Your show. I was. Have a good night. Thank you. We're just 24 hours out from the vice presidential campaign. And already the harriswalz campaign has picked the most important part of that debate. It's really rich for democratic leaders to say donald trump is a unique part of democracy when he overturned peaceful power. Who won the election? i would rather focus on the future. You have a real clear choice of who's going to honor democracy and who's going to honor donald trump. That was an absurd statement that donald trump peacefully turned over power. If you watched the debate you would have seen j. D. Vance trying to put a normalcy. It is hard to defend donald trump's action. There's a lot of bad data points there. Tonight today it sort of feels like the news gods watched last night's debate and saw j. D. Vance appalling answer and decided to highlight the whole issue. Because today a federal judge in washington, d. C. Unsealed a partially redacted a statement from jack smith in which smith lays out why he thinks the case is very much prosecutable following the supreme court's immunity ruling. Smith lays out another new narrative of the case. And that all 165 pages of that, is what reporters and legal analysts have been pouring over all day today. Things like conversations with trump. And vice president mike pence before an angry mob called for mike pence to be hanged. At a private lunch, pence encouraged trump not to see the i election as a loss but as a pause. And trump asked pence what should we do. Trump should take a bow. Trying to get trump to think of his loss as an intermission. Suggests that pence wanted trump to run again and joining him in the future. But it was trump to conclude that mike pence lacked courage. Later in the filing, smith describe's trump's reaction when the capital mob threatened pence' life on january 6th. Upon receiving a phone call alerting him that pence had been taken to a secure location. A staffer rushed to the dining room to inform trump so that trump would take action to ensure pence's safety. Trump looked at him and said only, so what. The vice president's life is in danger and the president's reaction is so what. This new filing further sheds light on just how clencious trump was. Then we learned the degree to which the trump campaign explicitly encouraged violent disruption. Not just at the capital on january 6th. But in states where the vote was still being counted. You might remember this footage of angry trump supporters in detroit demanding access to the secure location where votes were being counted. This shows how trump campaign staffers appeared to active live encourage those people to commit violence. A coconspirator tried to sew confusion when the result looked unfavorable for trump. There when a colleague told that campaign staffer, we take a bunch of votes in trump's favor, right. He said look for a reason to it. When the colleague suggested there was about to be unrest reminiscent of the brooks brother's riot an effort to stop the vote count in florida after the 2000 presidential election. The staffer responded, make them riot. Do it. Joining me now is democratic congresswoman zell lauflin. I'm eager to get your initial reaction to this staunch of new material that the judge has unsealed today. A lot of it quite damming. Well it has detailed that we were not able to get. But i don't think the conclusion is really much different than we reached. This was a plot by trump to keep power in, even though he lost the election. He knew we lost the election. In fact, we found statements going back to april of 2020 where he said, you know, he was going to stay in power. He would not respect the vote. So this was, he never intended to seize power. We were not able to get testimony from the vice president. So there were some things in here that we didn't know. Certainly the who cares statement is shocking but not surprising keeping with his attitude. He called, he assembled that mob in washington. He knew they were armed and he sent them down to the hospital anyhow and he wanted to go with them. He tried to go with them. Congresswoman, the most ex ex explosive. A lot of it is explosive. A lot of people that aren't privy too is the so what statement. Because it is heartless to say nothing of the morals and ethics and being completely unconcerned that your running mate might lose his life in around insurrection you started. And there were 71 instances that trump threatens pence. To the point where they feel like they have to alert the secret service. The threatening of a vice president's life by its very nature can't be part of the role of the vice president, can it? well, it boggles the mind if it is. Clearly as, the prosecutor has laid out, these efforts were in his capacity as a candidate for president. And someone who is trying to keep office and not act as the president. So i think you know it's a compelling case. I think we'll see because if trump is elected president, he's going to order the department of justice to dismiss this case. And the supreme court made clear that any communication between the president and the doj is going to be in that immune bubble. But if he is not elected president, this case is going to go forward i think. And i think a solid case has been made that there's evidence sufficient to proceed and probably to convict. As a congressperson, i wonder how you're processing the details like trump campaign staffers encouraging election workers to make them riot. As we now sit a month before another election when donald trump is once again at the top of the ticket and once again questioning whether the election will be free or fair. Now has an army of poll watchers who are going to do his bidding. What's your concern there and how prepared is congress in the coming months and years ahead if trump is reelected. Well, we did of course make changes in the electoral counter act liz cheney and i were the lead on that to make it harder to overturn the election. Trump has been pretty overt, pretty open that violence is something he appreciates. All the way from urging his followers at rallies to rough up people they didn't like. And encouraging an armed