MSNBC The Last Word With Lawrence ODonnell September 17, 2024
And then right after that at 9:00 p. M. Eastern we will premiere my new movie and its first documentary for my new
production company
a movie called from russia with lev with the absurd story of trump's first impeachment and a lot of stuff you didn't know about. Very excited for you to see about it and now it's time for the last word with lawrence o'donnell. We have senator whitehouse joining us tonight after the black
buster blockbuster
reporting on what is going on
inside the supreme court
with the chief justices and this is reporting like we have never seen before about how they arrived at that immunity decision. That reporting was based on source documents that don't exist in journalism. I know they exist in the real world, but you never ever see any of the journalism that says based on these documents we obtained from inside the supreme court, it doesn't happen and that is a unicorn. It is really striking to hold that in my hands reading it to think the supreme court is cracking in every way it can. At a time when it is not like any other. No worries. Why not that one fall apart too. Exactly. Thank you, rachel.
Breaking news
for republicans who already know this news because this is something to pay attention to. The
stock market
closed at another alltime high today as the biden
stock market
continues to outperform the
stock market
under every previous president which means the rich are getting richer, much richer and during the
biden ministration,
something that donald trump has always promised rich people would be impossible. But rich people have actually always done better in the
stock market
and the economy during democratic presidents than republican presidents and people of all
income levels
have historically been better off economically under democratic presidents. That is a simple fact of economic life in america and often ignored is a simple fact of economic life in america. On sunday morning, at 10:44 a. M. a
78yearold
florida man
screamed at the top of his
social media
lungs, i hate taylor swift. Unfortunately, for donald trump, nobody was surprised.
No one
thought he was better than that. No one, not his supporters, no one. Hate isn't a presidential verb. You can check the presidential statements of most presidents and you never find them saying they hate a person. George w. Bush's father did say in 2002 i hate
saddam hussein.
I don't hate a lot of people. I don't hate easily. Like donald trump, george h. W. Bush was a former president when he said that. And he was 78 years old. And he added the apologetic note, i don't hate a lot of people. I don't hate easily. And this was a way of explaining why he was using the
word hate,
a word presidents don't use in that way. Donald trump, on the other hand, hates a lot of people. He hates very easily. He hates everyone and has publicly expressed hatred for everyone from me to
taylor swift
and that really is everyone. He has the most hateful
mind and spirit
in presidential history and you can search the internet. You won't come up with much more than those two uses of the
verb hate
applied to a person in presidential history. Just i hate saddam and i hate taylor swift. George h. W. Bush, at 78 years old, had the presence of mind to give a reason for hating saddam. Former
president bush
said at the time that he used poisoned gas on his own people so there is nothing redeeming about this man. Donald trump gave no reason for hating
taylor swift
and nothing about
poison gas.
And so that sent possibly millions of young girls and boys to their
parents yesterday
to ask why donald trump hates taylor swift. Some of those kids will be asking some of those parents why the parents are voting for donald trump who hates taylor swift. Many of those kids will have a better understanding of donald trump from that one social
media post
than some of their parents who think they support donald trump's policies. The kids know that that statement, i hate
taylor swift
is the ranting of an angry irrational old man who has so much hate in him that he actually has hatred for taylor swift. Young voters who will cast their first vote for president this year all know who
taylor swift
is and hating her makes no sense to them. It should make sense to
anyone else.
The test of
trump madness
is always to apply the latest example of it in a hypothetical to
someone else.
So let's imagine president biden woke up
sunday morning
and tweeted in
capital letters,
i hate lee greenwood! lee greenwood is a
trump supporter
who sang at the
republican national convention.
