We had a House Speaker<\/a> removed and now also for the First Time Ever<\/a> a former president of the United States<\/a> was slapped with a gag order. On the second day of Donald Trumps<\/a> Civil Fraud Trial<\/a> in new york city, judge Arthur Engoron<\/a> implemented a gag order, quote, on all parties with respect to posting or publicly speaking about any member of his staff meaning the judges staff. It came after trump posted a baseless claim about the court clerk on social media yesterday while sitting just a few feet away from her inside the courtroom. On truth social and in an email to his supporters, Trump Insinuated<\/a> the clerk had a personal relationship with Senate Majority<\/a> leader chuck schumer, something there is simply no evidence to support. Photographed together, thats it. Trump later during the break judge engoron summoned one of the former president s lawyers and the president s son eric trump to his chambers and told him to get that post taken down immediately. Once the trial resumed the judge issued the gag order but not before the Trump Campaign<\/a> sent out another disparaging email, this one about the judge himself. The order is broken. The judge says it could lead to, quote, swift, meaningful sanctions. Trump says hell be back in court today for day three, the Punishment Phase<\/a> of his trial and proceedings could last all the way to december. Joining us now former u. S. Attorney and an msnbc contributor our friend barbara mcquade. Barbara, good morning. Furuncfor being with us today. So lets talk about the gag order. Do you agree with the decision, and what sort of impact could this order potentially have with the ongoing federal cases also proceeding against donald trump . Yes. You know, in this case the judge issued a very narrowly tailored order. It simply tells donald trump not to be friendly with any of the parties and making disparaging comments about members of the court staff. Really quite narrow but absolutely appropriate. Making these comments is simply designed to inflame the public and suggest that the trial is unfair in this case, but it also creates danger for the staff members. There could be somebody out there who sees this message as call to action. And then your other question, i think, is a really interesting one. And that is could you sort of break the dam for the other judges who seem really reluctant to issue a gag order in their own cases with donald trump making disparaging comments about judge Tanya Chutkan<\/a> and about some of the people who might be witnesses against him, suggesting that, you know, mark milley ought to have the Death Penalty<\/a> imposed against him for alleged treason and other kinds of things. It can be very indimidating to those those witnesses, have a Chilling Effect<\/a> on them and also draw the ire of supporters. One could hope perhaps those judges are watching this and feeling empowered by this order to impose orders of their own. The tricky part, of course, is they dont want to do anything that would harm the First Amendment<\/a> rights for someone running as president. Well certainly watch for that in the days ahead. Barbara, stay with us for another league headline. This one involving president two counts accused hunter biden of having lied on a federal form about his use of narcotics having bought in delaware in october 2018. A third count claim he possessed a gun while he was using the narcotic. Hunter bidens Team Released<\/a> a statement following the Arraignment Reading<\/a> in part, this, these charges are a result of the political pressure including trump and his maga allies to force the Justice Department<\/a> to ignore the law and deviate from its policies in cases like this one. Barb, weve also heard Hunter Bidens<\/a> lawyers flat out argue that the gun charges are unconstitutional as well as politically motivated. What is your read . What is your assessment about the strength of these charges . Do you think it was fair they were brought . Yeah, i think theres, you know, two questions that a prosecutor has to ask herself whenever bringing charge. One is can i bring these charges . Is there sufficient evidence . And in this case it looks like the sufficient answer is yes. And the question is should i bring these charges . And there is the one i think at least some appearance hunter biden is being treated differently from other defendants. This is a charge that is rarely filed. In my own experience as 20 years as a prosecutor i can recall filing it exactly once. And when it is charged it is because usually the person is in a danger to the community and the only charge available. For someone who possessed a gun for 11 days several years ago and no longer has that gun during a time he using drug he no longer uses does strike me as being an unusual prosecutorial clarj. I will a couple years ago i would have thought this case was very strong and theres no issue with it legally. But after the Supreme Court<\/a> decided a case two years ago i think this charge and many others are really in some legal jeopardy, and thats because in that bruin case what the Supreme Court<\/a> held is that Gun Regulation<\/a> should be examined to determine whether they have tradition and history in the United States<\/a>. What did the gun laws look like at the time of the framing of the Second Amendment<\/a> . And certainly there were not laws at the time that prohibited people from possessing guns if they were using illegal drugs. And so for that reason i think there is some legal jeopardy here. Abby lowell, the lawyer for hunter biden, has promised to file a motion to strike the charge on that basis. And i think after the bruin case, hes got a strong chabs of succeeding on that basis. Some are worried their strong push could actually help hunter biden escape this particular charges. Thank you as always. As you said yesterday we saw all the three major Stock Markets<\/a> end in negative territory. In fact, the dow is actually negative year to date, so weve erased all the gains of the year. The nasdaq down almost 2 yesterday. A lot of focus as you say moves upwards on bond yields. Tenyear treasury yields up 11 basis points. We were up the highest level since 2007 and also up 80 basis points just in the last month alone. 