That senator says this. I wouldnt be surprised if a senator or a house member were killed. Up first for us, though, we count the midterm votes five weeks from tonight and there is a Blockbuster Development today in one of the senate races critical, absolutely critical to the Balance Of Power here in washington. The Daily Beast Reporting Monday Afternoon that georgias Republican Senate nominee, Herschel Walker, paid for a womans abortion back in 2009. Walker calls this accusation untrue. It is a flat out lie. And now you know how important this seat is. This seat is very important that theyll do anything to win this seat and lie because they want to make it about Everything Else except what the true problems that we have in this country is. This inflation. The border wide open. Crime. They dont want to talk about that. The former Football Star has campaigned on a no exceptions nationwide abortion ban. Now, cnn has not independently verified this allegation. But the Daily Beast Report does come with documentation, with receipts. The woman making the accusation provided pictures to the daily beast of what she claims is a get well card signed by walker. And the outlet says she also backed up the accusation with, quote, a 575 receipt from the Abortion Clinic and a Bank Deposit Receipt that included an image of a signed 700 Personal Check from Herschel Walker. Again, walker says its all a lie. But this complicates his effort, this here, very much so. Walkers 22yearold son, a Conservative Influencer in social media, says the Abortion Account convinced him it was time to speak out. Family values people, he has four kids, four different women, wasnt in the house raising one of them. Dont lie on the lives youve destroyed and act like youre some moral family man. Youve spent a lot of time on this race. Walker decided to go on Hannity Last Night and say its a lie. Inside the Walker Campaign what do they view as more damaging or how do they deal with the idea that you have this accusation from the woman about an abortion back in 2009 . You also have his adult son coming out and saying his father is not the person he claims to be in the campaign. And it is perhaps the son that is more damaging than the daily beast story because we dont know how long christian will continue to speak out. That is the real trouble here. But listen, the republican establishment seems to be rallying around walker for now. You have the nrsc as well as other groups saying that this is all a distraction mounted by democrats and their allies and that theyre going to stay ladsar focused on the issues. So theyre really saying all that they could say in this matter. But notably in these statements they are not repeating the fact that it is a lie. They arent denying the accusations themselves. And look what hes done time and time again. I mean, he the revelations that have come out since hes been a candidate really just go to speak to its a bad track record when it comes to credibility with voters. Because he criticized absentee fathers. Then it came out that he had a child out of wedlock. Then it came out that he had not told his Campaign Staff about two other children that hed had. Its just kind of been this pattern that youve seen. And there was a reason Establishment Republicans did not want Herschel Walker to be the candidate here, that they didnt want to initially put their support behind him, because the red flags were there. Right. So now were five weeks out, though, and the red flags were there. Much of the establishment wanted another candidate. Didnt get another candidate. So they rallied around Herschel Walker. So five weeks out the National Republican Senatorial Committee is comparing this this to smears against Brett Kavanaugh and clarence thomas. Walker zielded last night a candidate with Something Like this happens what do you want to do . Do you want to try to ignore . It . Do you want to deal with it by written statements or do you go on television . Herschel walker decided to call it a lie. I sent out so many get well sent out so much anything. But i can tell you right now i never asked anyone to get an abortion. I never paid for an abortion. And its a lie. What about the 700 check . Is there anybody you can remember sending that much money to . Well, i send money to a lot of people. I give money to people all the time because im always helping people. I mean, thats the Biggest Issue for Herschel Walker right now, is that his own son is saying if i talk more i could destroy this candidate, this candidacy from day one. Now their unease has come true. And you know, i think this is very problematic right now. Whats notable, john, though, is that democrats arent pouncing on this. Every day i get emails from democrats in georgia saying that walker is wrong for georgia, but on this the Democratic Party in the state silent. They dont want to overplay their hand on this. Im speaking to sources who say we shouldnt get too gleeful about this, look at the former president who went on to win election when very damning allegations came out about him in the final hour. So their response has been something to watch as well. And thats the problem with, you know, you have the majority of the public that supports some abortion in some trimesters and then you have this concern that you have politicians who will get out there and say oh, we dont believe in abortion but when it comes to their personal life they live a whole other thing. And thats the problem. People dont believe in it. They believe youre saying one thing and youre doing another. And if you want grace for yourself, you want to say maybe you evolved, thats not what hes saying, but you want to say i evolved, ive come to the light, i found jesus, but you dont want to give other people that chance. Thats the problem. And so the conversation last night, and in other races this morning, was that republicans