Said that the probe is wrapping up and Michael Cohen prepares to testify next week. Lets bring in a former Justice Department prosecutor. Welcome, good to have you here again. Lets start with the mccabe revelation that he and the Deputy Attorney general, Rod Rosenstein, talked about the idea of invoking the 25th amendment to replace President Trump. Have you ever heard of anything like that before . No. It is pretty outlandish and i feel that way really for two different reasons. One mccabe and one rosenstein. Mccabe is serious quit ability problems. Inspector general found he lied multiple occasions including lying about the last conversation with the inspector general. He is on a book tour has a criminal referral out there and a lot of access to this ensemble interviews. On the other side and no Rod Rosenstein. Hes a prosecutor, a guy that is very standup and ethical and also very i wouldnt think that he would think this is even remotely in play. Its about disability, not dislike. I think on both ends of the spectrum there is some serious credibility questions. Surrounded mr. Mccabe s obligations. Was astonished that he was in no position to be able to invoke the 25th amendment. Of course he wasnt, he doesnt deny that he raised the issues. So maybe this was just the turmoil of the time that kind of chaos after the James Comey Firing that might have come up. I dont think would come up in a straightlaced way. I think its possible that rosenstein was sarcastic, dismissive of the notion. But you remember also when doj issues these denials, they are being very careful not to expose more detailed investigative conversations. I think hes kind of heading back with one arm behind his back. Paul you would like to see them testify as Lindsey Graham has said with the Senate Judiciary committee with all of this with Rod Rosenstein . That could be helpful i suppose. I do not know if i wish that on any of my friends. Were my enemies. [laughter] but i think rod will do very well in front of congress when it comes this type of question. I dont think he has anything to hide. I think theres a big comparison, a stark comparison between him and mccabe when it comes how they will perform. In terms of the constitution, if you are someone in the ministration anything the president of the United States is in some ways compromised, is your obligation to presumably resign and to then state why you are resigning and the, under the constitution, the remedy for Something Like that is impeachment. Go to congress and say look, he is compromise, cannot fulfill his duties and am willing to testify to that. I think that is the honorable kind of Law Enforcement approach to it. And that is what seems so out of place me talk about mccabe and james comey going on the view, doing book tours, is just a different politicized world that the fbi top reaches recently. I think even a lot of rank and file fbi agents that i know are welcoming the change and scrutiny and they want to see kind of a different attitude from the top of their organization and they are seeing in these guys. Paul the cigarette where Robert Mueller stands right now. A lot of talk and media reports that somehow this is going to be soon over and he will issue a report or tell the new attorney general, william barr that he is wrapping up. Where do you see this at the present moment . I think theres a lot of reason to think is the finish line. Part of it was back to the fact that President Trump was given a takehome assignment that he was given written questions. It sounded like someone that was more checking a box and trying to get incriminating answer. The fact that sentencing is starting to happen for either failed or breach cooperators, it tells me im not trying to preserve them for trial testimony. And i think theres a personnel i think it makes sense that were heading to the finish line. Whats interesting is getting a report to the attorney general does not necessarily mean the rest of us will see it. It is a real open question about how we will be released and how much and the timing of that. Paul what would be your advice to william barr . Theres an argument for making it public, just for the good of the country. To be able to see and layout what is the argument that hes making. On the other hand, if in fact, there is not a lot or maybe theres some innuendo about certain individuals, you dont want that to be public without charges. I do not think he needs any guidance from me. Hes a pretty steady hand. But i think when he will probably feel pretty compelled to do is scrub it for truly sensitive information. I dont mean embarrassing. I mean Like International kind of Intelligence Community type information that has to be redacted. There may well be some of that but i also think he realizes in the big picture, its really unattainable to think that this report would go no further than the president. I suspect he feels a pretty instant tug to have this release. If he releases it to congress it will take seven seconds for it to leak but i think he will probably be a strong advocate for full disclosure to everyone. It makes more sense to add him without waiting for someone to leak that and make it look at it is somehow nefarious. Do you agree . I think it makes sense. As a political correlation with an illegal one. I think at the end of the day, dripping it out through leaks or through kind