So now graco, and federal regulators are saying for the love of god, if you have a child with one of these strollers get them out prompt toe. Dont let them linger in the stroller, if it folds up it will be a hazard. They have a kit coming i out, right . They will help parents get the situation fixed. Is the kit a real solution . The kit doesnt come out until decent 2014 which i find. They should have the bring the stroller into a repair site. To me that is not enough. Gerri the repair is just a cover for the hinges. Im wonder if that will actually work . There is no proof that it will work. They have issued a statement that the repair kit has been tested. We dont know the result what that will be. Gerri graco has history of problems with recalls. I want to show you history, problems with glider rockers, the harness buckles. A lot of Different Things that havent worked. What is going on here . And why arent there goodness, more obvious things coming out from the government, the Consumer Protection safety commission, saying goodness, avoid these at all costs . In 2005 graco had to pay 4 million for belatedly reporting the defects in their products. So they do have a history in the past of not reporting the issues with their products. And the government should perhaps take better control of this company because children are most important. And theyre gerri look can they fine them . Can the company be fined . The company can be fined. And company can be sued by these families whose children suffered. Gerri so they have voluntarily done the recall which is interesting because theyre doing it on their own accord. What should parents be doing if they have one of these strollers . Be clear, these strollers have been around since 2000. You may have one sitting in your garage and not realize it. Good thing, online, you can see if the stroller you have is one of the strollers being recalled. Even if you dont have the serial number or product name you may be able to determine if that the is stroller you have. From your stroller getting recalled to your recalled airbag, the japanese government is ordering takata to investigate what went wrong. The defective airbags killed at least six and injured over 100 people. One of those injured is 26yearold cory. Cory was blinded in one eye. Before we talk about cory, i have to say the japanese government will launch an investigation. Meantime people could get hurt . Isnt it time takata recalled these airbags . You know it has been a moving target since back in 2009 when this, what they call rolling recall started. The thing they have been trying to get their arms around it. They have recalled a lot of these. Senator nelsons hearings talked about yesterday, it is a still debate which one of these need to be recalled so yes. Gerri i want to talk about your client, cory, has two children. Of the six months ago, it wasnt even a horrible car accident, was it . It was a fender bender and his airbag blows out and he gets injured. Tell us about that. Before you do, i want to tell our viewers i have graphic images well be showing. If you have small kids in the room you might want to take them out. This is really a story worth hearing. Rich, go ahead. Cory was on his way to work. He is a forklift driver. He left his house that morning. Was going through an intersection. His car stalled. There was a fenderbender as you can see some of the pictures you show your viewers. Should have been something he walked away from. Instead when the airbag blew, like you said, a slashed of metal 3 1 2 inches long went into his face and destroying one of his eyes. He has a pretty serious, not only lost his sight but disfigured. He will have to live with that the rest of his life. Gerri he said in a story i read about cory, you can see the stitches here. You can see the extent of the damage, he said i thought i was going to die as he sat on the sidewalk waiting for help to come. This is going to affect him forever, right . This is an accident that could, cap his earnings. It could inhibit his ability to interact with his family. The ramifications are pretty big. Youre right. For his little family, cory works for a living to support his family. As i said he drive as forklift. He is typically loading ballots pallets 35 feet up in the air. When you lose sight in one eye it affects your depth perception. It makes it harder. His company has been great. He is still working. It has been hard and obviously affect continue to doing that for a long time. Gerri so what is the status of his case . What kind of damages are you seeking . Well, it is early. Obviously in this case we filed it recently and were still in the early stages and were going to try to get compensation. I think one of the things that cory has said, and was underscored yesterday by senator nelson, maybe, maybe this case gives opportunity we can make the process better. It really helped spark a conversation about the problems with our recall system in the wake of of course not just this case but toyota and General Motors ignition. This will continue to happen unless we take this opportunity to change the rules. Gerri that is my next question for you. Yeah. Gerri which is this. Are there going to be lots more cases filed . This is a problem according to the New York Times is 10 years old. And the folks at takata knew it. Right. Gerri and have done nothing. Do you think thrill will be more cases . Are you filing more cases . You know were looking at cases for a few other clients. You know, im not sure how many serious injury cases are still out there that havent already been resolved. As typically happens, when ever there is very public recall like this, clients who didnt realize they had a case may come forward. So you know, that still has yet to be seen but, the good thing, like i said, is that, it is going to hopefully lead some change so were not here again six months from now with another company, with another defective product and more people being needlessly hurt and killed. Nhtsa sent a letter saying only 3 of the jeep grand cherokees and liberties fixed more than a year after the recall began. Jeep owners complain turned away by dealers due to lack of parts. At least 51 people died in crashes due at problem. Meanwhile toyota is recalling nearly 420 lexuses to repair leaks. Some of lexuses were also recalled in 2009 for similar problems. 