FBC Lou Dobbs Tonight February 1, 2017

Gorsuch is more sceptical of government. Being prolife, being pro gun, gun rights, i think they both set that mold. Both would allow him to say to his base, this is way promised and this is how i delivered. Working on the Third Circuit court, with the president s sister, some people think, that gives him if you will, a little bit of an advantageous. I know the president s sister. We were judges in new jersey together. A formidable woman. Personality and intellect. Lou i was on a jury in which she was the judge it was a civil case. You would have been a teenager in those days. Days. Lou i was, i assure you. Here comes the president. We are about to find out. Judge map with me throughout. Stay with us as the president approaches the podium. [applause] thank you. Thank you very much. Thank you very much, ladies and gentlemen. When Justice Scalia passed away suddenly last february, i made a promise to the American People. If i were elected president , i would find the very best judge in the country for the Supreme Court. I promised to select someone month respects our laws, and is representative of our constitution and who loves our constitution. And someone who will interpret them as written. This may be the most transparent judicial Selection Process in history. Months ago as a candidate i publicly presented a list of brilliant and accomplished people to the american electorate and pledged to make my choice from among that list. Millions of voters said this was the single most important issue to them when they voted for me for president. I am a man of my word. I will do as i say. Something that the American People have been asking for from washington for a very, very long time. [applause] thank you. Today i am keeping another promise to the American People. By nominating judge neil gorsuch of the United States Supreme Court to be of the United States states Supreme Court. And i would like to ask judge gorsuch and his wonderful wife louise to please step forward, please. Louise, judge . Here they come. Here they come. [applause] so was that a surprise . Was it . I have always felt after the defense our nation, the most important decision a president of the United States can make is the appointment of a Supreme Court justice. Depending on their age, a justice can be active for 50 years and his or her decisions can last a century or more and can often be permanent. I took the task of this nomination very seriously. I selected an individual whose qualities define, closely define what we are looking for. Judge gorsuch has outstanding legal skills, a brilliant mind, present discipline and has earned bipartisan support. When he was nominated to the tenth Circuit Court of appeal, he was confirmed by the senate unanimously. Also can you believe that nowadays with whats going on . [applause] does that happen anymore . I think its going to happen maybe again. Also with us tonight is maureen scalia. A woman loved by her husband and deeply respected by all. Im so happy she is with us. Where is maureen . Thank you very much. She is really the ultimate representative of the late great Justice Antonin Scalia whose image and genius was in my mind throughout the decisionmaking process. Not only are we looking at the writings of the nominee, and i studied them closely, but hes said to be among the finest, most brilliant of any judge for a long, long time. And his academic credentials, something very important to me. Education has always been a priority, are as good as i have ever seen. He received his undergraduate degree from columbia with honors. He then received his law degree from harvard, also with honors where he was a truman scholar. After harvard he received his doctorate at oxford where he attended as a marshall scholar. One of the top academic honors anywhere in the world. After law school he clerked on the Supreme Court for justices byron white and anthony kennedy. Its an extraordinary resume. As good as it gets. Judge gorsuch was born and raised in colorado. And was taught the value of independence, hard work and public service. While in law school he demonstrated a commitment to helping the less fortunate. He worked in both harvard prison Legal Assistance projects and harvard defenders program. I studied he aspect of his life. He could have had any job at any law firm for any amount of money. But what he wanted to do with his career was to be a judge to write decisions and make an impact by upholding our laws and constitution. The qualifications of judge gorsuch are beyond dispute. He is the man of our country and a man who our country really need and need badly to insure the rule of law and the rule of justice. I with like to i would like to thank senate leadership. I hope democrats and republicans can come together for once for the good of the country. Congratulations to you and your family, may god bless you, may god bless our glorious nation, judge gorsuch, the podium, sir, is yours. [applause] thank you. Mr. President , thank you very much. Mr. President , mr. Vice president , you and your team have shown me great courtesy in this process. And you entrusted me with the most solemn assignment. Standing here in a house of history, acutely aware of my own imperfections. I pledge if im confirmed i will do all my powers permit to be a faithful servant of the constitution and laws of this great country. For