of partisan half stories is not the way to do it. Basically that the whole thing come to light. Paul okay james trusty, thank you for being here. Appreciate it. Paul we come back, Bernie Sanders lodges is 2020 bid. Some democrats say his moment has come and maybe gone. What the vermont socialist brings to a field already brings to a field already crowded with progressives. Paul vermont senator Bernie Sanders launched his 2020 president ial bid on tuesday raising 6 million for more than 225,000 donors in the first 24 hours. Sanders joins a rapidly growing democratic field but hes wasting no time setting his sights on one opponent in particular. Is absolutely imperative that donald trump be defeated. Because i think it is unacceptable and unamerican. To be frank with you that we have a president who is a pathological liar and gives me no pleasure to say that but its true. Weve president that is a racist who is a sexist, who is a xenophobe. Paul joining the panel wall street journal calmest and deputy editor, Dan Henninger and Editorial Board member kyle peterson. Dan, well get to the rhetoric in a bit. What about, what are the assets that sanders brings to the campaign . Well, he brings to the campaign that he walked in from nowhere in 2015 and 2016 and significantly challenged Hillary Clinton for the nomination. As well, people forget back then and most of the headtohead polling that was done, bernie was in the lead of donald trump and people go, how can a 70 something socialist senator from vermont, have the support . Bottom line is, he does. People are saying that he finished his time was back then. He raised 6 million in one day. In the beauty contest polling right now he is just behind joe biden. Bernie sanders has something that appeals to a lot of democratic voters. Paul and has a passionate following. I guess one of his appeals is, i am the real thing. You want a socialist . I am a real socialist, okay . I call myself one. None of these trimmers who will sell you out. Right. One of the questions is how broad the bases. We know it is deep and enthusiastic but i have two numbers. In the 2016 primaries he won 1 4 black voters and about 1 4 primary support did not vote for Hillary Clinton in the general election. The question is, what he can broaden the supporter with he can take advantage of a divided field. There are 20 candidates on the debate stage. He can keep a broad, solid 30 percent of the vote. He could steamroll the nominations that way donald trump did. Paul no longer the only left of center candidate or progressive in the race. Yeah, think one remarkable thing is that his blood in his socialist agenda, much more in the Democratic Party. He is setting the direction of this right now. Medicare for all, the green new deal, free college. Yes and i think also he has made socialist not a dirty word anymore. It is something that during the obama era, it is something that now young people are claiming. Paul wait a minute me let me push back on that a bit because it is true in certain circles but donald trump clearly aims to make it a dirty word again. He did in the state of the union. And is it, i talked to democrats who say look, we really want to beat donald trump. But bernie is too far left to beat donald trump so the electability issue is Something Weird to think about in the primaries. I think a lot of democrats are in the position to be honest. They are very far left so they have to appeal that to get the primary support. But they risk isolating the broader american public. And i think it will be a difficult thing. Not just for bernie but others to navigate. Paul what about the rhetoric . The clippers extruder. Pulling the present physically a liar. He called him homophobic, racist, sexist. I mean, i am trying to remember when even come any political opponents so that about a sitting president. Yeah, it is very negative. Maybe that is one of the biggest things on the downside of Bernie Sanders. I would put Elizabeth Warren in there as well. When youre running for the presidency of the United States, its hard to see how you can run from start to end on such a negative argument like that. That you find your opponent hateful. You have to provide a more positive vision. I would be a little surprised to take the trip to see sanders go in that direction on donald trump. That long a creditable list of things. Liar, racist, pathological liar. But the democrats are just consumed with antipathy for donald trump. Its part of the dna seems like they all feel they have to do. Paul but Amy Klobuchar for one, and i think even cory booker, they are critical of trump but not they are offering a more optimistic view of america. It may be part of his play for the identity politics. It holds a lot of sway to the Democratic Party. Bernie sanders is not checking those boxes. He was asked about that this week. How can you lead a diverse Democratic Party . He paraphrased Martin Luther king said we need to look at candidates character, move toward nondiscriminatory society. Annie got a lot of pushback. People and left so the idea that someone is saying identity is not important in this day and age, is just wrong. Paul that might be a potential youve done some reporting about Burlington College. And his wifes role as a former president there. The School Leader went bust. Tell us about that. Yeah, so, the child ended up with a 10 