FOXNEWSW Outnumbered Overtime With Harris Faulkner September 25, 2018

Bill cosby at 1 30 this afternoon, roughly 30 minutes from now, judge Stephen Oneill will announce his sentence of bill cosby, the 81yearold comedian who could very well go to jail for at least 24 years, perhaps more. We will find out in less than 3. He was convicted in april of drugging and sexually assaulting a woman in his philadelphia home. He denied that an assault took place and it was consensual but she said her life was ruined by this event and a jury found that he did in fact drug and assault her. The d. A. Has recommended a 510year sentence, saying cosby earned it. The defense asked for house arrest, which is probably unlikely at this point. I want to read some of this fivepage letter that Andrea Constand filed. In it she writes harris, 80 of defendants in pennsylvania who are convicted of the crime that bill cosbys convicted of are sent to prison, 80 . There is oh four in five chance that this judge will rule that bill cosby will go to prison, he will be taken to first county jail for processing and then moved to a state prison facility about 12 miles northeast. Harris you read that victim impact statement and also today as i had mentioned, the judge wanted to decide whether or not he would rule that cosby was a sexually violent predator before the sentencing. What is the talk about that inside the courtroom . They had a skateboard psychologist comment yesterday and talk about how bill cosby met the criteria and then the defense brought in their own psychologist today to say he was too old, legally blind, basically was too weak to hurt anyone. But the judge ruled otherwise, he said in fact, bill cosby did meet the criteria, there was clear and compelling evidence that he was in fact sexually violent predator likely to do it again given that opportunity. This designation could weigh inn the judges sentencing, could mean that the judge will give them more time because he still deems him a danger to society, harris. Harris we are now on sentencing watch for bill cosby, former alist or in in hollywood, could face decade in prison, if that happens in the next little while, Rick Leventhal will check back with you for that breaking news. Meanwhile, this is happening. President trump firing back at democrats over the latest accusations against judge kavanaugh, saying they are playing a con game. The Supreme Court nominee vowed to fight the allegations against him ahead of a hearing this thursday. Heres the president just a few minutes ago. Its horrible with the democrats have done, its a con game, they are con artists. They are trying to convince they dont believe it themselves. They know hes a highquality person, they dont believe it. Its just resistant abstract. Harris those remarks were from the United Nations General Assembly right here in new york, he was seated next to the president of columbia as reporters were asking him questions. They come after Sarah Sanders said the president is open to having kavanaughs now second accuser testify. Heres democrat kirsten gillibrand. Ive heard from both sides and i believe dr. Blasey ford and i believe mr. Mirrors. Its not the response of someone who wants to plead his innocence, you have women telling the stories about what happened to them and credibly accusing judge kavanaugh of violent behavior, of Sexual Assault, of behavior that is disqualifying. Harris lets bring in counselor to the president Kellyanne Conway. This is a huge newsmaking day ahead of whats happening on thursday. I want to start if we can, the president s defense of judge kavanaugh today. Even though he said he was open to hearing a second accuser. That may be a little premature because the Senate Judiciary committee decides who will testify on thursday and i think we need to defer to them. As i understand it, the committee is taking the testimony of doctor for it of judge kavanaugh. But its within an hour of that article going online the other night, a thinly sourced, widely criticized by peers in the media article in the new yorker about the second accuser. The Committee Members did reach out to mr. Mirrors and ask if she would like to add anything. So they will take statements, they will take anything she would like to offer and thats how the process works. This is a process being by the Senate Judiciary committee. Lets not forget, this is not a legal proceeding or criminal proceeding, it is still the Senate Confirmation hearing of a nominee to the United States Supreme Court judge brett kavanaugh. This will be part of that. Thursday is about the two of them, judge kavanaugh has made very clear in a wide range of interviews, his wife by his side, that hes been willing to testify since he found out the name of the accuser. He was willing to testify when she was still anonymous because he is confident in saying as he has many times, and only he can say this, that he was at no such party, he had never treated anyone like this. Harris just a quick follow, the president calling this a con game by democrats, i want to get your final thought on this. The president has a point. If we are talking about the process, why did the democrats sit on this letter all this time . After 30 hours of sworn testimony, he has academic credentials and impeccable integrity and character and