There would be calls for invoking the
25th amendment
to remove him from office for
mental incompetence
if he tweeted i hate lee greenwood and concerns about mental competence wouldn't be justifiable if president biden tweeted i hate anything or you can name. The people who would scream about it the most, you know, are the people who completely accept as trump followers donald trump posting insanely, i hate taylor swift. That is how much donald trump followers have corrupted the expression outwardly of their own values in the need to accept the public poison of donald trump and continue to support his candidacy. Many of trump supporting parents in america are going to find out that their kids might not think it is perfectly reasonable and justifiable for donald trump to hate
taylor swift
just because she endorsed kamala harris for president. This i hate
taylor swift
story with the clips eclipsed yesterday by another crazy man with a gun apparently trying to do something crazy with a gun that he was apparently able to obtain illegally in a country where republicans have made sure that america's murderers and assassins are the very best equipped murderers and assassins in the world. Good afternoon. Thank you for joining us today. I am the
united states attorney
for the district of florida. Because history is sometimes perfect, the federal prosecutor now in charge of investigating what he calls and attempted possible assassination of
donald trump yesterday
is an elegant immigrant to this country from haiti and here is the last thing donald trump said about haitian immigrants in this country. In springfield, they are eating the dogs, the people that came in. They are eating the cats. They are eating the paths of the people that live there. The u. S. Attorney came to this country when he was 16 years old from haiti with his mother and when he graduated
miami edison senior high school
in 1987, he immediately joined the marines and served in the first
iraq war
for six months in 1990 and after
law school
he worked for two years in the u. S. Attorney's office before running a prominent
law firm
in donald trump has said this about immigrants specifically from haiti. Like him. There poisoning the blood of our country. In the
trump universe,
the man with the poisoned blood would be the assassin and the
nativeborn white american
would be the prosecutor. In reality, it is exactly the opposite. We are here to announce that a man has been charged in a criminal complaint in the
southern district
of florida with
firearm offensive
related to an incident that occurred yesterday at trump international
golf course right
here in
west palm beach.
He was charged federally with possession of a firearm by a convicted felon in
possession and receipt
of a firearm within obliterated
serial number.
He had his initial
appearance today
before the
magistrate judge
in the federal courthouse in
west palm beach.
According to the allegations in the complaint, a u. S. Secret
service agent
walking the
golf course perimeter saw
what appeared to be a
rifle poking
out of the
tree line
and after the agents fired the
service weapon
in the direction of that they saw a man later identified as
ryan wesley routh
fleeing the area near the
tree line
and he was later apprehended by officers in coordination with the
palm beach county
sheriff's office. The fbi continues its investigation of this incident as an assassination attempt on the former president. I want to express my gratitude to the attorneys with the u. S. Attorney's office with the
southern district
of florida and the justice department's
national
security division
for their nonstop work for the last 24 to 30 hours. Donald trump wants to fire the mall, everyone in those who in the u. S. Attorney just thanked and they are the deep state for donald trump and his crazed followers in washington. All of those federal investigators working nonstop at the us attorney just said, donald trump wants to fire. And donald trump believes they are all the enemy. These are the days to remember that. These are the days to remember that there is one political party in america who wants to defund the police and the police they want to defund our fbi agents and other federal agents. The republican party will do that if they win the
white house
in the
united states senate.
They will replace him and every biden appointed you as attorney throughout the country with a trump appointed you as attorney, a position that must be confirmed by the united
states senate
and the republican control of the senate would guarantee that donald trump could appoint anyone he wants to anything. And at stake in the election especially in the
senate election
is the future of the american
court system.
He is the first
haitian american
you as attorney in
american history
and there won't be another one in the
trump administration.
The senate has confirmed 205 judicial appointments by
biden for supreme court
and there are 21
biden appointed judges
currently waited waiting to be confirmed by the u. S. Senate and next year there will be 70
appeals court federal
appeals court judges reaching the
retirement age
and if the next president gets to a point, 70 appeals court judges, that would be almost 40 percent of all the federal
appeals court judges.
The difference between the republican appointed judges and democratic appointed judges is stark and republican appointed judges created a new doctrine of criminal immunity just for donald trump with no previous presidents having criminal immunity from
george washington
to
barack obama
but suddenly a supreme court with
three trump
appointees granted donald trump criminal immunity and the three justices appointed by democratic presidents,
obama and biden
sided with the constitution against criminal immunity for donald trump.
Federal judges
serve for decades. They exert power over the american people for decades.