million loan to acquire land. Paul in vermont . In vermont. To do that, they said they secured all of these fundraising commitments. It turns out that money never came through. The college ended up closing under the crushing weight of that. But there been questions about first of all, why the college had less than two main dollars was so easily able to get 10 million in loans. Whether Bernie Sanders political influence played into that. And if you look through some of the Financial Disclosures that the college filed, loan, more than 300 a Burlington College money. It went to a school owned by Bernie Sanders stepdaughter pete looks a lot like nepotism. Paul they say look, the us attorney looked into this. They filed and no charges. Nothing is wrong here. Move on. Do you think it will be an issue of the campaign . Absolute. Higher education was 2016 momentum. I really think this is it topic to look into. And again if youre looking at socialism, and has has some of financial incompetence and i think Burlington College us weve seen. Jane is already very political figure and advisor. I think its something to keep in mind. Thank you. Welcome back, Governor Newsom accusing the president of political retribution. After the initiation announces plans to yank federal funds for his train. Ive no interest in sending back during and a half billion dollars of federal funding that was allocated to this project to president donald trump. cos i know what it means to walk along the lonely street of dreams here i go again on my you realize your vows are a whitesnake song . Paul an escalation in the battle between President Trump and california governor, gavin newsom. With the ministration announcing this week they will cancel where the 900 million in funding for california s highspeed rail project. And is actively squaring ways to claw back an additional 2. 5 billion that has a ready been spent. Newsom announced last week he is scaling back plans for the 520 mile bullet train from la to San Francisco critical to political retribution four participation in the lawsuit. In a tweet tuesday saying quote the failed fast train project in california, where the cost overruns world setting desperately paul this was former governor jerry brown s signature project. He was says it was a california embracing the future. Why would his former Lieutenant Governor stop the project . Thats right. I would also point out Arnold Schwarzenegger before him really championed the project as well. Gavin newsom has just acknowledged reality. There is no course to completing this project. 520 miles from San Francisco to la. It is already over 14 years behind schedule. Youre looking at the end of the century before it could probably ever get done. And they dont have the money paul how short are they . There 40 70 billion dollars short. Is the present right as for the money back . Are things exactly right because california has not been holding up to the end of the bargain. The federal government had a degree with northcarolina , california repeatedly broke it, they did not submit timely reviews and reports. It missed deadline after deadline. I think its about time the federal government yanked money. Paul but gavin newsom saying im not killing this whole thing. Im still going to build the merced to bakersfield blocking the Central Valley we are not giving up on the whole project so you still owe us money. Thats right. And ironically is probably the least popular part of the project that they really dont like it because its destroying a lot of property. Even then, that is part of the project. It will still take over a decade and more money to complete. A lot more money. This california really have it to do this . Quickly projecting a surplus. It has one to 2 billion in trade revenues every year. It has another five or 6 billion that it is bringing from the gas tax paid is basically a free ride on the federal government. What about the other fights . This is part of a broader brawl between leftleaning california and the trump administration. A fight over fuel economy, standards that broke down this week the negotiation so it look like it will end up in court. You have the emergency board declaration that is also ending up in court. Right. Dont think this is political retribution. It doesnt make sense and anyone would have canceled this. This broader picture is how federalism is supposed to work. Particularly the environment where congress is no longer jealously guarding its own power. Paul what do you mean by that . How is this making federalism . The counterweight to the president , it is supposed to be congress, congress has become a Tribal Institution that will go along with whatever the party wants. The states are stepping in and kinda fulfilling the role. He saw this during the last administration when obamacare was, came down. A lot of republicans, texas was one of the leaders to file the lawsuit against it. This is the natural giveandtake of the system. Paul interesting. I also think that donald trump is teeing up california. President trump is always looking for villains he can fight with. I think you may california a general villain for his reelection campaign. This time based on some substantive issues like the bullet train, and these fuel economy. The Edelman Institute out there put out a fascinating study this week, 53 percent of californians are thinkin