30year treasury yields also moving about 13 points higher and news cycle high. And weve spoken to analysts about these drivers of move higher in yields, and many people are saying it is a reflection of positive macro data. You mention those job numbers coming better than expectations, it fact there is a recognition that Interest Rates<\/a> are going to stay higher for longer. And then, finally, john, a subject thats close to your heart, the political dynamics in the background of what the lack of governance right now means for the fiscal trajectory of the u. S. Lets move onto a couple other headlines here, joumanna. General motors reported an increase in sales despite the ongoing United Auto Workers<\/a> strike. Is there a sense this trend could continue . Yeah, so that was surprising, actually. Despite the ongoing strikes. In fact, General Motors<\/a> posted surprisingly strong results. 21 increase in sales from july through september outpacing expectations of growth 15 to 16 . They showed actually an increase in sales across every single one so it was broadbased and much stronger than their competitors, but analysts are warning if these strikes continue and the Work Stoppages<\/a> continue throughout october and november, we will start to see an impact on sales and supply chains. The vehicles most affected will be the chevrolet colorado. And we talked about netflix is no longer sending those dvds, but now theyre considering a Price Increase<\/a> for their streaming plans. Tell us more. Yeah, so there was a report in the Wall Street Journal<\/a> yesterday saying that netflix are considering another increase in prices. Remember last year they increased prices across all their different plans. They introduced an ad supported plan as well. Earlier this year they cracked down on password sharing, but it looks like they may be looking to increase prices once again but this time in reaction to ongoing negotiations with hollywood, to the Writers Guild<\/a> of america. Theyve agreed to grant writers for streaming segments an a minimum amount of compensation. The wga estimates the cost of their new contracts could add about 0. 2 to netflixs annual revenue cost. So on the back of that it seems netflix may want to pass on those extra costs to their consumers. Writers strike settled but some suggest progress has been made. Well keep an eye on it. Speaking with Heads Of State<\/a> and various european leaders nbc news reports that President Biden<\/a>, quote, hoped to convey that the u. S. Will continue to supply aid to ukraine. The call comes after a continuing resolution passed over the weekend that left out any further aid to kyiv. Joining us now to talk about this, democratic congressman Seth Magaziner<\/a>r of rhode island. A member of homeland security. Congressman, thank you for joining us this morning. Lets start there with the idea of future u. S. Aid to ukraine. There wasnt any money in the deal that was struck over the weekend. Weve heard from the president in recent days saying that he believed House Speaker<\/a> mccarthy would keep his word and that there would be additional funding forthcoming, and now theres no House Speaker<\/a> mccarthy, and its not clear who will succeed him and what their position on Ukraine Funding<\/a> will be. How concerned are you . Well, theres two things that people need to understand when it comes to the word ukraine. Number one, it is absolutely vital that the ukrainians are successful in beating this illegal invasion orchestrated by vladimir putin. Its in the United States<\/a> National Security<\/a> interest to stop putin and support ukraine. Second, there is broad bipartisan support for supporting the ukrainians in their fight to freedom in congress. Weve had several votes this year in the house in ukraine aid, and consistently more than 300 members of the house in addition to strong majorities of the senate have shown their support for continuing to arm the ukrainians with the tools that they need in order to win this war and appeal a defeat vladimir putin. So the support is there. And i think if we saw anything during the speakership of mccarthy it was that the house doesnt work when you have a speaker who only caters to a very small minority of the chamber. Kevin mccarthy is not speaker today because for the last nine months he would let a small group of dissidents set the agenda for him and do extreme things like try to cut title one funding for education by 70 , criminalize abortion, go after social security, launch a baseless impeachment of the president , and most recently blockade to ukraine. The speakership does not work when you only let a small push that wasnt extreme enough for them. So my hope is that the next speaker whoever