Clarence thomas
voted to overturn roe v. Wade 32 years after he was appointed i george h. W. Bush. There is a possibility that beginning next year, no federal judges, none, no federal judges will be confirmed for the next four years. And this is no matter how many of them retire. They won't be replaced if republicans control the united
states senate
during the presidency of kamala harris. Kamala harris would become the first president in history to a. 0 federal judges if the democrats lose control of the united
states senate
in the upcoming elections. The stakes have never been this high on judicial nominations because the difference between judges appointed by democrats and judges appointed by republicans has never been more dramatic. George h. W.
Bush appointed
clarence thomas and he also pointed
david souter
who turned out to be a supporter of roe v. Wade. And
richard nixon appointed three supreme court
justices who enjoyed the unanimous
supreme court ruling
against president nixon which forced president nixon to resign the presidency and the supreme court has changed dramatically since then and the politics have changed in shockingly bad ways since then on the republican side and the special
prosecutor jack smith
is appealing a ruling by the donald trump appointed judge,
judge cannon
in which
judge cannon
dismissed all criminal charges for donald trump for illegal possession of ossified documents and a judge just threw that case out and threw it out of
court and jack
smith is now appealing that decision to a federal appeals court which has seven republican appointees and five democratic appointees. That
11th circuit court of appeals
has been so far perfectly fair and considering the previous appeals of judge cannon's rulings that the
11th circuit court of appeals
is very likely to overturn judge cannon's ruling and reinstate the criminal case against donald trump. But if donald trump is elected president, he will immediately fire jack smith in order the
justice department
to drop all criminal cases against him in
federal court.
He will then appoint judge mercedes can into the united states supreme court after easily making clarence thomas an offer he can't refuse and to retire into a life of a very very rich man with massive wealth being instantaneously and legally handed to clarence thomas upon retirement. Donald trump will make the same deal with
justice alito
whom the
new york times
reports was removed by the
chief justice
from writing an important opinion for the court after the
new york times
first reported to those sympathetic to the january six insurrection defendants in a flag supporting that was flown at his home. Donald trump will conspire to make
samuel alito
a very very rich man for retiring from the supreme court and being replaced by someone 30 years younger at least. That means the next presidential election could very quickly lead the supreme court with five
trump appointed justices
two of whom would decide how we live in this country for the next 40 years. Donald trump's poison will live on in the supreme court and the federal judiciary long after he is gone. And if kamala harris wins the presidency and if democrats win the united states senate, then the future of the federal courts can be saved. The future of those courts can be improved. The stakes in the presidential election have never been higher. Leading off our discussion tonight's gary peters of michigan the chair of the

The stakes in the presidential election have never been higher. Leading off our discussion tonight's gary peters of michigan the chair of the
senate homeland security and environmental
affairs committee and also chair of the
democratic senatorial campaign committee.
Senator peters, thank you very much for joining us tonight and i would like to thank you tonight about your effort to once again try to maintain a democratic majority in the
united states senate. You have succeeded in this position before which is why they are keeping you in this position. What is the state of the
race tonight on control of the united states senate? you certainly played out what could happen if we lose the senate and we have to maintain this majority. The stakes couldn't be higher. I could to say right now these races are incredibly tight. We have a number of incumbents that are in races in a margin of error in opportunities to pick up some seats but these races will come down to the wire. As we are in these races, we see billionaires now supporting republican candidates pouring massive amounts of money into these campaigns. We have seen
special interest groups for massive amounts of money. Our candidates need to be able to fight and have the resources. We need to have a