423,000. What is the mood there and how are people feeling as we await for this decision to come down . Well, it is a tense situation and people are just kind of waiting to see what is going to happen. A lot of people are just talking about, it might be crazy and, i even have people coming in that are still hoping and praying for peaceful protesters. Gerri are you worried, nervous, anxious, about what might happen . Yeah. I mean, of course. I mean, i dont want anything to happen like it did back in august. And, were just kind of, preparing ourselves for good or bad. Were just kind of hoping that nothing is going to happen and that, we can get through this peacefully and let the court system take its course. Gerri august 9th, your store was hit, looted, with and we have unbelievable video of it because your security cameras caught it. I think a lot of people have seen this video, of the looting that went on at your store. Were seeing it right now. I cant imagine that, are you going to be open all weekend . Will you keep your doors open . Will you serve the clientele . Will you serve the community . Will you be confident that you can stay open . Well, as it is right now, the plan that me and my dad made was well stay open until the verdict comes out about what is going to happen. And how it turns out and then, just kind of take it from there and if it, if it turns bad, were not going to open and well have to stay closed until the situation has calmed down. We dont want to go through all that stuff that we went through back in august. Gerri fingers crossed but youre showing some confidence in the community by staying open. At least until that time. Are you seeing more evidence of increased security on the streets . We, im a little bit, im about a mile 1 2 from ferguson. Im in delwood which is neighbor city. Up there where my store is, we dont have any, there is not a lot of people or security in the streets right there. And to be honest with you, i havent even been down ferguson or down there because i wanted to stay away from it. Gerri so youre staying out of any potential harms way. What are your fellow store owners tell you . What are they doing . Are they staying open . I think a couple of the people that i have talked to, they want to stay open for the community and, just kind of hoping that nothing is going to happen. But i also have heard a couple of guys talking about, might even just close down from tomorrow and then wait until, if it is going to happen this weekend, then dont open until it is over. If it is not going to happen this weekend, maybe open again on monday so. Gerri how much money have you lost, having to be closed or shuttered part of the time because of all this violence. Well we had our stores, the store windows boarded up with plywood for two months. That brought down sales about 45 to 50 . So, it is a lot of money. No, theyre completely illegal. Both civilly and criminally by the way. They violate federal law and violate state law and violation of a criminal code. Assuming they ever find who did that, there is no question they could be prosecuted for that kind of activity. Gerri so, it is coming up because there is a recent case here. I want to know what you make of this case, the feds cracking down on thieves who posed as debt collectors, saying they were debt collectors. In fact they were not. They just wanted to con people out of money. What happened . What do you make of it . You know what, actually, gerri, these kinds of things going on for years, particularly through the real estate crisis we saw a lot of collection agencies doing things that were illegal but in this case theyre not even real debts. Goes to show you vulnerability of people when theyre contacted by somebody saying, you owe me 100. That is what they do, by the way. Go after 50, 150, oh, gees, i didnt owe that debt. Gerri why do people pay . Because people are afraid. They will absolutely grow exploit senior citizens. They will exploit young people that are vulnerable. They know what theyre doing. These people are pros. As a result out of fear and anxiety and idea of credit the idea of having good credit, gerri, absolutely close to who we are as people they pay and it is a numbers game for them n this case, finally the feds have gone after these people. I think they were out of georgia. They will prosecute it. Good for them. Gerri they will prosecute it. Yeah. Gerri i have to tell you there are also people in the crosshairs of legitimate debt collectors. Yep. Gerri in fact im astonished at this number. I covered this stuff for a long time. One in three, one in three adults have debt that is in collections. That is astonishing. How could that be true . Well, look, i sort of look at the way you and i covered everything that happened in the last several years with real es stay and all the bankruptcies. I just think when this real estate crisis hit, people got in over their head. They borrowed against credit cards. As a result never thinking that things would go bad, figuring to save their home. There are a lot of Different Reasons for it. But the bottom line is, they just built it up. Then they lost their job. As a result, they either go bankrupt or just dont pay the debt. So there is a lot of Different Things that happened in the last seven or eight years resulted in the amount of debt, billions of dollars worth of debt. Gerri billions of dollars. That people have. And wrung people, young people which is ridiculous. Gerri talk about guidelines on debt collectors. What can they not do . What is ten stepping over the line . Theyre not supposed to call you before 8 00 a. M. Or after 9 00 p. M. In the earning. Not supposed to call you at workings if you give them notice you dont want them contacted at work. Cant contact you continuously during the day. They cant call neighbors, masscy owes xamount of dollars. They can call neighbor to say, hey, does he live out at home. They cant give out proprietary information unique to me, call coworkers friends, family members. Those are violations. And what happens is this. When those type of violations occur, what we, today want to let our viewers know, which well get into, they have rights. And even though it may be a legitimate debt, if those debt collectors cross the line, that is their leverage for the debt thats owed.
