FOXNEWSW On The Record With Greta Van Susteren May 12, 2016 23:00:00

Turn in for full interview with donald trump 10 oclock p. M. Eastern. On the record up next. This is a fox news alert. Safe and alive. A kidnapped 9yearold girl miss mysterious disappearance now solved. A tip cracking the case. Here to tell you how it all went down. And also a bombshell in baltimore. Officer number twos trial begins in the freddie gray case. This day could impact the way police stop, detain and arrest suspects all across america. On the record is in court. Right now, the peace process. Donald Trump Holding three meetings in washington, Speaker Paul Ryan a meeting with house leaders and a meeting with Senate Leaders all in the Republican Party. Here is what donald trump told sean hannity about his meeting with speaker ryan. Were going to get rid of common core. Bring education locally. We are going to do that we are going to protect our Second Amendment so important. So, so important. The Second Amendment is being chipped away at. As far as hillary is concerned, she wants to abolish the Second Amendment. I really believe she wants to abolish the Second Amendment. The whole view on guns, she is a disaster in so many different ways. We are going to i think we really had a great meeting today and i think we agree on a lot of things. It will be a little process but it will come along. Just after the meeting, Speaker Paul Ryan had this to say. I was very encouraged with what i heard from donald trump today. I do believe that we are now planting the seeds to get ourselves unified to bridge the gaps in differences son and from here, were going to go deeper into the policy areas to see where that Common Ground is and how we can make sure that were operating off the same Core Principles and so, yes. This is our first meeting. I was very encouraged with this meeting. But this is a process it take as little time. You dont put it together in 45 minutes. Its very important that he that we dont fake unifying, we dont pretend unification that we truly and actually unify so that we are full strength in the fall. I dont want us to have a fake unification process here. I want to make sure that we truly understand each other and conservative Party Principles that built this country. Again, im very encouraged. Rnc chairman Reince Priebus was had inside that meeting with trump and speaker ryan and he went on the record. Mr. Chairman, nice to see you, sir. Hi, greta, thanks for having me. All right. I read the joint statement between the rnc and donald trump that said had you a great conversation. What does that mean . Here is what it means just generally. Number one, great party for unity. Also go ryan and donald trump. I mean, i was there and i can tell you that it was genuine. The spirit was good. Cooperative. It was an exchange of ideas. I will just tell you both of these ideas left the room feeling pretty good about each other. And, for that, i think it was a great day. I think they are going to follow up very quickly to keep the rapport and conversation going. Now, you also had a statement that there was honest differences and donald trump told me expect people to agree only about 70 . Thats a good number. Where are the honest differences between speaker ryan and donald trump . Well, look, i mean, i think donald trump and the speaker can talk to that. I mean, i dont want to get into the specifics of the actual meeting because that wouldnt make me a very good honest broker if i had a private meeting and then came on tv and spilled the beans. But i would tell you some of it is well documented stuff. But i think the point is though in the meeting they agreed with 80 90 . They agreed more than they disagreed. Really wasnt a lot of disagreement but there were some areas that they discussed that i cant get, into but i will tell you it was a good, honest conversation and a commitment on both parties to continue working together to get to a good place. I think paul ryan wants to get to that good place soon. He didnt endorse today. And he has said in the past that he wasnt ready to endorse. Can you give me some sort of prediction . I mean, what is it going to take for donald trump to get the speakers endorsement . How long that will be or what hurdles that trump has . And whether or not even needs endorsement . Well, first, i dont know about the last one. I mean, lock, donald trump has broken the playbook and has done very well, better than any nominee in the history of our party. I mean, as soon as you try to Start Playing by conventional rules, i learn half a year ago that it just isnt the case. So i dont try to apply those rules. But i would just say that i think both parties got out of today what they wanted and what they expected, i think. And they both left happy with the result. I dont think either donald trump or paul ryan came into this mornings meeting and were prepared to, you know, just have a big endorsement party in 45 minutes. I think they both left much more positive and more happy than when they came in. So i think for that it was good. All right. What do you make of the truce, thats the word i use between senator Lindsey Graham and donald trump . I think we probably expected that speaker ryan and donald trump would have a different would have a discussion today that might lead to the point they are. But senator graham and donald trump now have a truce . I dont know much about the truce but i know the character of senator graham and is he a kind, warm, funny person that loves our country and so im not surprised that he if thats true, im not surprised by it i think everyone understands, look, we