qualifications beyond reproach. Many of them were raising money for the 2020 president ial elections instead of asking the judge about legal precedent because they already made up their minds that they are not going to support him. The president s point is as i said yesterday, this is becoming a leftwing conspiracy. A lot of democrats, consultants, hollywood folks and others of the left wing in cahoots, coddling each other, definitely coaching each other on this. There is no question. Harris the definition of what the president is calling a con game. I want to get to Rod Rosenstein. The president meeting with his Deputy Attorney general. Press secretary Sarah Sanders says that if Rod Rosenstein exits, however he exits, that could begin the end of the Robert Mueller investigation. What is the white house saying about that now . The president made the point yesterday that on thursday he will meet with the Deputy Attorney general, he met with the chief of staff at the white house, they participated in a meeting on other issues. Some of the media are always surprised to learn that people come to the white house and justice does that routinely. The president and mr. Rosenstein will have to make those decisions i guess on thursday. As for the Mueller Investigation thats up to the president , i have not heard that and i think yesterday was a terrible day for the media getting their information from twitter, from faulty sources, people who could not possibly have known what was going on. Hes on the job today, he was on the job yesterday. The president wants to meet him in person on thursday. The department of justice, as run by the last administration, was rotten to the core at the top of the fbi. Especially when it came to putting their thumb on the scales to get Hillary Clinton elected. This is important because i see a pattern here, perhaps. Jim comey fired from the fbi had taken notes, got a book deal and leaked some of those notes to the media. Andy mccabe got fired, had some notes, got a book deal. Leaked notes to the media. Harris i want to bring you back and i hope you can forgive the interruption, weve got breaking news. I wanted to get you on the program, its so important ahead of thursday to see what might happen. Weve got a sentencing coming up with bill cosby that we are watching. Kellyanne conway, thank you for your time. Now to the other side of the political aisle on this, you are on the House Oversight committee. You just heard the counselor to the president talking and youve heard the president from earlier today as well and i want to jump back to judge kavanaugh now talking about how this is a con game. You and i talked quite frequently, how is it that democrats, specifically to senator dianne feinstein. You guys in the position to have to defend this 11th hour reveal, if you will. Thanks for having me on again, harris. As you know, dr. Ford originally did not want her identity divulged and i think thats what led senator feinstein to basically not reveal it publicly. But now we are where we are and im very glad that senator grassley is having dr. Ford come in and testify along with judge kavanaugh and we have to allow them to tell what they need to say about the allegations. From dr. Ford and on the other hand hearing what judge kavanaugh has to say and we will have to go from there. Harris this is not a court of law, Kellyanne Conway just said it, weve heard others say it and thats important to point out, it is not the evidence necessarily that will provide the case forensically in the senate, its impressions of what these people are saying. Is there a better vehicle Going Forward . Because it seems like that might not be fair to either party, what do you think . Thank you for the question. I thought that the fbi should have done an investigation with regard to these particular allegations. I agree with you that we should have someone else look at these as well, now we are nearing thursday hearing. Harris judge kavanaugh does not disagree with you. I thought the Senate Judiciary chairman and his staff should have allowed for the fbi or should have requested the president to request the fbi to look into this but now we are on the eve of the thursday hearing and so i think its incumbent on the senators to ask probing questions on both sides and really hear what they have to say about whats at issue. This is a very serious issue as you know, harris, we are in the era where we take these allegations very seriously, as we should. Harris we have always taken them seriously. Right now we have to hear both sides. Harris people liken this to the anita hill situation and that investigation, that was still only a two day fbi investigation, you are working to have to shore up evidence that there were no witnesses. In that way this might be similar. Its 36 years old, you had some people say they dont know why they are being dragged in as witnesses because they werent, so now you are going to hear from both parties on thursday and it seems to be also split down party lines. I come to you on the lateness of this and whether this is something that mightve been handled so differently but particularly by democrats. Clearly somebody leap something. I think again, senator feinstein having received the letter in the first instance had to make a judgment call, im not