governor josh green said the fires will likely be the largest Natural Disaster in his states history, with damages estimated at close to 6 billion. Hawaiian electric is reporting that power has been restored to 60 of maui residents. We of course will keep you posted all morning long. As the tragedy continues to unfold there. Elsewhere this week after more than two years of investigating District Attorney fani willis will begin presenting her Election Interference case before a grand jury in Fulton County, georgia. A majority of that grand jury will have to sign off on an indictment for willis team to press charges against former President Trump or some of his allies. At least two witnesses that were subpoenaed by the das office have confirmed their scheduled dates to appear. Former Lieutenant Governor geoff duncan tweeted on saturday that he was scheduled to testify tomorrow. Journalist george chiti also confirmed his tuesday slot in an interview with nbc news. So saturday afternoon i received a phone call from the das office one of their investigators to tell me that i should come in tuesday to offer testimony to the grand jury thats investigating Election Interference here in georgia. Very reluctant to act adds an agent of the government, as any, you know, good journalist should be. The only reason im doing this honestly is because i think that the stakes are that important to democracy writ large in the United States and because i have this limitation on what im going to be what im going to be asked about. Former Georgia State senator jen jordan and former state representative bee nguyen are also both confirmed to have received subpoenas. Da willis has said she will announce any potential Charging Decisions by september 1st. And as he awaits those possible charges in georgia, trump is already testing the limits of a new Protective Order put in place in the federal Election Interference case against him. In court on friday judge Tanya Chutkan ruled that Going Forward trumps lawyers must review any notes he takes while looking at sensitive materials to make sure he is not copying down personal information about any witnesses. She also prohibited trump from having a phone out while reviewing those materials for that exact same reason. Prosecutors requested the order after trump started attacking potential witnesses, Special Counsel jack smith and even the judge herself on social media. On friday judge chutkan warned the former president s lawyers that, quote, while he has a First Amendment right to free speech, that right is not absolute. She added that the more a party makes inflammatory statements about this case the greater the urgency will be that we proceed to trial quickly. Despite trumps lawyers insisting that he would, quote, scrupulously abide by his conditions of release it sure didnt take long for the former president to seemingly start breaking those new set of rules. On social media last night in addition to calling jack smith a, quote, deranged lowlife prosecutor. The former president went after judge chutkan herself, sharing a post with her photo and a caption falsely claiming that she, quote, openly admitted shes running Election Interference against trump. Later on trump wrote that she was, quote, very biased and unfair and that she obviously wanted him behind bars. Last night attorney neal katyal who you know from msnbc posted this, it would not surprise me if judge chutkan called a hearing with trumps presence given his new remarks. Trump is seemingly so blatantly pushing back against it. What youve seen, do you think he has already violated it . The dwruj suggested she would give him some leeway, but do we think that neil might be right and we are going to see a hearing this week . We spent the last week ranking from one to four the not only pending cases against donald trump but if you include georgia the potential criminal case against trump but now im add ago fifth to the mix and its pretty high on the list in terms of threats to Donald Trumps liberty and that is a Potential Contempt Charge or any kind of penalty for violating not just judge chutkans order but any other pretrial order insofar as he may threaten witnesses. Ive imagined along with Chuck Todd Donald trump standing at the podium during a debate pointing to mike pence and calling him a traitor or a rat. Thats the kind of thing that prosecutors charge other defendants, defendants that no one has ever heard of, with witness intimidation. Thats how seriously not just state prosecutors but federal prosecutors take the idea of defendants threatening for intimidating witnesses. So when people ask about what cases pose the most threat to donald trump, i might put right near the top not just Donald Trumps d. C. Case but perhaps a greater threat is the potential he may violate that Protective Order by either potentially threatening a witness or revealing something that he learned in discovery. But i would just add that trumps own Legal Defense team in the d. C. Case was open to a Protective Order. In fact, the parties were not that far apart, they just reached an impasse and when that happens its not that uncommon to let the judge work it out and figure out and thats exactly what she did, she came out up with her own version of the order, gave something to the prosecution, gave something to the defense, neither side was right on the money. The judge found the middle ground to be the best route. Trump clearly decided this is good politics to play the aggrieved victim. There may be legal consequences he doesnt quite grasp. Lets turn back to the Georgia Investigation now. Weve known for a while that this was the window in august where charges were they to be filed would come. Theres witnesses presenting evidence this week and testimony. What do you make of that and what does it mean for a timetable for any potential charge. Siamak namazi. The scuttlebutt which is not reliable had potential charges coming as early as this week. To the extent there are additional witnesses coming in to testify that would suggest the timeline is pushed back even more, maybe a week, maybe more than a week. Its hard to say. That means the system is working the way its supposed to because grand juries are conducted in secret and these witnesses were not supposed to know when theyre coming in, its only through watching the courthouse closely or watching the locations closely or putting our ear to the ground and figuring out that theres a possibility an indictment may come this week. But it equally could come next week if witnesses are still testifying. The doj on friday announced Attorney GeneralMerrick Garland announced they would be appointing a Special Counsel in the Hunter Biden Case. Later in the show we will talk about the political ramifications of that with anna palmer of Punchbowl News, but just in terms of legal matters, if this has happened, does this increase the likelihood that hunter biden is going to trial, that Special Counsel david weiss suggested that it would, and does it necessarily mean that the investigation into hunter biden is widening or is this simply a tactical matter in order to bring charges outside of the state of delaware . The answer is yes to both. It is theoretically possible that the Special Counsel will be expanding the investigation to, for example, and this is just one theory thats out there, that you might need a Special Counsel if you were investigating or even had to speak to the current president , joe biden, but on the other hand it could be as simple as the fact that the plea deal broke down unexpectedly to both sides means that the case must go forward to trial and if venue for some of these tax crimes lies only in d. C. Or maybe the Central District of california, that could be why the Special Counsel status was sought, although the existing david weiss already had significant broad investigative and prosecutorial power, but it may be as simple as that, that as the government is now shifting to a trial mode, they need that Special Counsel status in their minds to take this case to trial, whereas as long as hunter biden waived Venue Objections or anything else, then theoretically they could have wrapped this up in the district of delaware, but i think it was a surprise to everyone, but i should also criticize both sides that you shouldnt walk into a plea hearing without everybody being on the same page. Thats what led to this unexpected situation where they may be going to trial and now they need Special Counsel status to do that. Hunter biden thought he was mere minutes away from putting his legal woes behind him. We do know that whether its the expanding probe or simply a trial, this is going to now shadow his fathers reelection campaign.
