OTT regulation: A mirage in desert
 
The emerging 500 crores over the top market of more than 17 crore users would soon need to embrace the regulations and authority with its addition to Schedule 2, Government of India (Allocation of Business) Rules, 1961 (amended 2020) under the Ministry of Information & Broadcasting. This move comes in response to the notice by CJI Sharad Arvind Bobde led-bench of Supreme Court in a PIL seeking regulation of such platforms, hence should also avoid the criticism of centre-led initiative to come down on free speech.
Defining the term OTT
OTT stands for “over-the-top,” the term used for the delivery of film and TV content via the internet, without requiring users to subscribe to a traditional cable or satellite pay-tv. Started as hosting services of video content, these have now become major producers as well, somewhat relatable to the Amazon inventory model case, where they provide not only hosting services but are also involved in core businesses of distributing and producing content like ASUR on Voot or Netflix/Prime Originals as they are called. As per the notification – Films and audio-visual programs made available by online content providers and news etc. are to be regulated. The terminology of Online Content Provider would technically exclude the hosting services like YouTube or Daily Motion (would still include their premium OTT services like YouTube RED in the Indian context) where the company merely plays the role of the platform between users. Audiences are reluctant to search for truth and understanding between lines. There are many movies and series that claim to be based on real events but in the whole story, only one or two neglected events are taken from real life. Usually, we see any movie or series getting great views without creating controversy. Creating controversy is the best way to attract a foolish audience, a stunt well done by incompetent directors. If all these things don’t stop or the audience doesn’t grow, it will be very difficult to keep independent series and movies in the name of free thought.
