Notably, it will be an open hearing. We will get to see this as it plays out. There are still details are trying to work out. Who will ask the questions and who will testify first . The Senate Judiciary committee has offered to have a female outside attorney do questioning but the team of doctor ford wants a senator to do it. As for the order of testimony, her lorries want judge kavanaugh to go first. But the committee has been pushing back on the request. They argue kavanaugh cannot properly defend himself if ford has not little allegation. Fox news sunday, Lindsey Graham said that he expects the hearing will play out and he wants it to be fair. Chairman grassley has been bending over backwards to make it happen for the offer is thursday at 10 00 she made conditions to the lawyer and accepted six. They say they plan to defend her when hearings take place later this week thursday at 10 am. Some huge hearings on capitol hill over the last two years but this one really could be the biggest. Is keep in mind this is not a criminal trial with a presumption of innocence determines the outcome. The senators are going to have two weigh credibility of his comments versus the credibility of doctor ford comments. I sort of reject the notion that there is a criminal standard that is to be applied. Leland is the American Standard though a presumption of innocence, sir . He does have a constitutional right to sit on the Supreme Court. So his right is not been denied if the judgment of the senate, he is not a credible candidate for the court. And this testimony, this hearing will determine that. But it is not a case where he has to be Proven Guilty by or beyond a reasonable doubt. Leland what should be the standard then . Is it, someone makes an accusation . You have four people allegedly at the incident. Saying they have no memory of it. So when accusation is enough to sink someones career . Standard is what the judgment of the senators might be when considering a lifetime appointment. I guess i would ask senators to do is withhold any judgment on the question until the testimony occurs. And if they in their judgment, determine that her argument is more credible than his leland theres already been a lot of Democratic Senators essay i believe her. I believe her. It doesnt sound like withholding judgment to me. I think for the most part those ive decided they believe her, already had determined they were not going to vote for judge kavanaugh. Leland fair to say, maybe i want to believe her rather than, the facts. Lets be fair about this beer for the most part this kind of assaults go unreported. And for the most part, women are not believe even when the assault is true. So i completely understand leland hold on, to say not believe, this person is being given by far, the benefit of the doubt here. By whom . By anyone willing to have a hearing. For someone to sent a letter from 36 years of antennas happen, i cannot remember when, i cannot member the time, i cannot remember what house. Then the United States and is says were going to hold votes and have a hearing where this person is able to make the accusations known on National Television and call somebody on the carpet and have them have to testify under oath about a set of accusations that no one has heard about for 36 years. It certainly sound like the benefit of the doubt to me. Doesnt it to you . It doesnt solve the benefit of the doubt when we have United States senators saying before hearing what she has to say, that she is mistaken and that she is is not the benefit of the doubt. Congressman, you cannot have it both ways. What about the senator saying i do believe her despite four other people saying i have no memory of this. What about those senators . To my point, you cannot have it both ways. Just as you said. A people that run the Judiciary Committee, the senators who are in the majority, are deciding already that no matter what she says, it is not true. I have an idea. When we wait and see what she has to say . I agree that anyone who is already determining the outcome of this may be prejudging. But i do not think it is unreasonable for people leland only a 15 seconds let me see. By definition republicans are willing to have the hearing. They willing to reopen this up and delay the votes. Are they at least given her the benefit of the doubt of having a hearing . Is not by definition, not prejudging it . Not when theyve already determined and said that no matter what she says, it does not matter. They will vote for judge kavanaugh. They do not believe her already before having heard her. All of them have said that it does not happen or they have no recollection of it happening. And the weight of the evidence is with judge kavanaugh. What do you think . I think before she comes forward and testifies, for sinners to say we dont believe her we do believe her. I think that is necessary for this to really go through the process. And the republicans are bending over backwards to give this woman every opportunity. Right, they were all going kristin let me ask you all, is anything judge kavanaugh can do or say that could really impact how republicans on the Committee Vote . Jennifer . We have not had a chance to hear from judge kavanaugh at all. And i think as you will recall back in the Clarence Thomas hearings, when Justice Thomas came in and defended himself before the senate and before the people of the United States of america, people saw a man who they believed felt had been wrongly accused. And that turned things for him when people had a chance to see his emotional reaction. And so that may be the case here. Kristin and faiza patel, to you, anything that kavanaugh can say . I think was interesting is how hard he and his allies are trying to come up with an alternative story here. Which we saw over the weekend with the twitter storm suggesting it was a case of mistaken identity. I think theres a difference between the Clarence Thomas moment and what strikes me is that in that case it really was a question of just putting the individual including Clarence Thomas, from the committee and having him testify. Where is here, you really see an effort to reach for an alternative explanation for what might have happened. So i do think that there is a difference there and i am interested to see how it plays out. Im adjusted to see whether judge kavanaugh also goes forward with this mistaken identity with this other theory being floated on twitter over the weekend. I think theres a lot of interesting things that we might learn from this hearing on thursday. Kristin before we go i want this new fox news poll to come up. It says who do you believe . 46 percent of the people say they believe ford. 30 percent say that they believe candidate kavanaugh. And others say on shore. Jennifer, i will leave it to you. The poll was taken before the four other people alleged to be at the party, before they came out to say they have no recollection of the party. But still, those kinds of numbers have to make Senate Republicans nervous. I think they are making Senate Republicans nervous. I do not think they should. The Supreme Court justices, it is not a popularity contest and has nothing to do with what the public thinks. It is every thing to do with what the senate thanks.
