If you are not targeting minority group, it does not sandra a criminal offense against property or person perpetrated in the hole by right. It has to be a protected class. That is why he was going after we dont know as much about the dayton shooter right now, but it seems that it was indiscriminate, and he wanted to kill people. He killed even his sister. Some argue that there should be so that we can perceive those cases with the same research and data that we do hate crimes, so thats all sort of crosses over each other, but ultimately, in this situation, whether or not this is a hate crime will not make a difference. We must form our Mental Health laws to better identify mentally disturbed individuals who may commit acts of violence and make sure that those people not only get treatment, but when necessary, involuntarily confinement. They mean thats it, you cant imagine anyone in a colloquial conversation does he mean that every one of of the shooters is going to be found not guilty on the basis of insanity. And that isnt what is going to happen here. One of the things that the nra and republicans have been using for years, even though they dont want to fundamental honest programs, i would add there, one of the things that at least as a democrat, coming from progun reform perspective, i see as a way of scapegoating this. It is significant damage to the people who actually suffer from Mental Illness. They do not go out, get a gun, and shoot dozens of people. That is not what it means to be mentally. Rick that doesnt mean that the people who do this are only to mess shooters have actually had technical Mental Illness. Sandra heather, i want you to talk about this. Routinely blaming Mass Shootings on Mental Illness, research has shown that only a very small percentage of violent acts are committed by people with Mental Illness. Because thats true. They are not more likely to commit acts of violence. There is some sort of a mental issue with the shooters in order to bring them here, and we need to know what that is so we can look at how to prevent it. Things like depersonalization, using the computers, not having society support. Things like radicalization, being more likely to jump on the bandwagon of some of these crazy websites. Those are the mental issues we need to look into to prevent these, but ultimately, this young man is not going to be getting off, most likely, not guilty by reason of insanity because of his acts were so depraved, so battered. Rick my father is a former president of the American Psychological association, and just because someone has been treated or diagnosed, it doesnt mean that they are not mentally ill. So i think the statement should be qualified a little bit. I think if you look at this, this is a challenge that we have in society as a whole. We immediately start pointing fingers, who can we blame . I actually agree that all of these options should be on the table appeared we have to come together as a country, as republicans and democrats what about this red flag law that would allow police and family members to take guns away from people who may have issues. That is an issue because we have a constitutional right to bear arms, and we talk about this all the time, but that right is not without boundaries, so we talk about these laws and a vacuum. We need to know what the laws do, what they allow for and do not get oftentimes, we know that most crime is local, and local authorities know best who in their community as a type of person that should have a gun taken away. I am a proponent of these laws, but we need to make sure that they are the least restrictive they can be. Speech you now the New York Times cover and eventual replacement. The New York Times late yesterday put out this headline, trying to capture the president s words yesterday, the first sentence he spoke yesterday. Trump urges unity vs. Racism. The times was quickly criticized, even by some 2028 democratic president ial candidates, and eventually, many readers think i will pull my subscription because they thought that they had mischaracterized the president s words. He could not have possibly been urging unity was there take. I work in strategic communications, and i think what this highlights is the daily 24 7 battle for influence in the media narrative in this country. You see a headline, that they believe is a factual representation of what occurred, and Democratic Candidates didnt like it, so they took to twitter, they were outraged by it. As a result, they are shifting the coverage. The New York Times did change that headline. Sandra they sure did. Yet, they sure did. That isnt at all what i feel about it, it was for those nine and a half minutes that he was speaking, but the objection was that it didnt really speak to the entirety of what has gone on here. It did not account for months and years of rhetoric that has found a home and support in communities like where this el paso shooter came from and that discussion board, people who do hate minorities, white supremacist, white nationalist, and that it wasnt doing justice to what the president has done but also to alexander burns, wonderful reporter, and he actually did speak to the context of all of this. We do know that often an editor writes the headline and the journal star reporter writes the piece, so there was clearly a miscommunication between the two things. Trump condemns bigotry but doesnt call for major reform. I wonder how often that happens. It was about the full front page, the major story of the day. It should be correctly titled. It is difficult to have a headline that is perfect on both sides, but in the situation, i think it wasnt so offensive that it needed to be changed, and that lends itself to more distressed in those 10 minutes, we saw a very different president then we have out all of these rallies. The pair is still eluding investigators there. Latest efforts to track them included a dive team searching a river in manitoba where a damaged boat was found. I actually researched to see if they had anything on the internet about them being survivalists, because given where they are, where they escape to, they would need those techniques to survive. That is what everyone is starting to speculate, and theres nothing on the internet that says these two teams are all trained it to survive. You are calling to extend those background checks back in the senate in 2013, i believe only four republican senators voted in favor of it. Do you think it would get more support today . Well, i hope it would. It is just a common sense matter. We have universal agreement in this country that violent criminals and those that are determined to be dangerously mentally ill shouldnt have firearms for obvious reasons. Well, the background check system is the mechanism for determining if someone is in either of those categories, but we know that there are big loopholes, so i would like to close