ground campaign to turn out to voters which is what we do here in at the last cycle it was the
ground campaign that allowed us to win these tight races. Today we announced we are investing $25 million into our incumbent seats as well as
pick up opportunities in florida and texas and the stakes couldn't be higher. We need to be able to have those resources and that is why we hope folks across the country who do believe we have to have a fair judiciary we have to have judges who believe in the
rule of law who understand how important the u. S. Senate is and they volunteer their time, get out and work on the ground campaigns and if you can't do that support us financially through defend the senate. Org which is a website that allows us to get the resources to win. The stakes couldn't be higher in these races are tight. I am confident we can win. We have the best candidates. If you look at the quality of candidate differences in a look at these republican candidates we are running against and they are basically on a continuum from flawed to very flawed and most of them are toward the very flawed carrot agree category. We have to see that voters see the difference and get out and vote and we need everybody rolling up their sleeves to help us do that. Viewers have seen
jon tester of montana and others on this program explaining in their word the miracle of how they managed to get reelected in those republican states. So i think there is a certain familiarity and i know
jon tester has the toughest campaign of anybody but talk about the two possibilities you see, the two most likely possibilities you see to pick up and add to the democratic majority or as
insurance policies for the possibility of losing one of the democratic incumbents. We do have to pick up these opportunities and we will go on the offense and we will do everything we can that we hold the states where we have a democratic incumbents now. But we have to go on the offense because the stakes are high. Florida and texas provide that opportunity to us and we have outstanding democratic candidates in both those states and they are running against what i call flawed republican candidates that don't represent the interest of their state. They are out of touch with a majority of people in those states and it gives us
a real opportunity. In florida for example against
rick scott he has very extreme positions on abortion. In florida there will be a referendum on abortion to
enshrine abortion rights into the
state constitution. We know that could drive folks out that want to make sure their voices heard and make sure their rights aren't taken away. And there is a strong race also down there but she needs help on the ground and financial help and
colin allred in texas an outstanding candidate and a member of congress representing a
district taking on
ted cruz. His popularity has continued to decline over the years and he is very vulnerable. These are big states and we need resources and folks willing to invest in these candidates. Certainly my committee is doing that and we made investments into the ground with our
announcement today and we will continue to provide resources but as long as the republicans continue to pour in money particularly from wealthy billionaires to support these two republicans, we know these will be tough races. We are in the margin of error. I am confident we can win. We have to work very hard in the next 50 days.
Senator peters, thank you for starting off our discussion. The
new york times is reporting that
chief justice roberts push the justices in the supreme court for a quick ruling in donald trump's favor and we will discuss that after the break but we do have breaking news to discuss after this break.
Jd vance has just spewed poison that is comparable and worse to some of the things donald trump said. He said the big difference between conservatives and liberals is that nobody has tried to kill kamala harris.
Senator whitehouse will join us next with that breaking news. We will be back. Serious disease. . . . That gets worse over time. If you see any of the
warning signs, don't wait, ask your cardiologist about
attrcm today. Still have symptoms from moderate to severe
ulcerative colitis or crohn's disease after a
tnf blocker like humira or remicade? put them in check with rinvoq. Rinvoq works differently and it's a oncedaily pill. When symptoms tried to take control, i got rapid relief with rinvoq. Check. When flares tried to slow me down, i got lasting
steroidfree remission with rinvoq. Check. And when my
doctor saw damage, rinvoq helped visibly reduce damage of the
intestinal lining. Check.