have got two big parties in this country. And were not like italy we dont have 12 parties that fit into a nice neat box. We dont agree with each other on everything. We agree we are the party of freedom, quality and opportunity and party of the open door. If you are the party of the open door, that means there is going to be a lot of the people in the room that might not agree with each other on everything but agree for a Better Future for our country and Hillary Clinton doesnt fit that description. I think thats what you are going to be seeing over the next several weeks. Who would have guessed that the republicans would be where they are today and the democrats are heading into this convention with who knows. What anyway. Mr. Chairman, nice to see you, sir. Thank you for joining us. Thank you, greta. Well, donald trump certainly had a busy day here in washington. The presumptive g. O. P. Nominee cozying up with speaker ryan and house in the senate. Senator John Barrasso was in that Senate Meeting with trump. Here to go on the record. Good to see. You were you a trump supporter before the meeting and, if so, or if not, are you now . Well, i said for a year im going to support the nominee of the party. Donald trump won this the Old Fashioned way. He got the most votes. The turnout has been remarkable. I was very impressed with the meeting today. It was a positive, productive meeting. He met with 11 senators. We talked for over an hour and 15 minutes. Lots of issues. Lots of topics. Asked questions. Went back and forth. The one thing that might surprise a lot of your viewers is he listened. He listen to do what we had to say and reacted very appropriately. Its so funny, he had a tryout it seems like tonight but he already has it wrapped up. Its sort of odd. What i hear is that there are a lot of republicans that dont like his tone or rhetoric. I dont like the insults. The fact is if he acts sort of like the other ones without that tone and rhetoric, they lost. His tone and rhetoric has drawn people to the party and he won. So, does that mean the strategy is to keep going with that tone and rhetoric . Well, what we know is two thirds of americans believe the country is heading in the wrong direction. I think people all around the country know that we cannot afford for america to have another four years like the last eight years. Thats what you get with Hillary Clinton. You get a third obama term. Should you let donald be donald or are you going to try to make him in to some sort of Something Else . Well, you know, there is a lot that we still dont know about donald trump in terms of really flushed out positions but there is a lot more we do know about Hillary Clinton. So, we were asking the questions about different issues. Talked a lot about what unites us as a party in terms of specific positions on healthcare, for one, which you know i have been so actively involved in because it is so unpopular with the american people. So i pushed him to talk more about that topic. I think we audited to be talking a lot more about it. What about thep the ban on the muslims. Last night he told me said that it was not it was a temporary ban. Not a permanent ban. And that there would be some exceptions. Because obviously we have muslims in our military serving overseas and need to come home. Was that discussion today the muslim ban. We talked about the issue of tone matters. As our mothers told all of us, its not what you say but how you say it. Its worked for him. Thats the irony of it. His tone has drawn people to the Republican Party and he is walking away with the nomination and he has crushed everybody else who had, quote, good tone. Thats what this election is going to be oneonone donald trump against Hillary Clinton and the future direction of the country he is going to make his points. All 11 senators left with a positive impression of directions of the Republican Party. Donald trump is a Master Builder and now rebuilding bridges that he previously burned or that his rivals burned depending on your viewpoint. Trump and former rival senator Lindsey Graham making peace after bitter fighting and sizzling insults. I wont talk about Lindsey Graham who had like 1 point. Mr. Trumps view of the world is really pretty delusional. He talks about i know more about the military than trump. Ive been dealing with it for years. Yeah, for years. Thats why we cant beat isis. Wheres trump . And light weight Lindsey Graham a total light weight. If all else fails, you can always give your number to the donald. I wrote the number down. I dont know if its the right number. Lets try it your local politician. Trump on the record Political Panel is here. Abc political director rick cline. Trump had a conversation Lindsey Graham, and they now seem to be i mean, certain solid a different relationship than it was 24 hours ago. Thanks to Lindsey Graham, thanks to donald trump Lindsey Graham had a new phone to take that call on evidently. I think whats happening with Lindsey Graham, paul ryan, i think, is another example. There is a growing sense because of the reality, this is a choice. The republicans will have a choice. It is donald trump. It is Hillary Clinton. The idea of a third party person, there is still buzz out there. Its really not going to happen. Binary choice. Donald trump. Even though a lot of nasty things. He has made fun of me. Destroyed my cell phone. You name it. Whether you agree with donald trump or not, and im not telling people to agree with him or not, when you sit down with him oneonone, is he a very sort of different person than when is he at these rallies and someone flings something at