are making some progress or at least stopping democratic momentum in some of these races five weeks out. If you look at you mentioned its a 5050 senate. So if you look at the map of Key Senate Races around the country, republicans are thinking we might lose pennsylvania. Theres a republican incumbent there, hes not running for reelection. Thats a competitive seat. If thats the case, if youre going to lose one as republicans, they havent ceded that, they want to win that race, but youre thinking we have to pick a couple of these blue states. You had Georgia Target number one. Then you go out to arizona, nevada. But in terms of the republican math New Hampshire. New hampshire. In terms of the republican math this is troubling. And there had been this sense i feel like among republicans that maybe democrats did have a really good summer and they were feeling optimistic but they were experiencing somewhat of a bounceback in recent weeks and then of course this headline comes out in georgia. And that has been the entire argument thats played out between rick scott, mitch mccom, donald trump about the quality of these candidates because so much hangs in the balance depending on georgia, depending on pennsylvania, and a headline like what came out yesterday with warnock with walker and the concerns about hypocrisy is not what they wanted to see i think also the democrats have been feeling much better about New Hampshire and arizona, which then make nevada and georgia extremely important to them. And you know, to your point i think the democrats are going to sit back and let everybody else talk about this. Their big goal is to win outright on election day. Otherwise, if neither gets 50 then it goes to december 8th, and theyre worried about the environment in a runoff there. Im sure theyre sitting there looking at this going maybe this can help us pull that off. All this as the kremlin Propaganda Machine tries to suggest all is well. Today president Vladimir Putin set to sign documents declaring four ukrainian regions are now part of russia. The bridges across which are being repeatedly hit. There have been voices certainly saying in in russian analyst circles that this area of kherson was very vulnerable to ukrainian attack. That appears to be under way. Theyve waited, theyve bluffed. They appear to have shaped the terrain ahead of them. And now theyre moving forward very fast. Quite extraordinary to see yet another front going against russias favor. Very hard to see how russia turns around this ukrainian momentum. John . Prosecutors unveiling new audio of an alleged oath keepers planning meeting in November 2020<\/a> where the leader, Stewart Rhodes<\/a>, you see him here, says, were not getting out of this without a fight. The twohourlong meeting was secretly recorded by an attendee. That according to the fbi agent michael palian, who is the prosecutions first witness in this important trial. Cnns sara sidner live now outside the d. C. Courthouse. Shes been monitoring whats happening so far. And so far pretty dramatic testimony. Reporter yes. Because it is coming out of the mouth, prosecutors say, of Stewart Rhodes<\/a> himself. And some of the other members of the oath keepers who are charged here with the most serious charge in the january 6th cases that we have yet seen, which is Seditious Conspiracy<\/a>. That is one of several charges. But that one is the most serious. And if theyre convicted they could go to prison for up to 20 years. So lets get into what we heard and what the jury heard in court today. They heard some of these secretly recorded audio of prosecutors say Stewart Rhodes<\/a> talking to his group. They had a meeting in november, as you mentioned, of 2020 around the time of the election. And here are some of the things that were said about what was happening in washington. One of the things said my only regret is that they should have brought rifles. We should have fixed it right then and there. If hes not going to do the right thing, hes just going to let himself be removed illegally. That is rhodes allegedly talking about President Donald Trump<\/a> at the time. But we heard more audio. The prosecutors played some of this audio in their Opening Statements<\/a> and then, using the fbi agent palian, they used him to verify that this is the voice of those people that they have listed out. So we heard some of that at the beginning of the trial but then we heard more from rhodes allegedly in these particular audio recordings. This is from a goto meeting chat where really its kind of the first time that weve seen the prosecution lay out a large piece of evidence that speaks to what they are charging these people with. And that is that they conspired to stop the transfer of power, the peaceful transfer of power from then President Trump<\/a> to president elect joe biden at the time. And one of the other things that we also heard is so our Mission Going<\/a> to go to d. C. , but i have to i want some oath keepers to stay outside and stay fully armed and prepare to go in if they have to, rhodes can be heard saying on one of these audio recordings. You also hear from other members of this oath keepers group. Kelly meggs saying weve been issued a Call To Action<\/a> in d. C. And that this is the moment we signed up for. So a lot of these things all sort of excuse me all sort of come together to try and prove the prosecutions case that this was a sedition Seditious Conspiracy<\/a> case. John. It is off to a fascinating beginning. Sara sidner will be there tracking it for us throughout the days ahead. Sara, thank you so much. Lets bring the conversation in the room. This is a legal proceeding. These five members of the oath keepers including the leader on charge for Seditious Conspiracy<\/a>. As sara notes they could go to prison for up to 20 years. Its a very important case, one of the most significant cases of