the last decade i worked as a federal judge in a court that spans six western states serving 20 of the continental United States and 18 million people. The men and women i worked with are an inspiration to me. I watched them tend together rule of law, enforcing the promises of our constitution and living out daily their oath to admin ever justice to rich and poor alike. Following the law as i find it and without respect to their personal political beliefs. I think of them tonight. Of course the Supreme Courts work is vital not just to a region of the country, but vital to the whole. And the couldnt knew th andr constitution. The towering judges who served in this particular seat of the Supreme Court including Antonin Scalia and Robert Jackson are much in my mind at this moment. Justice scalia was a lion of the law. Agree or disagree with him, all of his colleagues on the bench share his wisdom and his humor. Like them, i miss him. I began my legal career work for byron white, the last coloradoian to serve on the Supreme Court and the only justice to lead the nfl in rushing. He was one of the most courageous men i know. When he retired he gave me the chance to work with Justice Kennedy as well. And like Justice White he taught me so much. Im forever grateful. If you ever met Justice David sentel. You will know how lucky i was to land a clerkship with him right out of school. Thank you. These judges brought me up in the law. Truly i would not be here without them. Today is as much their day as it is mine. In the baffle my professional life, i had the privilege of work as a practicing lawyer and teacher. I enjoyed wonderful colleague hospital support whose support means so much to me at this moment. As it has year in and year out. Practicing in the trial work trenches of the law. When we judges don our robes, it doesnt make us smarter, before it does serve as a reminder of whats expected of us. Impartiality, independence, cleanin. I look forwardw to speah members from both sides of the 00. Answering their questions and hearing their concerns. I consider the United States senate the greatest deliberative body in the world. And i respect the role they play in the confirmation our judges. Its for congress and not the courts to write new laws its the role of judges to apply, not alter the work of the people representatives. A judge stretching roar results he desire ofs rather than what the law demands. Im so thankful tonight for my family, my friends, and my faith. These are the things that keep me grounded at lifes peaks and sustained me in its valleys. To louise my incredible wife and companion of 20 years. My cherished daughters who are watching on tv and all my family and friends, i cannot thank you enough for your love and prayers. I could not attempt this without you. Mr. President , i am honored and i am humbled. Thank you very much. [applause] lou judge neil gorsuch, the president s choice to joint Supreme Court as the 9th justice. An extraordinariy man as the president rekowntd and you just witnessed in his simple, straightforward language which was elegant indeed. With me, judge andrew napolitano. I now were involved in the process. You counseled the president privately. Your thoughts about this judge becoming a justice of the Supreme Court. The president not only said he wanted a bright, experienced, experienced just jurist, but he wanted one most similar to Justice Scalia. An academic, interest atlantic. A wit, a person who writes with clarity but with flair and humor and shares some of the same values as Justice Scalia. Politically the democrats will have a difficult time challenging him. Look at the academic background. Ph. D from oxford as well as harvard law degree. Lou what does one do with a doctorate of philosophy from oxford if you are a lawyer. One usually teaches which judge gorsuch also does. I believe the university of colorado in the evening. Because hes judging during the day. A person against the universal accolades of his colleagues. And a opinion shares and a person who shares a healthy scepticism for the government which is something the president who nominated him also shares. And the justice whom he seeks to replace also shared. Lou millions of americans as well. Appointing him to the Supreme Court. Its a fascinating moment. With the democrats and Chuck Schumer vowing scorched earth, vowing hes going to leave this seat open in perpetuity i guess if it were up to him. And all three branches of government. How do they obviate this, how do they overkoivment an over ovd move this man into Justice Scalias seat. Thats up to the political sophistication of mitch msh mith mcconnell. What he does with the filibuster rule will be the first decision he will have to make. Lou how critical is it, we are looking at his remarkable background. Private practice, extraordinary background. Going back to his academic backgrounds. I havent seen a more impressive background, columbia, harvard and oxford. Im not easily swayed with these things. But this man has a hour house mind. You asked what a judge with a ph. D does with a ph. D. Its unusual for judges and lawyers to get a ph. D. Oaf case alley one ends up on a federal appeals court. And he would be the first on the Supreme Court, i believe, to have. Ph. D to have a ph. D in philosophy. Lou if we cant bestow a ph. D on peter barnes, great work, peter. Too cory gardner, the