Rapid symptom relief. Lasting, steroidfree remission. And visibly reduced damage. Check, check and check. Rinvoq can lower your ability to fight infections, including tb. Serious infections and
blood clots, some fatal; cancers, including lymphoma and skin;

assassination attempts by crazy people into a political issue. Listen to what jd vance said tonight and what he is now calling the difference between conservatives and liberals on this issue. Let's listen. The big difference between conservatives and liberals is that nobody has tried to kill kamala harris in the last few months and two people have now tried to
kill donald trump in the last few months and i would say that is pretty strong evidence that the left needs to tone down the rhetoric. After saying that he then said he would be an example himself of toning down his own rhetoric. Joining us now is sheldon whitehouse
running for reelection in
rhode island a member of the senate judiciary
committee and author how the right wing used dark money to capture the supreme court and i do want to get to this reporting inside the court but i wanted to address this
breaking news story about jd vance assigning political motivation to two obviously crazy people involved in these last two events when there is no political motivation known. And then i don't know what you call it but is he complaining that nobody has tried to kill kamala harris? those are his words, nobody has tried to kill kamala harris. It is pretty stunning to talk about your political rival in that way. Obviously, it is happening because she is kicking their butts so they have to resort to this kind of rhetoric. I think it is pretty clear that both of these individuals who took shots at donald trump are not liberals. They are unhinged and have considerable connections into
trump world and all of that. So i think he is wrong on the facts. It is a deadly dangerous to start talking about people taking shots at kamala harris. Historically we know every president every vice president has faced a constant stream of
death threats throughout their service in both parties. I want to get to this reporting about the supreme court and the headline how roberts shaped trump's supreme court winning streak and here we have the
supreme court linking, again leaking this time internal memos about the
decisionmaking process which doesn't seem quite as patient and deliberative as they want to present it publicly. There were a bunch of interesting things about the story. One was they want to help trump to make a fast decision to get them on the
colorado ballot and he got a really fast decision. When it helped him to get a really slow decision to postpone the immunity decision, they postponed it until they realized they had a majority to create this very dramatic new
immunity doctrine and you described it very well and notably it appears that that the liberal appointees on the court didn't see that coming and they expect the district court's ruling in the court of appeals ruling and the lack of any such precedent anywhere in
history of the united states supreme court would guide the court to the logical place which is there is no immunity for president and this is the rule of
law country. So it does add to the shocking nature of this small group of right wingers creating this community. The third piece of course is the question about and i guess you would say what did he know and when did he know it? if roberts removed alito from the
insurrection case because of the
battle flag story that came out four days before he removed him from the case, super unusual to remove alito unprecedented, what he know before that because that story was available in the press and he knew about it back in 2021. Was there a moment when roberts new that the
alito family was flying these flags outside of their house and assigned him the opinion on the cases and stuck with it until the story broke years later? that is a pretty important question to get to the bottom of but through the whole thing, what you see is backstage maneuvers in this business that they are umpires calling balls and strikes, no. The analogy is broadway and the show is the big decision at
the end but behind it what we don't see is all the maneuvering by roberts that led to the
immunity decision and led to
citizens united. There was an enormous
maneuver strategy there.
Somebody somebody will write a book on
backstage maneuvering i roberts. The
roberts memo about the
immunity case, before the case is even formally before them, he is saying how he will rule on that case and expects the court to rule. He is trying to organize the gang of six together that he ended up being able to do and keying up the next extremely aggressive opinion which you do see also repeatedly here with almost no effort to reach out and try to find any kind of bipartisan compromise and once he has his majority he jams forward and you do see this in this case as well and it does begin as you said even before they have the case properly before them.

debate donald trump's
niece mary trump was more specific. He didn't inherit that. He was gifted and loaned that much money while his grandfather was alive and then he inherited $250 million.
Vice president harris said this about how donald trump began his career working with his father. Let's remember how donald trump started. He was land and he owned land and buildings and he was investigated because he refused to rent property to black families. An important new book by two pulitzer prizewinning authors that will be published tomorrow describes a prosecutor's interview with a
trump building superintendent at the time.
