Good evening. Kind of a fascinating scene right now. Hundreds of protesters arched across the city of louisville and they ended up here on this Church Property and they were kind of taunting police, they were past curfew so Police Declared this an Unlawful Assembly and then ends up getting in the faces of officers screaming profanities at the officers, for quite some time and it looked like there was going to be a rather serious showdown between police and these protesters. Just moments ago there was a major Law Enforcement presence and then a spokesperson or representative from this group spoke with police and i was able to hear some of it and police basically showed some mercy to these people who violated curfew and were screaming in their faces and are now allowing them to walk straight home and weve got this large group now thats been on this Church Property for quite some time entering the streets of louisville no well past curfew, leading what was declared an Unlawful Assembly and its going to be interesting to see how this plays out. Hopefully these people had back to their place of residence or back to their cars, because there are choppers above watching their every move and if anything goes wrong, we might see some arrests sooner than later, shannon. Shannon all right. Matt, have you seen anything like you saw last night . Does the temperature feel different there . Because as we see these folks walking along calmly, its a little bit different than last night when you were showing us some fires, some direct confrontation, whats your take on how things are headed tonight . You know, it started off, we walked with these protesters for quite some time and we will keep walking with them now and we saw them smash windows, salt and destroy property, screaming the usual profanities against police and they ended up here at this church right around 9 00, right at that curfew cut off and so at that point, police started to declare this an Unlawful Assembly and there were officers and right gear on every corner and there was kind of an association where the officers allowed these people to leave and so thats whats happening right now in the night began very tense, it was very tense for quite some time but it seems like if these people dont head straight home hours after the curfew, where probably going to see some arrests and citations. We witnessed at least two dozen people being arrested last night and for Disorderly Conduct and for violating the curfew and we might see that again a little bit, i guess we will keep you updated, shannon. When it comes to mailin ballots, even during a pandemic, some folks say they only trust going to the polls. Took me four and a half hours to get to the voting. I am going to the polls this year. Im not trusting the mail at a all. Shannon senior correspond at Rick Leventhal is on the case tonight and there are some interesting ones out there. Good evening, rick. 20 years ago one in ten voters mailed in their ballot. In 2016 it was two and ten. This year the numbers are expected to be far higher. Magnifying the problems that we are already seeing the system. This november there will be a lot less of this and a lot more of this with many republicans suggesting the Election Results could be tainted because the mailin Voting System cant be trusted. In greenville wisconsin, warning bells are ringing after three treys of mail, including absentee ballots, were found in a roadside ditch tuesday morni morning. Usps spokesman said the United StatesPostal Inspection Service immediately began investigating and we reserve further comment on this matter until that is complete. In austin, texas, 134 felony charges were filed against a county commissioner and three others for trying to break the 2018 democratic primary with a fraudulent mailin ballots came using ablebodied young people posing as disabled. Republican attorney general ken paxton said mail ballots are vulnerable to diversion, coercion and influence by organized boat harvesting schemes and in pennsylvania, the fbi has joined state Police Probing the discovery of a small number of military mailin ballots discarded, possibly in the trash. At least seven of the nine ballots had posts cast for President Trump, who narrowly won pennsylvania to seal his victory in 2016. We want to make sure the election is honest and im not sure that it can be. The president also criticized the bulk mailing of unsolicited ballots suggesting the system only works when a voter first request and then receives a ballot. Now some democrats are pivoting on mailin ballots too with concerns postal delays, litigation and higher rejection rates could hurt their chances in november since more democrats and republicans then republicans are expected to vote from home. Twice as likely to have their ballots rejected in florida and in parts of georgia. Mail is also less reliable for people in public. Late today the doj revealed there were more problems with that pennsylvania county elections office, more barcoded ballot envelopes found empty in a dumpster and evidence workers were opening all envelopes, including sealed ballots as a matter of course. The u. S. Attorney demanded the issue be corrected immediately but admitted theres no guarantee any of those trashed both will be counted, shannon. I also think its so sad whats happening with everything about that case, including Law Enforcement. On a day that saw him roll out a Key Health Care initiative and travel to florida for the preelection rally, President Trump today offer his regards to the family of Breonna Taylor just a day after a grand jury in kentucky declined to file homicide charges in her death. So many people suffering, needlessly suffering but with respect to breonna, we give our regards to the family. The president declined to address specifics about the case, preferring instead to offer support for both taylor and more broadly lawenforcement. But it gets less than peaceful, as you see all over, then its unacceptable and thats where law and order is necessary. The president also offering support for