sure harris did she make the right call . Im not sure, i wasnt in her shoes with the information she had at the time. What i know now is better late than never, we have to understand the nature of these allegations. You know this as well as i do, only 23 of women who are sexually assaulted actually come forward because a lot of times they dont believe that they will actually be believed. Harris having somebody leaked this person isnt going to encourage others to come out. If the g. O. P. Base and even more moderate voters were not energized before, this might be driving point of intensity for them like never before. If it seems like two sides are entrenched on what they want to see with judge kavanaugh. Congressman, thank you very much for your time, appreciate it. We are minutes away from that breaking news sentencing of bill cosby. The disgraced comedian once known as americas dad, who is facing prison time after being convicted of Sexual Assault and ruled today as a sexually violent predator. We are live outside the courthouse in pennsylvania. Stay close. Speak of the president and mr. Rosenstein will have to make those decisions i guess on thursday and speak on thursday. I have not heard that. Harris white house counselor Kellyanne Conway weighing in on the speculation surrounding Deputy Attorney general Rod Rosensteins future at the department of justice. President trump is set to meet with rosenstein on thursday, invoking the 25th amendment to remove him from office. Rosenstein has denied it happening. Mark meadows demanding rosenstein testify before congress this week or face impeachment proceedings on the hill. Watch. If indeed Rod Rosenstein said these things, which many believe that he did, many believe he said it in a nonjoking manner, then he needs to explain that, not only to the president of the United States but the american people. If he does not, there are a number of us that are standing by with impeachment documents. Harris democrats are urging rosenstein not to resign in order to protect the mueller pro. Part of the freedom caucus, cosponsor of the impeachment articles for rosenstein in july. Here we are, congressman. Now talking about these impeachments, proceedings potentially against rosenstein, has it changed any, do you think it will happen . Its definitely changed. What we are talking about here is effectively a coup attempt if you want to think about it. He was saying it was a joke, if it happened it all it was just a joke. Hes kidding around about trying to find a way to invoke the 20th amendment which is basically saying the president is mentally unstable. I think its very serious and i think it adds some gravitas, additional gravitas to all the issues weve had with the department of justice which was the impetus of the original articles of impeachment. We love to see whether hes willing to come and testify. Harris Kellyanne Conway, counselor to the president , i asked this question about what Sarah Sanders said, if rosenstein exited brings about the end of the mueller pro. How would that happen and how quickly . Im not sure thats exactly the linchpin that pulls the plug on the mueller pro. Rosenstein was the guy thats basically been overseeing mr. Mueller and he hasnt done a great job of that and thats been a problem of the original impeachment. If he goes, who supervises mr. Mueller and that person will make the decision on whether this continues. Harris can you talk to me about how much i play rosenstein has in terms of conflicts of interest . For reporting a fox news there were some alleged conflicts where he may be called to testify and how james comey was fired. What are you learning about that . We believe, and i think a lot of us believed initially that he had a conflict of interest because hes the guy that said comey should be fired, hes the guy that helped orchestrate mueller getting in there, he was the hub and spoke of everything all along with the fisa documentation, warrant authorizations, these type of things. Those are conflicts of interest when they are being investigated not only by congress but by mueller ostensibly although that doesnt seem to be happening. And the need for the fbi and the doj to oversee themselves and the reports that the Inspector General brought out. All these indicate that mr. Rosenstein is one of the hubs and spokes of this whole thing and he had conflicts of interest, he was involved in all these decisions. He may have a problem providing us with real answers to what happened. Spew on thats a lot, we will continue to cover it as it happens. Let us know the latest on the impeachment movement. Im curious to know how this moves forward. Lets talk about judge kavanaugh now. You have the interview with our own Martha Maccallum last night for the judge and the wife by his side. What impressed you most about what you saw and what kavanaugh faces . I had the president spoke on this today, talking about the familial element of what they are going through. I think to see that mrs. Kavanaugh, she was very supportive but the emotional strain she has been under, the Death Threats for her and her children and all along, youve got a guy who steadfastly said none of this happened. And i was very impressed with his steadfastness, his unwavering, unequivocal denial. I was very impressed with that but