him and someone in the media says you are a jerk, what are you and then he responds with a nuclear weapon. There is clearly a lot of theater going on here. The point about the cell phone, tell a truth about Lindsey Graham which is he didnt really destroy that cell phone. Lindsey graham still has his flip phone to this day. He may be the only one in the nation. He may be. And even after that kind of dramatic destruction of it, he still has it there is this is such an example of the overwhelming amount of theater. Also, to your point, it donald trump can repair this relationship maybe he has some diplomatic skills that we havent seen from the podiums and rallies that he has been holding. Democratic side, pretty crazy over there who would have guessed . Thats turned out while they are having a love fest on the Republican Party what about the democrats . Picking out real estate on Mount Rushmore today. Good visual. Winding down. Clearly Hillary Clinton has the delegates. She is going to be the nominee. Not been a pretty process. The buzz about elizabeth warren. The best thing going is the republicans continue to be interesting and donald trump still having meetings. Its asounding. Rick and any, thank you both. Sorry its so short. Vote at home on twitter. Should donald trump do as republican critics say and tone it counsel . Tweet yes or no using greta. We will show you live twitter votes throughout the show. This is aer in the. Breaking news out of the pentagon tonight. Fox News National security correspondent Jennifer Griffin is at the pentagon. Jennifer . Greta, we have just learned from u. S. The navy has relieved commander eric rash due to a loss of confidence in his ability to command according to a Statement Released by the navy he was second in command at the time of the incident. Sailors were taken hostage and then paraded by irans revolutionary guard before video cameras force to do apologize and cry on camera. Ash carter said the mistake was the result of navigational error. Fox news has since learned that the sailors were not given premission navigational brief. Shortcut highly unusual in the navy. The sailors ended up near farsi island a listening post for Iran Revolutionary guard when the patrol boat had engine difficulty. Thats when the iranians surprised them at gunpoint. The incident is still under investigation. We are told by Navy Officials that other administrative punishments have been leveled about now word yet as to the ultimate fate of the 10 u. S. Sailors. Greta . Jennifer, thank you. And a federal judge slapping down president obama and signature obamacare. Just a short time ago the federal judge ruling that president obama never got house approval to pay 175 billion to subsidize insurance companies. And thus has no business doing so. Well now a death blow to obamacare. Millions of americans may have to pay more for coverage. Georgetown law Professor Larry barnett one the lawyers who worked on the case in the United States Supreme Court unsuccessfully challenging obamacare on a different issue is here to go on the record. Good evening, sir. Good to see you, greta. First of all, how did congress get into court . Because we always hear that congress cant go into court. One of the things that makes it difference is house as a whole. Usually they turn away individual members. The house as a whole had an interest in this outcome. Basically its the protection of the power of the purse. So is it the situation that they hadnt authorized the money but president obama said i dont care anyway obviouslily im being crass about it i dont care im going to authorize the payments any way to insurance companies to subsidize is that what happened and the judge just said no, you cant do that . Its unconstitutional . Exactly. I mean, the statute covers two different things. One is payments to consumers in the form of credits and the other is payments to insurers. While the statute did include annual recurring payments for the credits, it did not include perpetual or ongoing payments to the insurance company. That was supposed to be done through an annual appropriation. And the Obama Administration, after first asking for appropriation. When they didnt get it started other sources to this even though that was not part of the statute. Is this a big deal or not . Its a big deal from constitutional standpoint because it has to do whether congress with exercise its power of the purse. If you listen to the administrations position, the only way that congress is k. Contest what the president did is by denying the president funding. That require a resolution of law in the house, a law in the senate and the president could still veto that the only way that congress could look after itself is by having a super majority of congress and so this means that the president cant spend money when the congress doesnt say something, the president cant make up something and spend the money anyway. Does this clip the president s wings so to speak . Are there other instances when the president is trying to do this in other cases spending money not allocated by congress . Not that i know of. The president has pushed the envelope even the individual insurance mandate is Something Congress has never tried to do before. That was something that congress did. This is not something that is widespread. But if it were allowed to be done and if the courts of appeals do allow it to be done, qui imagine that it is something that will become widespread in the future. All right. So the judge ruled against obamacare on this provision in the statute. But the judge has stayed the decision. Meaning that she didnt