all those charged in the january 6th. As we watch that play out we are now five weeks from tonight will be counting votes. There are still some members of the Republican Party<\/a> who want to downplay, almost erase your memories about what happened today. Just today incumbent republican senator ron johnson whos running for reelection. Hes on the ballot in wisconsin. This is him at a Chamber Of Commerce<\/a> event saying, not that big of a deal. Calling what happened on january 6th an armed insurrection i just think is not accurate. You saw the pictures inside the capitol. I saw it that day. The Armed Insurrectionists<\/a> stayed through the rope lines in the rotunda. The Armed Insurrectionists<\/a> stayed within the rope line in the rotunda. Simply flat out not true. Police officers were beaten. Staff members in the capitol, senators themselves, testimony in this trial, were under security. Weve seen flag poles used. Senator johnson at one point almost i dont know how to say it, casually says, well, we did learn how to use i aflag pole as a weapon that day. To say its not an armed insurrection is what . Wrong. Its hard to believe and i hate to directly contradict a senator. But he is you know, he was there. Hes seen this. And you know, theres been a lot of obfuscation after the event. I mean, it was a violent event. Its pretty chilling testimony going on in that court case of how much more violent people wanted it to be. I think one thing that we are watching for is whats going to happen with the January 6th Commission<\/a> and are they going to get a report out before the election. I mean, that was always the intention, is to remind people which is one reason the republicans hate it. Is to remind people that what occurred. And obviously, Senator Johnson<\/a> is concerned about it himself. I mean, the tapes weve all watched and the xerpss on the ground of all the people we work with sort of belie that. The filings in these court cases, the Witness Testimony<\/a> in these court cases that have gone to trial, including the one under way right now, the January 6th Committee<\/a> hearings, all the new video released, if on that day youre not sure what happened, you have no excuse for it well over a year later. Which is why you mentioned the January 6th Committee<\/a>. Its republican vice chairwoman liz cheney is literally traveling around the country trying to make the case that republicans have to come to grips, tell the truth about what happened that day. Were either going to embrace those ideology those ideological principles on which we were built or were going to go down a path of embracing insurrection. The embrace of insurrection, the embrace of the lies about the election have godden worse and more widespread. I wish i could say she were wrong on that last part, but you cant. No. And from the Oath Keepers Trial<\/a> thats happening right now to whats happening with the January 6th Committee<\/a> to the other Grand Jury Investigations<\/a> that are under way on what happened that day when it comes to fake elector schemes and whatnot, you get a better sense of the Bigger Picture<\/a>. And even listening to saras report there where shes talking about how this Oath Keepers Attorney<\/a> is saying he had no violent intent that day but then the jury in the courtroom is Hearing Recordings<\/a> of him saying i wish they had brought the rifles and talking about, you know, where they were stashing certain weapons. And i think that goes back to the Bigger Picture<\/a> of what this looks like. And republicans really just dont want to talk about it at all. They know that when it keeps getting brought up its not really effective for them. They dont really have a good perspective. And what theyre counting on is that voters will share that sentiment, that theyll care more about gas prices and about the economy, what thats going to look like. But every day you see whats happening in the courthouse, you see whats happening on capitol hill with the committee, the details come out, they only make it more stark of what actually happened that day, what we actually saw and what these lawmakers and everyone lived through. Well, its pretty clear that it was a very violent day. Ron johnson didnt hang around. You didnt see any lawmakers oh, let me go out and talk to these very peaceful people. They were gone because their lives were in danger and that was very clear. So to say this was just a peaceful day and this wasnt some violent insurrection when all of the lawmakers were running for cover, i mean, it just begs the imagination. But they continue to do this. And the problem is its not clear what can be done if people dont believe in the Voting Systems<\/a> in this country. And its important to tell the truth about that day because of the climate we continue to live in. Weblg all show the pictures of that day. Carl, you were part of a team of times reporters that had a piece in the newspaper over the weekend, threats against members of congress in 2021. 9,625. Thats up ten times since just 2016. Republican senator Susan Collins<\/a> of maine quoted in your piece saying, i wouldnt be surprised if a senator or a house member were killed. What started with abusive phone calls is now translating into active threats of violence and real violence. Thats scary, number one. And number two, it just tells you that everybody including Senator Johnson<\/a> need to call out the horror of that day. Yeah. Senator collins was concerned about saying Something Like<\/a> that, but that is genuinely how she felt. That this is whats going to happen and that, you know, people need to be aware. But what used to be kind of rare incidents are now everyday incidents. And you know, sometimes theres not a lot of sympathy for members of Congress Like<\/a> oh, well, this is your job and you have to take some of it. But this is not the kind of thing that youre supposed