Supreme court has overturned a kansas ruling involving the prosecution of undocumented immigrants using false Social Security numbers when they apply for work this is going to open the door for states to more aggressively crack down on immigration were joined now by alan or Vice President of the American Immigration Lawyers Association an all round very small very smart lawyer has done a lot to help america help immigrants all over this country allan how d are you well thanks for having me. 1st of all could you tell us a little bit about kansas you know what the way i understand this is its a preemption what we would call a fight on a preemption issue which is the the what what is the relationship between a states right versus the federal preemptive right to preemptive orders thats kind of what this is coming down to isnt that right exactly its coming down to federalism and an understanding of who enforces Immigration Laws is it a federal issue or is it a state issue and when there is written contacts with and federal statutes with regards to what form information on that form can be used for can states use it for Something Else that is specifically what it sort of narrows down to so kansas look we have the right to criminally prosecute if we have laws that put these to say that this particular person did something wrong yes were familiar with the fact that the feds have some involvement in this arena but we havent lost our right under in what we call Health Safety in welfare protection of our citizens to do what we wanted to do so what theyve done is theyve said to immigrants what what are they saying immigrants right and so i think its a far stretch and to just talk about the facts of the case specifically in this case these 3 individuals were pulled over for a Traffic Violation so it wasnt an od a procedure at a company to see if the check in the Company Documents what the what the government can do at any level which is sort of relegated to the federal government and then they sort of went and found these documents and then they added on this charge and people being here undocumented is a simple violation right something and in most states when you volleyed an identity it is a felony so it is a work around to give states the ability to sort of enforce some type of Immigration Law because charging them with that felony would make them automatically deportable. So what we have here is we have its kind of a bonanza to go after immigrants on issues like you know i use this this id because i needed work i need to use a i do use a Social Security number because i needed a job to support my family and theyre saying well you shouldnt be here to begin with so were going to use this element of violating the law really is a reason to send you back to where you came from of until this ruling how has Work Authorizations for undocumented immigrants been handled by our court system up until the time that this kansas case has been tested by the Supreme Court right so this case is specifically about the form so generally the local state and force my officers would not use and i nonform to enforce some kind of state rules such as the sort of Identity Fraud rules it would only be the federal government that would come in either through an audit or through some kind of enforcement action to sort of get these documents and sort through them for the company. You know allan as i look at this here in america you know youre dealing with on the law of the time constitutional all the time and we talked about on this program sometimes when a state aggressively goes after the argument to say look we respect the federal government we know you have your rules but we have our rules too and our constitution our state constitution says above all things where it comes to the states right we have a right to protect Health Safety and welfare now what im saying what im saying is a pattern im saying the Supreme Court this is this is a series of immigration cases that were seeing right now in the Supreme Court is saying yes youre right state you have this right under Health Safety and welfare protection it seems to be expanding doesnt it you know well if you see in these immigration cases as youve already said theres a number of them and theyre all 54 which falls along political lines but sort of tells you that immigration has now become a political football but in this specific case what they did was theyve also expanded the scope of an employers liability under the same rules so now the employer that takes that information and knowingly provide that to that state on some other form right knowingly doing so is also now involved in this sort of Identity Fraud you know scheme and therefore should also be subject to these federal penalties so i think thats the undergirding from the legal analysis of how it sort of follows that i dont think they sort of thought in this case what they saw in this case was now were going to be able to get these immigrants and be able to deport them quickly and to sort of get them a felony crime because once again i want to state that the underlying document issue here has a deeper penalty than actually coming to the United States without documents one is civil the other is federal. Ellen of interviewed you before and i remember my last interview you said that as we expect to see conservative courts are going to further enable the not only federal government but theyre going to able the state governments to figure out ways to say you shouldnt be here you came here illegally and now were going to find ways to turn all that around this is one of those things your statement i think last time we talked is we expect to see this expanding more and more at the state level and at the federal level you see that is is whats unfolding here absolutely our problem is immigration is relegated to a federal issue and for whatever reason our congress is broken right the senate has not moved on any bills from the immigration they havent worked on immigration in 20 years either party right so this becomes a football and it goes to the states to sort of now sort of say were going to do what we want to do here which then makes greater disparity because these foreign nationals that are in one state that are in forcing it in other states arent are just going to move to the other state would in fact we both know its someones using someone elses so security line that it is not a hate crime in that sense because basically what theyre doing its paying taxes for someone else to get benefits for in the future. Yeah President Donald Trump has rebranded the north American Free trade agreement aka nafta with a new pact known as the us mexico Canada Agreement the us and ca passed with bipartisan support from Congress Democrats and republicans both cheered the gutting of nafta as controversial investor state dispute settlement clauses which empower multinational corporations to sue governments when laws threaten investor profits like you just said for example if the u. S. Were to implement new regulations expanding Environmental Health or Labor Protections canadian or Mexican Companies could then sue the American Government if those new laws undermined that companys ability to. Profit now under the same rules American Companies are also free to do the same so the new trade pact is different because its actually abandoned an investor state dispute settlements for most industries but there is now an exception for american oil and gas firms that have government contracts in mexico so u. S. Energy is really the big winner of this new north American Free trade deal. Well i mean the point is when we drill down on what the whole problem is with globalization one of it is were able you have a foreign a foreign country youve got france or wherever mexico is or wherever they come to the United States and we say to us you have affected our right to go to to come to america in cut down all of your timber you have affected our right to take our toxins and put them in your streams because youre affecting our business this is the same kind of analysis here but were giving this extra protection to the american oil and gas industry why it why is mexicos significant to this particular part of the story. Well mexico significant because International Companies now hold exploration and production rights and offshore and onshore blocks of Mexico Mexico is the number one destination believe it or not for American Gas Oil and refined product exports and before nafta only mexicos state owned Petroleum Company could operate in the countrys upstream segment but recent reforms in the last few years have actually opened the country up to more privatization and the problem is that these new trade agreement this new trade agreement locks those reforms in and makes it really hard for future mexican administrations to change their policies without the risk of being sued by the American Energy industry the whole reason these are problem is because they really impede on the sovereignty of these nations well thats the whole idea with this whole globalization though you know would you think about what you just said i mean i hope the viewers called that if if if mexico passes laws in they say to the oil industry what youre doing is hurting our people what youre doing is destroying our waterways is destroying our environment theyre not able theyre not able to push back when the oil Company Comes back in and sues them even though even though theres laws on the mexican books that say you cant do this or coburn in the oil company says those laws interfere with our right to do business no matter how horrendous the business may be my point is they were trying to do that in the United States under globalization in that were seeing that play itself out right here for those who dont know.