that ends up being is someone who will recognize that a strong bipartisan majority in both the house and the Senate Support<\/a> ukraine aid and that we will be able to get it passed this year. There are a number of procedural avenues that we could use to deliver the president s request for supplemental aid to ukraine. And its going to take a House Speaker<\/a> who will thereon the majority of the chamber as opposed to listening to a small handful of the most extreme members. You just outlined all the reasons why democrats didnt end up supporting mccarthy yesterday. What happens next . First of all, no speaker for at least a week. The clock is ticking until Government Funding<\/a> runs out again. How concerned are you about the future right now of the Lower Chamber<\/a> . You have to be concerned because again theres a cohort of the Republican Party<\/a> in congress that cares more about getting tv hits and playing to their base than about governing. We are concerned if theyre built to be a Majority Party<\/a> or not and capable of governing. We felt confident on the democratic side that Kevin Mccarthy<\/a> was not the right person to lead the chamber. He had catered to the extremists on issues like ukraine and abortion and gun safety that matter to the American People<\/a> instead of listening to the majority of the chamber. Im hopeful we can elect a new speaker quickly and will be someone who can Work Across Party Lines<\/a> to get things done. We really appreciate you coming on this morning. On his way out of leadership yesterday, Kevin Mccarthy<\/a> had one last order to his staff, to remove former House Speaker<\/a> nancy pelosi from her capitol work space. She revealed she had been told to immediately clean out her secondary office, calling it, quote, Sharp Departure<\/a> from tradition. Although, pelosi attributed theed orrer to the new interim speaker, a source tells nbc news the decision was actually made by the now former House Speaker<\/a> Kevin Mccarthy<\/a>. Additionally, pelosi wont be able to clean out her office today because shes in california, preparing to attend the funeral of the late senator and her friend, dianne feinstein. Joining us now, senior congressional reporter for punch bowl news, andrew desidario. Andrew, andrew, anandrew, it wi be a messy few days. So we are really in uncharted territory here, right . Because you have a speaker of the house who has been kicked out. You have an Acting Speaker<\/a> which is not a precedent that anyone currently living has ever experienced. Look, the frontrunner right now seems to be House Majority<\/a> leader Steve Scalise<\/a>. He has started making calls to republican members to try to gauge his level of support. Were also told that congressman jim jordan, the longtime conservative member of the Freedom Caucus<\/a> is also potentially interested in the gig. And another part of this, john, is that we wont find out really more about who could get the requisite votes until early next week. The house obviously is not having any more votes this week. The only business of the house right now is to elect a speaker. And meanwhile, we have 44 days until a Government Shutdown<\/a>. And you know, the house was supposed to be working this week and next week on those appropriation bills. But now that timeline will be even more condensed. Yeah. That cant be underscored enough about the ticking clock. An drurks we know how hard it is to get the vote to be speaker. It took mccarthy 15 ballots. There was a sense that even after the motion to vacate that he would fight to keep his job. Whats the decision to walk away . Leader mcconnell in the senate called this a thankless job. Thats the right way to put it when youre speaker of the house. It became clear even if Kevin Mccarthy<\/a> were to throw his name back in the ring and try to get elected speaker again, there was no moving any of these eight republicans who ended up voting against him. And so, i think he just really saw no clear path to becoming speaker of the house. With Steve Scalise<\/a> and jim jordan, obviously, they have potential path to become speaker because some of those eight republicans who voted against mccarthy have even directly floated those individuals as people they would support to be speaker of the house. So, i think its very possible that you see the current leadership kind of stay in place as people just sort of ascend in the ranks. Andrew, one other story i know youve been covering closely. Major developments in the senate amid Bob Menendezs<\/a> federal indictment. The new chair of the Foreign Relations<\/a> committee decided to block aid to egypt. Menendez was indicted on charges that he accepted bribes on behalf of the Egyptian Government<\/a> to take official actions that benefitted the Egyptian Government<\/a>. One of those actions was supporting weapon sales to egypt. And theres long been a concern in congress, particularly among democrats about Human Rights Conditions<\/a> in egypt and the deteriorating nature of that. And senator ben cardin who came in as the chair of the Foreign Relations<\/a> committee after me mendes stepped aside as the chair, one of his first actions now was to put a hold on all u. S. Military aid to egypt because of those human rights concerns. So, its a pretty seismic development in the senate here where you see this turnover in terms of the Foreign Relations<\/a> Committee Chair<\/a> and one of the first issues hes tackling is one of the issues his predecessor was indicted on.