harris, this gets back to the overall thing ive said right here. I dont think this is ultimately about kavanaugh in any way, shape, or form. I think the left wants roe v. Wade to remain law, they dont want donald trump to have success. Harris would you allow me to say what we are seeing on the left side of the screen. You know the president spoke earlier, spoke again sidebyside with the president of columbia and was asked about judge kavanaugh. Now hes entering a working lunch and you see several nations representatives there. The president with some strong words about what needs to happen to keep iran in particular from becoming nuclear. And now you are along side for a different kind of breaking news. We understand the president is going to make some remarks but i just want to invite you, congressman, to maybe speak to what we see on the screen here with the president at the United Nations. I want to say ive been impressed with what President Trump has done today and what hes doing right now. I think hes demonstrating that he is a world leader with significant gravitas but moreover that he is an american leader. His discussion of american sovereignty and what we are as a nation. I am grateful, i am pleased to say he is our standard bearer of this nation. Harris hes asked whether he and the iranian president sat down, at this point we are working out some other things. The president has not minced words and i mentioned that we are expecting he may make some remarks here. We may have to pull away and watch that live but i want to get your thoughts on the tone he takes. Hes changed the very tone of america, this is why we are respected again in the world. Hes basically said, you know, im in Stephen Oneill will announce his sentence of bill cosby, the 81yearold comedian who could very well go to jail for at least 24 years, perhaps more. This is why everything from the china issue, north korea i think will move to denuclearize, iran not quite sure what they should do, our dealings with russia. This is a dangerous world but you have a leader saying america is going to stand strong and to be the leader in the world and thats something we havent had. We are waiting for disgraced actor comedian but bill cosby to learn his fate. Whether because we will we wild any time in prison as his attorneys are arguing he would be at risk behind bars because hes 81. Stay close. 300 miles per hour, thats where i feel normal. Harris we are awaiting the sentencing for comedian bill cosby. A judge has already ruled today that he is a sexually violent predator, they wanted to get that out of the way before the sentencing. Bill cosby facing up to ten years in prison after he was convicted of drugging and sexually assaulting a woman in his home in 2004. His defense team has asked that he be sentenced to house arrest rather than going to prison, predominantly because of his ag age. Criminal defense attorney and a former prosecutor on set with me now. As the old age thing working court . It can. It can, particularly his advanced age, health issues, all of this could play a factor in sentencing. Harris lets go to the president of the United States, we were awaiting remarks from the working lunch at the United Nations. The United Nations has such tremendous potential, everybody gathered together, all these great leaders, world leaders, people we all know and read about on a weekly basis, sometimes a daily basis. But the United Nations has this incredible potential to bring people together. I think we are an example, certain things we are doing now towards world peace, truly a direct has a direct relationship to the time i spent at the United Nations meeting some of you, many of you are now friends. When i first came here, even though i lived in new york it was a little bit of foreign territory to me, the United Nations but now its like home. So many great leaders in this room and a lot of terrific things are happening. As you know we covered north korea, last year my tone was somewhat different on north korea than it is right now. Tremendous progress has been made and i think you are going to see an outcome, as the expression goes, who knows but i think you are going to see a very great outcome. I hope that eventually some of the other countries that we have conflict with, if not warlike conflict, trade conflict, other types of conflict. A lot of those problems i think will disappear by next year. I want to thank you on behalf of myself, secretary pompeo, secretary nikki haley, so many people have such respect for the job you are doing, mr. Secretary general. And on behalf of the United States id like to toast you and toast the United Nations. Thank you very much. [applause] thank you. Harris at the United Nations General Assembly, you heard him reference his speech which was pretty tough on iran and russia and other nations. He pushed forth with America First and now he gave opening remarks before the working lunch there at the United Nations. We will continue to watch this as the president makes news right here in new york at the u. N. Meanwhile we are going to go to the breaking news we are expecting now, weve been told in the next couple of minutes. I want to bring back criminal offense to attorney and former prosecutor, you and i were talking on camera about the situation thats going