mob to attack the capitol. He uses violence for his own purposes. And he is, threatening i believe to do that again. He sometimes uses code words. But his followers certainly understand what he's saying. They sure do. Congresswoman, thank you for making the time tonight. I appreciate it. I'm joined by chrissy greenburg. Thank you for joining us and helping us understand what was just gifted us by the news gods. It feels like there's three buckets. There's probably more but in all honesty it's probably 360 pages. Three really buckets where the special council is saying these are not official acts therefor, there should be an indictment. We should move forward. This is all stuff he can be held to account on at trial. The first are all the interactions with mike pence. It seems the supreme court has left open the door that some of the conversations and our actions between the vice president and president may just be prosecutable. In the filing, the special council goes out of his way to characterize the conversations as those friends would have. That they are conversations where trump is being encouraged by pence to acknowledge that it's over. Kind of like you would console a grieving friend. That the context and contest of the conversation reflect candid statements. I found it very convincing, reading through their exchanges it doesn't seem like it was a president and vice president talking. It seemed like a schoolyard bully and you know a victim. Like that's how it seemed. You have mike pence calling him on christmas to wish him merry christmas and saying, so you're going to go and certify that election. It was constant to the point that he was saying everybody is going to hate you. He does sound like a bully. Everybody is going to hate you. And you're too honest. The part that just hit me because going back to the intro, where is your part in the 360 page that they knew trump had lost and they knew these election fraud claims were bogus. That right there is one example. You are too honest. Again, it's hard to see how the supreme court can look at those statements and say, that was well within his official acts as president. When pence is talking to trump to try to get him off the ledge. It's not a vice president serving his president. It's a running mate saying, hey bro, we lost. We can try again in 2024. The fragility of this man's ego. It's just reading it. It was just very lame and pathetic but again not seeming very official whatsoever. The next part of it is the ellipse rally. They go out of their way to say this was not an official white house function. This was paid for, i believe by a grocery chain heiress. The special council is trying to establish that everything that happened there had nothing to do with official function. Anything that trump said there would not be deemed official acts, right. Right. And so, i think what jack smith sets up so beautifully when he gets to this point on january 6th. He takes you through days and days of the pressure campaign on state officials. The fake electors scheme. And now everything is failed and this is his last shot. This is it. He's got to get this crowd to stop the certification. Because mike pence isn't playing ball. And so, you know, seeing how donald trump, the words in that context with that fuller context everything that had come up before it, it just seemed so clearly designed to incite this riot. He's not charged with inciting riots but that's clearly where that statement is. How is that presidential. Vance does the same thing. Suggesting this is in no way official. This is completely unofficial. It's fair game for. Judge smith unveiled this. The public is digesting it. It's heavily redacted or partially redacted. Where can trump go from here. They get the chance to re examine the witnesses and confront them. And presumably for a number of these witnesses the way that they are characterized in the filing is not going to be the way that trump is going to characterize them. For example, eric kershman who is not identified by man but you can read between the lines and figure out who he is. He's described as a conduit from the campaign to the white house. Am at some point in 2020 he's actually working in the white house. They're going say, no no, this is official. He's a white house guy. None of this was just within the campaign and the candidacy. And with mike pence, i think it'll be a similar calculus of how much of this was official versus nonofficial. I think with those kind of varied facts and determinations he's probably going to want to hear from the witnesses. Those two witnesses are particularly important because those are the two that jack smith says, donald trump knew he lost because these two people told him and he knew it as of november 13, 2020. You have a lot of statements from donald trump back to them seeming to acknowledge it when hershman says this is not going to hold up in court. And trump says well details don't matter. Things like that. Those are really important facts for the judge. And i think he's going to want to hear it from the horse's mouth. Whatever she decides is going to get appealed and going back to the supreme court. That's a whole other question. Christie greenburg, thank you for your time and expertize. Thank you. The most interesting thing that we learned in the filing is just how much jack smith has about donald trump's behavior on january 6th. I think the january 6th committee did such a great job. I didn't know how much more material would be out there. Just kind of scanning what we've seen so far. You know, the knowing what trump was, what he was watching on his phone. Like as the riot was occurring. What the context was when he sent out the mike pence doesn't have courage tweet. The fact that people told him about the threats to mike pence and that he didn't care. There is, even additional information here added on top of the already damming stuff that we learned from the january 6th economy. And so, hopefully you know between that and what we saw from j. D. Vance last night kind of continuing to keep this story in the news as it should be. You know about refusing to say that donald trump lost the election. You k