to have to take. And people are worried about it. People are real concerned. People are worried about it. And i just want to for the record bring this in. Just in to cnn, we have a statement to cnn from the johnson campaign. Johnson Campaign Spokesperson<\/a> Alexa Henning<\/a> says, the senator in that video clip you just saw was comparing the methods used by Racial Justice<\/a> protesters in the summer of 2020 with the january 6th rioters. The republican candidate for governor in pennsylvania, doug mastriano, back on the airwaves today for the First Time Since<\/a> may. For 30 years i wore the uniform of the United States<\/a> army. One of the Biggest Challenges<\/a> besides deployment was serving in alpha company. Theres a lot of pressure on these soldiers, you know. There were suicides there. Mastriano just one example of how many republicans running for governor are laying unusually low at least in terms of tv spending. Spending far less than their democratic opponents in a year where there are 36 governors races across the country. Cnns dan mer uk joins our conversation. Dan, you spent a lot of time in pennsylvania. It has a democratic governor right now who is term limited. Josh shapiro the democratic attorney general is the democratic nominee. He has raised a boatload of money. All the polls show him leading. Pretty modest ad by mastriano late in the campaign. Take us inside the strategy. Its a drop in the bucket. I dont think theres any other way you can describe it. 1 million ad buy in a state with so many Media Markets<\/a> at a time that josh shapiro, and i have this number written down, 7. 3 million in the last 30 days on ads alone. Thats just in the last 30 days. Its a drop in the bucket at a time when mastriano is kind of in a perilous point in his campaign. Theres been very little spending on air for mastriano. Theres been a republican superpac that has spent on behalf of antishapiro ads. And the leader of that pac has signaled that theyre getting squeamish, that they might stop some spending, they dont like the fact that mastriano has not closed any gaps in polling and they might stop airing those ads. So it seems like mastriano felt like he had to air these ads, had to put something out on tv to just get something on the market to take the race to shapiro. I also think its noteworthy that a lot of that focused on both his military service, and mastrianos barely in that ad. He opens it a little bit, he closes it. Theres photos of him obviously serving. But its a lot of the voice of other people. That is distinctly different than mastrianos the Race Mastriano<\/a> is running on the ground in pennsylvania. And on the on the ground the democrats say hes out of the mainstream on abortion, he has some past times to white nationalists, or questionable characters. You see an ad like that, if there were real money behind it i would say the strategy is to say im a normal guy who served in the military. Theres not real money behind it. So i think its more of a keep somebody happy. And how do you win a race if youre not doing hes not even doing local media from what ive seen. Its not like hes going out and doing interviews, talking in all the Media Markets<\/a> that they have. Hes doing one ad, no mail. It just raises a lot of questions. And even republicans are asking these same questions because how do you win a race like that . Its a lot easier to win a primary with the backing of former President Trump<\/a>. Its a lot harder to win the general election in this sense. And so its been a big question for them too of what the actual strategy is. Theres a lot of anger at trump for meddling in this primary and then not spending in the general. Very little spending on mastriano. Obviously he backed him in the primary late. That is a source of anger among republicans as well. And it is a new republican strategy. Que the question is why. If you look tudor dixon the republican candidate for governor in michigan. Mastriano in pennsylvania. You have the candidate for governor in illinois, democratic candidate for governor im sorry, republican candidate for governor. The republican candidate in maryland. All not spending any money between their primary and october. That is unusual to say the least in a competitive year where republicans at least began the year thinking theyd have chances. Well, they are unconventional candidates. So this is a very unconventional approach. Some of it is just lack of money. Im sort of sorry he did start advertising because i wanted to see how this actually worked if youve never ran an ad. But ive been watching, john, how these governors races are affecting the senate races. And in pennsylvania you see this very determined Democratic Campaign<\/a> for governor. I think that that polls along the democrat for the senate because theres not much other advertising going on there. So and thats going on in a couple of states with both parties. Absolutely. Its one of the fascinating questions five weeks out. Just today the Cook Political Report<\/a> moved the Pennsylvania Senate<\/a> race to a tossup. Fetterman it was i alean democrat. Because there is clear evidence of momentum for dr. Oz the republican candidate in the polls, even though i think fetterman i havent seen a public poll where fetterman is not leading. But its a smaller lead. So thats a giant question. Does the governors race in pennsylvania affect the senate race . Does the governors race in georgia we were talking about Herschel Walker<\/a>s problems earlier. Republican brian kemp seems to have a Comfortable Lead<\/a> there. We could go state by state. But we have ticket smith, which doesnt happen in president ial years anymore. But we have a lot of it in midterm years. In georgia we do have some reporting from some Member Station<\/a> wheres theyre talking to people who are saying they will vote for kemp but when it comes to walker