to play out for bill cosby. There were many women who came forth but this one particular case, prosecutors decided to try. Why . It was the only one that was left within the statute of limitations, they charged it on basically the last day of the statute of limitations. They allow these other women to testify as prior bad act evidence to show he had a common scheme and a plan. Harris you would said that old age can work sometimes. Do you think it works for bill cosby . Many people already see hes lived a very privileged life and you if you are found to be a sexually violent predator, do you deserve a break in court . I think for bill cosby, id be surprised if it does work. I think for most people it can work, advanced aged, but bill cosby, if this judge wants to set an example, is going to slam bill cosby for ten years in jail. Harris what do you know about judge Stephen Oneill in terms of what this particular judge might do . I think the fact that he allowed during the trial of five other women to testify as a bad sign for bill cosby. There is to go different ways he could go about this. He can choose to show mercy which would probably anger a lot of people or he can just put them in jail which would make him a folk hero. Harris when you hear the prosecution say that he would do it again, hes a predator, he is 81 years old. Is that a Strong Enough argument for the maximum amount of prison time in this case . I dont think its a good argument here because assuming bill cosby is violent predator, i think his days are long over. Heres a question of punishing him for all the other acts and other people that if. Harris i want people to catch the lingo you just dropped, you worked sex crimes in your past. You said hunting days are over. When the judge made that decision, it informs the sentencing, i would assume. You are talking hunting, you are talking predator. Thats a designation in the sex offender registration act, theres levels one, two, and three, three being more restrictive, a lifetime placement on the list. If hes in jail for ten years, its unlikely he will ever get out, it will probably be death sentence for bill cosby. Harris you said this particular case with this woman was filed on the last day that it could be because of the statute of limitations. Why did the judge allow other women to come in and what effect could that have on the sentencing . The theory that a judge allowed was prior bad acts evidence. They are supposed they are coming in to show a common scheme or plan and they argue that bill cosby had a common plan and scheme of seducing and assaulting women. The problem is that the idea of prior bad acts is basically to show complicated financial schemes and things along those lines. On a sex case you are really risking under prejudice. A lot of alcohol was involved in a lot of these. Harris some of the women who came forward, not all of that made it to this courtroom but some of them have talked to other publications and some of them have alleged that they were drug to the same way, there seems to be some sort of pattern among women who wouldnt have known each other in any other category. It also depends on what quaaludes were used for back in the 70s, as an inhibition releasing drug. Harris just to make it clear, outside that courtroom in norristown, pennsylvania, where we expected any moment we are being told that the sentencing will be coming. In this case we already know the verdict and this ruling on top of that verdict is by this judge calling bill cosby sexually violent predator. What will the sentencing be . Thats what we are awaiting right now and weve been told that can happen at any moment. We have our own Fox News Team inside the courtroom and Something Different i want to talk to you about, they expect this to take a while to read the sentencing. Weve heard the impact statement. Walk me through what happens next. The judge for purposes of review, the appellate record is going to look at this case, they are going to look at this case and they are going to analyze everything he said. He has to lay out all the factors for sentencing bill cosby. He cant we had to be very careful here, you asked about what impact the other women testifying could have on sentencing. He has to be careful hes finding it appropriate to sentence bill cosby in jail for the act against this woman. Then he can say the other evidence that came in also supports his findings that hes a predator. Harris this is the first time in the metoo error that weve seen a celebrity go to trial and you think its possible from what you said that the judge may make an example of bill cosby and he gets the ten years. Standby, please, we are awaiting the cosby sentencing coming up. Stay close. Financially well for all those extra years . Well, you have to start planning as early as possible. It started yesterday and the judge would make a determiner of whether he was a sexually violent predator and he did that. Bill cosby facing up to ten years in prison and with my legal guest onset with me today, its a possibility that this judge may take a look at this and say okay, this will be an example. Are we looking at life pictures . Im asking our control room right now. This is former file footage of bill cosby entering the courtroom. We are waiting for that sentencing to begin, this