senator from colorado, got a front row seat. Hands off to john decker from fox news radio who is a lawyer has been around and seen these things in the past. This will be a fight. Signs was announced, my inbox on my iphone was flooded with emails from supporters and opponents. And obviously the big question is how far is Mitch Mcconnell willing to go to get this nominee across the finish line. Democrats would need 8 democratic votes to be filibustered. And right now, its not clear where those 8 democrats are. And of course as you know, harry reid back in 2013 triggered the Nuclear Option for every seat but a Supreme Court nominee. So far it sounds like Mitch Mcconnell wants to keep the filibuster. Well see how far he will be willing to go. Lou great work. Thank you very much. Peter barnes from 9 white house. Its interesting sometimes if you cant do the addition in this instance, that is, get the 60 vote, you do subtraction and get it down to a simple majority. How important is it to move him through committee and move him into confirmation . The last conversation i had with donald trump, he was the president elect. I dont think im spilling the beans. He told me he wanted his company confirmed by early april. Thats a short period of time. January is over. So thats about two months. Its very, very significant. In april the Supreme Court takes its last batch of cases for the year that it will decide by june. And he knowing that wanted his nominee on. So they are really going to try and get this done. Chuck schumer wants to delay it. He doesnt want the 9th justice to be sitting by the type the Supreme Court make these decisions. Mitch mcconnell and the Republican Forces will do their best to get it through. Lou how how long do you think e American Public can col rate this level of nasty opposition that i think is perilously close to subject version. I dont know how long the American Public will tolerate it. But i know the more they learn about this charming selfeffacing brilliant guy, the more difficult it will be for them to sustain the opposition. The opposition will come from two forces in my view. It will come from the gun control crowd and the prochoice crowd. Two crowd that are accustoms to being allied. Chuck schumer will stir the pot but i dont know how he can sustain opposition to somebody. Lou when you say opposition, opposition to what or whom . Judge gorsuch. Do you think the gun control crowd and the prochoice crowd will be opposed to him. Not because he said i want roe versus wade reversed. But he has given end case that hes on a prolife and pro gun side of things. Lou are there cases that you believe are so critical right now that this justice associate justice can decide . Already serious challenges to excessiveover reach by the epa that we have much need the fifth vote to tip the scales. And the decisions below went in favor of the epa. So Chuck Schumer delays, the epa wins because the tie goes to the lower court. Lou as always, great to have you here. We appreciate. Lou the president nominating judge neil gorsuch. A former clerk for Justice Clarence thomas and charlie hurt join me to analyze the choice and of course the dirty, nasty my business was built with passion. But i keep it growing by making every dollar count. Thats why i have the spark cash card from capital one. With it, i earn unlimited 2 cash back on all of my purchasing. And that unlimited 2 cash back from spark means thousands of dollars each year going back into my business. Which adds fuel to my bottom line. Whats in your wallet . And the wolf huffed like you do sometimes, grandpa . Well, when you have copd, it can be hard to breathe. It can be hard to get air out, which can make it hard to get air in. So i talked to my doctor. She said. Symbicort could help you breathe better, starting within 5 minutes. Symbicort doesnt replace a rescue inhaler for sudden symptoms. Lou back with us is chief counsel, policy director for judicial crisis network, former Supreme Court clerk for Justice Clarence thomas, and charlie hurt. Carrie, you didnt want to difficult you will have knowledge anything before the announcement. Is judge gere such the man you wanted . Absolutely. Its like hes out of central casting for who is the best person to step into Justice Scalias shoes. He has such a principled record on the bench. His academic credentials are beyond compare. And his writing style can people have said resembles Justice Scalia. Its incisive and entertaining. Lou it struck me as he spoke tonight, accepting the president s nomination, he has that eloquence of simplicity and straightforwardness. A remarkable man, whether talking about his powers of expression or his record as a jurist. I second everything carrie just said. But democrats will find some way to oppose hip. The most interesting thing about what we are seeing tonight, for going on two years now we heard conservative purists in the Republican Party talk about how dangerous donald trump is and how he will ruin the Republican Party and ruin america, and do all these things that basically jump into bed with democrats. It took donald trump to pick a guy like this. Now its up to these republicans in congress not to screw it up. It is their job to make the argument that they quite frankly had a hard time making the past couple decade. That the Supreme Court should be populated with justices who believe that the constitu
