Jolson Lim/iPolitics Richard Lee Desautel, an American citizen who has never lived in Canada, who shot an elk near Castlegar, B.C., has an Indigenous right to hunt in Canada, the Supreme Court of Canada ruled Friday in a 7-2 decision. His case marks the first time the top court considered the meaning of “Aboriginal peoples of Canada” as it is written in the Constitution Act of 1982 and could determine whether Canada has a duty to consult or negotiate with, or allocate resources to Indigenous people in another country.