is norristown, pennsylvania, there is one woman that bill cosby has been found guilty of sexually assaulting and drugging. We will bring it right here to you live on fox news. Another alert now, President Trump with his second address to the General Assembly, the Foreign Policy success in his big speech earlier today, tensions have used between the countries in recent months while also pushing a hard line against iran today and announcing these sanctions against that regime. Heres the take. A campaign of economic pressure to deny the regime the funds it needs to advance its buddy agenda. Last month we began reimposing Nuclear Sanctions that have been lifted under the air india. Additional sanctions will resume november 5th and more will follow. Harris chief White House Correspondent john roberts is live from the United Nations, this quite the day for the president and he continues or marks to the american people. What is been the point with him today . The overarching theme here is that the president is trying to put the screws to iran, youre a member at the u. N. General Assembly Last year, the president all but threatened war with north korea, punitive sanctions putting on a program of maximum pressure, enlisting kim jong uns neighbors in the region to put as much pressure on him as possible. The president doing the same thing with iran now, accusing them of being the worlds worst state sponsor of terror among other things, raiding the countrys piggy bank to line their own pockets and the president saying the world has to come together to prevent iran from ever developing a nuclear weapon. Listen here. We cannot allow the worlds leading sponsor of terrorism to possess the planets most dangerous weapons. We cannot allow a regime that chance death to america and threatens israel with annihilation to possess the means to deliver a Nuclear Warhead to any city on earth. There was some talk that the president might carve out some time to meet with the iranian president , the president but that one on the shelf earlier today, i imagine he is an absolutely lovely fellow about the president saying the bilateral meeting in columbia today, he believes around one day will come to the table. Some of our allies, some of our opec allies in germany in particular gaining some criticism but the u. N. Gaining some criticism for laughing at the president. When he unveiled his list of economic accomplishments at the beginning of his speech. Listen here. In less than two years, my administration has accomplished more than almost any administration in the history of our country. America so true. [laughter] didnt expect that reaction but thats okay. Of the president now having that lunch tomorrow, he chairs at the session at the United Nations Security Council where he is expected to again go after iran. Nonproliferation with the president , try to get as much momentum as he possibly can to put pressure on the Iranian Regime to change its ways. Those sanctions snapping back november 5th, that will be the start of it. Harris john roberts, thank you very much. We are awaiting the sentencing of former Hollywood A Lister, Television Star bill cosby. Vote yes on 11 to ensure 911 Emergency Care is there when you or your love one need it. Harris some activity in the hallway in norristown, pennsylvania, as we await the sentencing of former Hollywood A Lister bill cosby, now a convicted Sexual Assault criminal. And a sexually Violent Offender and predator. He faces a maximum of a decade behind bars, but here are the details and i was giving it before we went to commercial break. If he receives less than 24 months he will serve time in a county jail in pennsylvania. If hes sentenced to more than two years hes going to state prison. A former sex crimes prosecutor joins me now from houston, texas. Talk to me about the difference in those sentences and what it would be like for bill cosby. Either way its going to be very unpleasant. Jail is jail, whether its prison or the county jail, its jail. A somebody of that age poses are really difficult situation, a problem quite frankly for the people keeping him in custody for all kinds of reasons. Cost of health care and maintaining his health are not one of the problems with this issue. Keeping them safe is another. There are a number of concerns with the case of this nature. Harris i hear their criminal defense in your voice there, thats some of the things his attorneys may say. The seriousness of his crimes, the hashtag metoo moment we are in right now. How does this play out, could the judge give him that . But for his age he would be looking at the maximum and the judges really going to have to weigh this from every side, all the concerns the jail will have about keeping him versus the appearance of whatever sentence he gives and quite frankly hes been found guilty which is why hes being sentenced and to the judge will have a really hard time not giving him prison because of the way it looks. Harris and 81yearold man called a sexually violent predator today and it is bill cosby. Thank you for being along for the breaking news here. We continue sentence watch right now. Norristown, pennsylvania, bill cosby. Will he go to prison . Stay close. The consequences underwater can escalate quickly. The next thing i know, she swam off with the camera.
