Closed doors for the last several days ever since cnn and other outlets called this race for joe biden. The president has continued to push these baseless accusations that the selection fraudulent and it has been stolen without providing any evidence from his campaign or Campaign Officials with their claims and voter fraud and what has been happening if these critical states where the president has been lagging behind. Now theyre planning these rallies where the president can go on the road, talk about what hes been saying here. And thats a message that could resonate with his supporters who believe what the president says. Despite that, despite the push by the president and his allies, weve talked to state officials, weve talked to election administrators, county fwls these allegations from the president and his campaign and of course, the thing is, if theyre alleging this fraud, they have to go to court, get affidavits for it, go to the fbi. There are steps to take if you actually legitimately believe there is fraud west should note the Trump Campaign has set up this voter fraud hotline. Im told last week they set up a Conference Room where they could field calls about the accusations of voter fraud. Im not a lot of calls have been prank calls coming in thispath theyre continuing to pursue even as joe biden is mofg full steam ahead with pursuing his transition to power, starting with formulating this potential Coronavirus Task force. The question that is really surrounding the president and his advisers, how much longer can he deny the reality publicly if he doesnt ever accept or concede the race, they still believe the president at some point will acknowledge the fact that he is not going to be remaining in the white house in about two months. On. Its interesting that theyre claiming voter fraud after the fwlakt the gop did have poll watchers in their while these mailin ballots were being processed in most of the states around the country except pennsylvania and wisconsin which started the day of the election. So they had the chance then to challenge ballots, to get them tossed out. It is very hard to do it after. All right. Thank you for that. Lets talk more about that with the senior legal analyst, laura coates. Thank you for coming. On lets talk about this deeper. The legal had plans, talking about it after the fact when they could have made the claims before and challenged ballots. Could they change the outcome of the election with what theyre doing right now . It is highly unlikely they could. The margin of victory in the states that theyre challenging the results in, the margin of victory compared to the number of ballots being challenged is yes. So you dont have this notion where it will be able to be overturned. The key phrase is, after the fact. It is exceedingly, if not impossibly difficult to be able to try to gather up evidence after the fact. You have to go and try to essentially put a jigsaw puzzle back together. You cant do it if you dont have the actual in the moment evidence of fraud. Of chair tal error, something else, of intimidated. If you dont have that, you are beginning with the result and trying to work backwards for the steps to get there. It is like putting tooth paste back in the tube. When they processed the maibls, they check the signature and everything. Then the ballot with the vote is separated from the envelope. You cant then put the two back together. It would be very difficult to challenge them. Lets talk about the from the republican, that is destructive to the cause of democracy suggest widespread fraud or corruption. And hes seen no evidence of that. Listen to these other prominent republicans on the president s legal challenges. 70 million americans voted for donald trump and they he and the president deserve to have this process play out. A couple of republican governors are the ones responsible for a couple of the states that are still in question. They havent questioned the results. We want to make sure every single vote is counted fairly. There are legal processes but i dont think well see anything that has overturned the election and i havent seen anything that is widespread. Thisway it works whether you like it or not. It is time to get behind the winner of the race. So is there harm in letting it play out . Does this look line purely an attempt to delay the inevitable as much as possible . Well, first of all, the process will play out. As much as we have the popular vote and we tallied up those, the Electoral College has yet to convene. It is yet to be organized and you have not had a total certification. So the process will play out. Theyre trying to conflate two concepts, the idea of the College System playing out and the idea that somehow because people are claiming with bold assertions of fraud without an eye oata of evidence, that it is enough to undermine the integrity. Remember here, were talking about the presidency, the head of the executive branch of government whose job it is to enforce the laws. Well, voter fraud has a legal definition. Youve got an entire division, a whole section in the department of justice devoted to just that. I was a part of it. And the idea here that simply saying, im going to use the umbrella term fraud and home to envelope everything underneath without substantiated evidence is really hard on democracy and makes people question the motivations here. It seems to me, an old saying. If you get to the end of your rope, tie a knot and hang on. The president is tying a knot but it is slipping through. People can see perhaps what this is all about. Weve clearly seen this play out in the court in the few days after the election. The Trump Campaign, the republicans havent made much head way. And i was talking to a source who says, there is this idea being tossed around of running out the clock so they could put forth a slate of electors or push states to put forth a slate of elector thats would support trump in states where biden won. As you know, laws vary from state to state. The Supreme Court said it is okay for states to have laws that require electors to support the popular vote. Do you think this is a realistic possibility . You know, unfortunately, weve seen that anything seems to be possible as terms are trying to assert a position. But realistically, youre talking about what would happen if people tried to put up competing slates of electors and had the house and senate decide the presidency. What a contravention of what weve been accustomed to in our modern democracy. The date to watch here is december 8th. Thats when every state will be scrambling toward. Why . Thats the safe harbor deadline. If youre able to have the results known in your individual state, then essentially, the Winning Party is able to have their electors who then present the votes for the senate and the house to vote and count in january. So this idea of