preexisting conditions. Shannon so you know folks are pointing back to your comments from 2016 and the decision to hold off on voting for judge Merrick Garland when he was nominated by president obama. You have explained that. Some say theres a distinction with no difference, but here is what your Senate Colleague democrat senator dick durbin had to say about the rush to get this done. I certainly wish you were this fast when it came to dealing with the pandemic we have or dealing with the economy and all the people who are suffering. He has no time for that but when it comes to trumps nominee for the Supreme Court he wastes no time and pulls out all the stops. Shannon your response . He knows originally the reason we havent done it dumped on a rescue package is the speaker in a democratic leader of the senate have been resisting having another deal. Here are the facts with regard to the Supreme Court. There are than 15 occasions where a president has nominated during an Election Year someone to the Supreme Court. In eight of those 15 occasions, the president s party was the party of the senate and 7 out oe confirmed, one time blew up in a scandal. What we had in 2016 was a time of divided government. You had the president , a democrat, the senate, republic republican, divided government, you have to go back to 1888 to find the last time a vacancy on the Supreme Court created during a president ial election was filled by a party different from that of the president. So this is entirely consistent with a history of handling Supreme Court vacancies in the middle of president ial electio elections. Shannon do you think the average american gets the nuance of that . You know the latest cnn poll says 59 of americans think the next president , whoever is elected or reelected on novembee who gets to fill that seat. I think theyve not seen the nominee had. Right now this is a hypothetic hypothetical, caught up in a president ial election. By saturday afternoon we will have an individual, the president said its going to be a woman. She will be judged on her own merits by the American People. Im confident hes going to make an outstanding nomination, the American People are going to take a look at this nominee and conclude, as we are likely to conclude, that she well deserves to be confirmed to the u. S. Supreme court. Shannon are their worries for you that some of your members who are in very tough reelection battles you are in a reelection battle yourself potentially are going to be in danger of losing their seat . Here is something that congressman eric swalwell, a democrat who ran for president this year had to say. We have good reason to believe were going to win in the senate, not just arizona, colorado, maine, the online fundraising, the seat in alaska. Alaska of all places, commercial fishermen running as an independent, hes tied 4343 with the freshman incumbent dan sullivan, so expanding in our favor. Shannon do you worry about the senate . We cant pick and choose when decisions are forced upon us. Like the untimely death of Justice Ginsburg, who by the way had a spectacular career and was an inspiration to millions of americans, but the election has no reason to dodge our responsibility and not go forward with a wellqualified nominee, which i anticipate we are going to get saturday afternoon. Shannon so another one of your colleagues who has occasionally crossed over to vote for the sum the nominees youve put through at a record pace, joe manchin had this to say. I hope you understand what youre about to do. Never been done, youre setting the precedent thats never been set before. Shannon talking about just how close we are to the election for filling this seat. What do you think of that . Its not a precedent that hadnt been set before. I addressed that at the beginning of our interview. Theres nothing appropriate about filling this vacancy, many Supreme Court vacancies have been dealt with in a shorter time frame than the time frame between now and the election or the time frame between now and the end of the senate, which is at the end of this calendar ye year. Theres nothing extraordinary about the situation, nothing unusual about the situation. They dont like what happened. I understand that, theyve been block voting against all of our judicial nominees anyway. They are threatening to do one thing or another, but there were already threatening to blow up the senate by getting rid of the filibuster, [indiscernible] the district and puerto rico and there were already threatening to pack the Supreme Court. Weve heard all these threats before. We intend to move forward to exercise our responsibility and to vote on this outstanding nominee that we will get later in the week. Shannon so your counterparts and Senate Minority leader Chuck Schumer has had plenty to say about this. He of course is diametrically opposed to what you plan to do. He says the president is all about getting somebody on the court who will help him in an election battle if it gets to the Supreme Court and democrats are consistently also pointed to the Affordable Care act, the big case on november 10th, they say the president wants and with their help get a conservative justice who will overturn health care for millions of people. How do you answer that . Because its becoming a talking point on the campaign trail. Its very difficult to predict how people vote when they get on the Supreme Court. Its a lifetime appointment, the founders set it up that way on purpose and predictions about how people are going to vote when they get on the Supreme Court have been consistently wrong. You should have heard the things they said about John Paul Stevens or about david souter, republican president ial nominees, both of them turned out to be big liberals, so it turned its very difficult to predict how someone is going to will because want to put the black robe on, as chief Justice Roberts said actually justice [indiscernible] said last year, they dont wear red robes or blue robes, they wear black robes. Shannon and that is what all americans should want.