those loopholes. I had a very constructive conversation with the president yesterday about this and other matters. There is no single piece of legislation that is going to guarantee we never have another one of these horrendous massacres. We know that, but if we can make it more difficult for people who shouldnt have firearms in the first place to get them, then that is what we should be doing. My legislation would help in that regard. Rick no question, senator, background checks could help, but in the case of the dayton shooter, he had no criminal background. Nothing to suggest that he couldnt get a gun, and he did get a gun legally. And that is why i say that there is no bill that is going to solve this problem completely by any means. There is no question that many shooters have had no prior conviction. No reason to deny them the sale. So this is not a solution for all circumstances. I do think that we should also be pursuing red flag laws, the kind of laws that say if there is a pattern that emerges and people identify someone who is clearly advocating violence, suggesting that he might engage in violent activity, that we create a process by which a court can consider whether or not this person is in fact a threat, and if they are deemed it to be a serious threat, than their firearms could be removed from them, and i think that we should go ahead on that basis. I also think that a bill with chris coons this is just about enforcing these laws better. When somebody attempts to buy a firearm who has no legal ability to do so, saved by virtue of a prior felony conviction, that attempt is in itself usually a new crime, and its a new crime that is almost never prosecuted. Sandra in addition to the red flag laws and the background checks. Sandra senator Lindsey Graham is also working on a bipartisan plan. How do you all of these recommendations as youre putting it, how did they all come together . Everybody is proposing different changes to the gun laws, so what do you do as a party, how do you come to gather on this to enact change . So they are our processes by which we try to take these different ideas in this piece of legislation. I think that senator graham has recently indicated that as chairman of the judiciary committee, he intends to really examine and advance a proposal on the red flag laws. He has indicated to me that he is interested in pursuing the legislation that chris coons and i have introduced together, and with respect to the background checks, that is going to require work on our part to bring about broader sandra are you or any other republican members of Congress Addressing these many of whom democratic colleagues of yours who have spoken out. Be saying that these should not be in the hands of civilians or magazines, though shooter in dayton had over 240 rounds at his disposal when he has the capacity to kill many more. Are you making any calls or recommendations on changing laws pertaining to that . My focus is on keeping guns out of the hands of people who should not have guns, people who have no legal right to a firearm. Guns that are described as assault weapons are almost invariably no more powerful than regular hunting rifles. They look different. They are painted black, and theyve got features that an ordinary hunting rifle doesnt have. They are no more lethal. They are extremely popular, so to ban an extremely popular firearm, im not going to support that, that would be an infringement on the rights of lawabiding citizens. Well, there is no question that people can self radicalized via social media. We have seen this time and again in different ideologies. There are some different pathways to take. There is a framework, not a checklist. Even individuals who tend to have checklist, social isolation is common. Then they go through a process of reaching out online, finding likeminded individuals. It then sometimes they will find an enabler or on the g how decision pathway, and in the case of white nationalism, someone who shares their twisted political beliefs. Then you look for a few other leaps along pathway. Often it can be broadcast they will say i really plan on doing x, y, and z. There are some places where you can catch the person in this process, but as i said, it is different for every individual in the radicalization speed. It varies dramatically. Rick summary t into this dangerous territory. When you are talking about lone wolves, self radicalizing, the internet is the primary if not sole place for this recognition. They can monitor or surveilled without infringing on peoples rights and on their privacy, but catching individuals who are on this pathway and have made that leave, they are looking for a stack needle and a stack of needles. This is incredibly difficult to do. There are some similarities between different cases, broadcasting intent is certainly one of them. We see this often afterthefact. An individual will say i plan to do the following. Sometimes there will be a triggering event in their lives. They will see something on tv, and that could be what leads them forward. These are not always the same. Rick the technology exists, does it not . Could flag certain words or phrases are messages that are online. The technology exists to flank that, and potentially, Law Enforcement could be notified. This person could be dangerous. Usually, the best Law Enforcement work that we tend to see involves i dont know, undercover, confidential informant, people who are very close individually to the suspected radical. Using computer programs could certainly narrow down this process, but there are a lot of people talking about a lot of Different Things and all of these different chat rooms. Social media is obviously a constant mill of new information, so you are trying to use these tools to look at where you are going to put those resources. If we are going to try to rely on algorithms, we are going to be waiting a very long time. This requires a lot of old school detective Law Enforcement work. We do stop a fair amount of them, but of course when we dont, it is a tragedy, like we see. Rick we heard people say about the shooter and dayton, he was like i most likely to do what he did, according to kids who went to his high school. This is true with the Marjory Stoneman douglas shooter. You have to look at what the laws are. I think this is why the conversation on red flag laws and way to engage and preventative action here, instead of dealing with everything after the tragedy has happened, those are worthwhile conversations to be had, and you have to look at what would be the requirements to commit somebody. At what point is someone spouting off, and at one point is it a threat that should be taken from a criminal perspective . We need to hone in on that so that we can prevent these tragedies from occurring. Rick quite often, they do post messages on whatever social media platform, saying what they are going to do.