Thomas miranda said he was told by
three trump company employees including the
company controller to mark applications from nonwhite applicants with a large
code c for colored and he concluded his first interview by saying he feared
fred trump would have him knocked off. The book also reveals just how fake donald trump's socalled
reality tv show was and how much money he actually made because of that
television show and joining us now is suzanne
craig investigative reporters from the
new york times who
got a
pulitzer prize for the reporting on donald trump's personal finances in their new book coming out tomorrow is lucky loser, how donald trump squandered his father's fortune and created the illusion of success. Suzanne, it is hard for me to say the title without starting to laugh in the middle of it at that story because we have all felt various impressionistic versions of this story but
this is it. We now have the bible of the whole thing from start to finish and let's begin at that beginning with kamala harris that she talked about were donald trump and his father
fred trump find themselves on the wrong end of a
federal civil rights law. That was in the early 70s and interesting because that lawsuit has come against a number of other builders and it was all for the most part settled but
fred trump decided to fight was donald trump who made the decision to fight it and a lawyer spent a year or more fighting that lawsuit when if they could have settled it they ended up paying more but if they had settled it a would've saved money and spared themselves so much publicity. What were you thinking in the debate when you heard
kamala harris press what
all of us know as a button and you don't have to be donald trump's psychiatrist to know what gets him going but the thing about being handed the money from his father and then we have mary trump in her clarification over the next day but it did sound like an donald trump's reply he was trying to demean his father and say he was just a builder and he didn't say he wasn't a
big manhattan guy like me but it felt like he was trying to do that and the father was nothing compared to him. That has been one of the most startling things we noticed in the course of our reporting and one of the ways donald trump has always elevated himself is by denigrating his father to create this hard fable that is complete fiction and his father went
along for the ride and stood by when donald said i am way bigger than my father ever was. His father would nod and say yes he is. And when he would put it up at that point and they had a remarkable relationship. What we know about what donald trump's siblings thought about all of this and it seemed like not exact we a fair division of the father's estate. And there is this attention he said and he had his
namesake fred junior who died in his early 40s of alcoholism. He was cast aside early on in the race to become the head of the
trump organization and fred sort of landed on donald trump. It was incredible when we watch how no matter what donald did fred never said anything and it never made sense because fred was this businessman who wanted cash on hand. He didn't like debt and didn't want to give personal guarantees and here comes this guy who is the opposite of him and he became this black coal for all of fred's money but we never saw
fred weaver. I think the other dynamic going on to your question is robert was somewhat involved at times in the business but he sort of came along after this had been decided and he had two daughters who were never in the running. It was never a question like once fred landed on donald it was it. Let's take a break and we will come back to donald trump's
television career and how that worked. We will be right back. Together, citi and the

nbc show. The network agreed to pay trump an
appearance fee of $50,000 per episode which with the addition of the finale would work out to $750,000 for the season and this was on top of whatever he would make from the
profit split he and
mark burnett had agreed to in february. Suzanne, it turns out the gold was in the
profit split in this is fascinating for me having worked in
prime time tv programming programs that nbc and when trump would say i made $200 million from the
apartments apprentice and i said that is ridiculous and they would never pay him that much and as a salaried performer he would never make that much and it turns out he wasn't making it as a salaried performer. That has been something i have heard from you and most people would think he is a salaried employee and how would this happen in the magic of this was
mark burnett and the deal he cut. When he came in to pitch the apprentice he was coming off of survivor and he was redhot in hollywood. What he did is he said nbc they really wanted the apprentice and he said, okay you could have the revenues but i want this
product placement money and at that point it was still untested and they would be competing. They would be competing for that so
mark burnett got control of product placement in whatever he could get which means a
toothpaste company coming in and saying we want this and they will pay
2 million for show but that didn't happen in the first season of the apprentice but all of the sudden after the first season was a
hit and madison avenue was watching. All of a sudden
mark burnett productions are getting calls coming in saying we would like to be on this show and we will pay and it went up in season 4 to $4 million. What that meant for donald trump was every time a corporation paid or they wrote a check he would get half of it and it was a
money machine and in addition he was getting these deals off of it and it was unbelievable the amount of money. And then there is detail in this how he goes behind mark burnett's back and makes deals where he gets all of it that he doesn't split because of the show and when burnett and the producers first went to
trump tower over there where they thought we will shoot this thing and it will be great and in this glamorous corporate office of the
trump operation, they found out the place they were going to shoot actually among other things stink. It was an amazing moment to think of. These are people who are incredibly trained who spent years in the jungle
around the world filming survivor and taking videos of snakes and spiders to make you feel scared and they walk into this place where they are supposed to find this epicenter of
wealth and success in america and expecting this buzzing humming rich looking place and they do walk in and, yes, the first thing they notice is it reeks and the carpet has mold and everywhere they walk it was following them around and they are scanning for a sign of wealth and they see the furniture chipped and that all dates back 20+ years to when the building was open. They realized they not only have to reinvent donald trump to make him seem like something he is not but make a set. I knew from
friends of mine that
everything use on television was fake and it was the built set that he had never been in before. The book is lucky loser and this is really great coming out tomorrow and i just like saying the title.