having the Supreme Court weigh in, bush v. Gore before that, and remove it from the house, this is something that would really be quite a the novelty in american history. The idea of the power of the people deciding the president of the United States, not litigation strategy. Right. So you have december 8th, the safe harbor deadline. December 18th theyre supposed to get together and count. And then january 6th, count the vote. So those are the important dates we should keep an eye on as it unfolds. Thanks so much. Thank you. Well, the numbers tell a very different story than the one President Trump wants you to believe. Ballots are still being counted in several key swing states and bidens lead is holding. The senior political analyst is here now. Mark, this is math. Simple math. Where does the vote count stand now . Well, to that point, it is slowly getting there but were getting there in several states. Lets look at the state of arizona. A state that the Trump Campaign might actually have a shot of winning. Right now, there is just shy of a 17,000 vote difference between joe biden and donald trump in this state. Now, this is a state the democrats have not would have since 1996. Where are these votes that were looking at . Were still waiting on 18,455 signature verified ballots that are left to be counted in maricopa county. 10,900 provisional ballots that are left to verify. And 3,700 left to verify in maricopa county. That is in and around the phoenix area. Now, going down to pineal county, 1,800 provisional ballots. While we see that the lead has shrunk for joe biden to about 17,000, the idea that there could be a recount will be a High Water Mark for them. The Trump Campaign to get to. Because specifically, pam, the way to get a recount in arizona that you have to have a victory that is less than 200 votes or. 1 of 1 . So that is unlikely to happen. In georgia, lets take a look out there. This is a hotly contested race as we know it. 16 electoral votes that are on the table. Right now, there is a biden lead right now. But it is only about i about. 2 Percentage Points if you look at that. Lets look specifically where those votes are that are still waiting to be counted. Gwinnett county in the northeast corner, 965 provisional ballots need to be reviewed. 535 absentee ballots need to be reviewed. And three military ballots to be reviewed. So talk about getting down into the real data points there. Now heres the deal wefrlt havent called this race because of the tight margin thats we are seeing. But we expect this very much to go to a recount. Weve sustain Trump Campaign, doug collins, to lead the recount efforts in georgia. The way it goes to a recount is once all these votes are certified, then you will have two days, the Trump Campaign will have two days to ask for a recount. If it is less than. 5 . And it looks line it is going that way. There is so much talk about pennsylvania. This is state that helped joe biden win the day. Look, joe biden has a lead of about. 7 . He is the president elect. Where are those outstanding ballots . So much talk about fraud and what have you. Well, we have them right here. There is about 55,692 votes to count statewide. Ska in alleghany county, a little more than 12,000 votes left. And philadelphia county, 11,000 plus, 11. 1 left to be counted. So we have to point this out. While we talk about all these votes, we know that joe biden is the president elect. We have to make sure that, to relate that these are not just data points. These are peoples votes. Everybodys vote should count. So thats why were giving you these numbers. And specifically if you look down in georgia, there is a race going to carry into january when we see very likely, well have two Senate Runoffs in the controlled senate on the line. Pam . All right. Despite President Trumps refusal to concede the election, president elect joe biden is moving forward with plans for his administration, launching a transition website today. Were following the very latest. He has laid out four priorities for his administration. What is he going to focus on first . Well, pam, in the very first days of president elect joe bidens team, he is going to hone in on the coronavirus pandemic. Tomorrow he will be announcing the formation of a 12person Coronavirus Task force as he is looking to get to work right away, tackling this health crisis. The coronavirus pandemic really shaped. So of joe bidens messaging in the closing months of this campaign. And it is now going to shape these early days of the transition period. Biden has talked about how he wants his response to be led by scientists and experts and that is something you will see play out as he announces this team tomorrow. And bidens team has been working behind the scenes for many months, preparing for this possible transition. Putting together a list of possible cabinet members and taking a look at policies. It is expected that joe biden will sign a series of executive actions in his first day of office, trying to undo some of the actions that President Trump has taken. This includes rejoining the paris climate agreement and also, rejoining the world health organization. These are things that joe biden has talked about out on the campaign trail, that he is hoping to make good on once he is in office. And as this transition period plays out, there is still a technical point that needs to be addressed. It is something called ascertainment. The General Services administration of the administrator needs to determine that joe biden has won the election and become president elect. And then she will sign a her that releases funds the Transition Team can use to move their team and their transition process forward. So thats something to watch for in the coming days. Today the president elect attended mass with his family. While he was at that Catholic Church he visited the gravesite of his late son beau biden. You can see in those images, beau bidens son hunter biden is there. The former Vice President is holding him as they visit beaus gravesite. A touching weekend this has been for the entire biden family. And hes also relieved congratulatory phone calls including from george w. Bush. He released a statement saying he spoke to both joe biden and Vice President elect Kamala Harris. Announcing they have differences but joe biden has earned the right to lead the country and unite it. There is one person that joe biden has not heard from. And that is the current president of the United States, president donald trump. And bidens Senior Adviser talked about that earlier today on cnn. Take a listen. I dont believe anyone from the white house has. I think the white house has made clear what their strategy is here. And that they are going to continue to participate and push forward these flailing and in many respects, baseless legal strategies. So joe biden is putting all of that aside.