theyre not going to go there. So i think you could see some Ticket Splitting<\/a> especially in places like georgia, especially with a candidate like Herschel Walker<\/a>. It is less than there used to be. And i think people some of it is a function honestly of how the ballot is constructed. But then you have a case where like jon tester in montana a few years ago won by 30 or won when he was getting crushed on the president ial side. Theres also an argument to be made that mastriano helps oz with conservatives. Conservatives hold so many questions about oz. Mastriano is a conservative. Conservatives across the commonwealth are devoted to him. If they go to the ballot box to vote for mastriano theyre going to likely pull the lever for oz as well. Theres a dynamic there where oz could actually be helped by mastriano in a kind of a weird way. The chest, if you will, going state by state through the races, who needs what. Whats the other guy need . Democrats also increasingly in the final weeks, they thought they could take back arizona. The republican governor is not running for reelection there. Democrats thought thats a tossup race at best. Some people lean it republican. Democrats also nervous about the governors race in addition to the senate race out in nevada. Again, five weeks out. But you had the started as a big republican year. After the Dobbs Decision<\/a> democrats had momentum. Heading into the last five weeks i think both sides would agree on this, that the democratic momentum has at least plateaued and republicans say they think they have some. And even people inside the white house have said similar when theyve talked about this because there is this sense i mean, look at whats happening with gretchen whitmer. Her campaign has said yeah, the polling looks really good but dont believe that. And the white house has noticed this and said this is something theyre focused on, that theyre talking about, because they are worried the last five weeks you could see a difference. And you have inflation that is hitting people hard, that is going to make it very difficult for democrats and especially when you have voters who say they trust republicans more on inflation and the economy. And the other issue is crime. And thats where republicans have a huge advantage and they have been driving that issue home, that fear of crime and saying that they are the ones that can be tough on crime, law and order, law and order. Its a claim we now know to be false. And trumps then attorney, alex cannon, refused to relay that message. Sources tell cnn cannon had been working out of new york and could not confirm trumps claims. The former federal prosecutor, defense attorney shan wu joins us now. The innocent explanation is mr. Cannons working in new york, cant personally do the inventory, says i cant sign that piece of paper until i with my own eyes can verify it. Another interpretation is donald trump asks him to do something, hes in another city, he says i dont trust this, im not signing it this. I think its a great example of how lawyers need to remember to distinguish between making a representation versus their advocacy. Cannons remembering that distinction. He cant vowed for whats in there so hes not going to make those representations to the government. I think Something Else<\/a> weve seen in the reporting thats interesting is he didnt want to look in some of those boxes because he was worried there could be classified documents and told others to be wary of that as well. So thats very curious because why is he worried about there being classified documents in there . Thats a very important point. We know now, new email released by the National Archives<\/a>, shows trumps team was contacted in 202 1, told at least two dozen boxes of documents are missing. Among the missing documents, correspondence between former President Trump<\/a> and kim jong un and the letter he received from barack obama when he took office. This came up in a conversation with Maggie Haberman<\/a> of the New York Times<\/a> for her new book confidence man. Listen. Did you leave the white house with anything in particular . Are there any Memento Documents<\/a> you took with you, anything of note . Nothing of great urgency. Okay. I have great things there. You know, the letters that kim jong un letters, had many of them. You take those with you . Look at whats happening wow. No. I think thats i think thats in the archives. But most of it is in the archives. Okay. He starts he seems to start again, its interpretation, saying kim jong un and then when she challenged, whoa, you took those, then its like oh, no. I mean, his word selections instinctively careful. He says most of them are in the archives. So he thinks thats covering him. But of course it doesnt because its not that most of them should be in the archives. They should all be in the archives. So as usual, he thinks hes able to control the conversation but hes actually revealing a great deal. That case is on its in pause, if you will, going through the special master process. But we do know at one point that one of trumps attorneys in florida did certify to the government that all of the documents were returned. And then obviously the fbi executed a Search Warrant<\/a> and found dozens of documents. What happens to that attorney in that case . Can the attorney say i just did what i was asked to do, the client said they were all gone . Well, the first thing is getting to that point where the Attorney Says<\/a> that means that the privilege is pierced. And i dont know what dojs doing, but they certainly should be seeking to talk to that attorney. And that attorney, great example of representation versus advocacy. You dont want to make a representation like that to the Justice Department<\/a> unless you are absolutely certain thats rock solid. So that converts them into at the very least witnesses.
