N. , will be going back to the white house where he will sit down and have a frank conversation with Rod Rosenstein about all of the allegations. Something else the president brought up today that is worthy of discussion, the charges that he levelled at china and russia again on election tampering saying that china is taking out ads that look like news stories in newspapers like the Des Moines Register to try to swing the election to the democrats and take away some of his power to go after china on trade. That the real sentiment building that the judge has to be super forceful and passionate in his response tomorrow. I think theres no question that the judge has got to put forward his absolute best case. Dont forget, hes not going to be questioned by senators at least on the republican side. Hes going to be questioned by a seasoned prosecutor of sex crimes for maricopa county, arizona. So he better have his a game on. I really do believe that his nomination rises or falls not only on what he says tomorrow but how he says it as well, neil. Neil thanks very much. Ahead of that, the focus is exclusively right now on this hearing about Christine Blasey ford and her charges dating back to when she and the judge were both high school students. But two other womens names have come up in the interim, Deborah Ramirez who has similar claims about her interactions with the judge when they were students at yale. So in college. So then a woman of materialized Julie Swetnick. A Michael Avenatti client that goes on to make charges. Theyre different but part of the theme that the judge was a serial harasser and more. Now, the issue were hearing is that these other women cannot be brought up. That its Christine Blasey ford will be the focus of this. That will not stop the Democratic Senators on that panel when the judges turn to respond to dr. Fords charges to address these other women. Enter emily. This could turn into bedlam, couldnt it . What is your sense . Yeah. This is a very, very fragile situation. I think theres a reason that theres a seasoned prosecutor that will be doing a lot of the questioning tomorrow. Not only because there are no female republican senators on the senate Judiciary Committee but shes seasoned in investigating sex crimes. I think well see her being leaned on heavily and for a reason. But this is a very fragile situation. When you have allegations like this, of course it is. But at the same time, i think its very, very important to note from what i sense the mood of the Republican Base has shifted critically when it comes to allegations of President Trump will feel embolden and that could embolden republicans on the Judiciary Committee. Theres a sense that what is happening a democratic delay strategy and the Republican Base is sick of it and wants to see the senator stand up to that. Neil so lets go on this personal crimes prosecutor will be serving in her role of counsel asking dr. Ford these questions. Are both sides of the senators expected to honor that and let her do all the questioning . If republicans want to jump in, can they and conversely as the judge has to take on and deal with those accusations from Rachel Mitchell, can either side, senators most notably democrats, get their chance to pounce on him an question him . Senator grassley will be presiding over the hearing. I dont know exactly what to expect in terms of whether democrats will try to jump in, whether republicans try to jump in. Im sure that senator grassley has a strategy and im sure that he has laid out his expectations to both sides as to how he expects this to play out. Weve seen him be very forceful. Hes used a great tone in explaining that he wants fairness and he wants people on both sides to come with a sense of primary mission to get to the bottom of this, not boost their president ial bid or put on partisan shows. Well have to see how it goes down. I expect probably a more reserve process than what we saw in the initial hearings. Neil the focus had to be on at least originally christine fords allegations. Its possible the Democratic Senators could go on to the other allegations and particularly with the judge, right . Its certainly possible. I think it would be kind of odd and maybe unfortunate. We have two sessions. One with ford around one with kavanaugh. So you have to give the whole point of the hearing is to give both sides equal time to be probed on what happened and tell their stories. What is the sentiment building ahead of this on the hill . Neil, its all systems go. 18 hours from now, this room will have Brett Kavanaugh and Christine Blasey ford. The hot seat is there in the front seat getting ready. The way that we understand it, the room empty now but once republicans are in there, they plan to yield most of their time to Rachel Mitchell, the experienced sex time prosecutor from arizona taking leave to be here. Both sides are bringing their own evidence. Brett kavanaugh will be his calendar from 1982 where the month of may lists cutting the lawn, being grounded and basketball related activities. Dr. Christine ford is bringing evidence in the form of sworn affidavits signed by friends that tell the committee that later in life she mentioned that she was sexually assaulted by someone who became a federal judge including one that says it came up during a conversation about the stanford trial of brock turner. This is going on even though theres fresher allegations brought by Julie Swetnick who is represented Michael Avenatti and alleged that kavanaugh and his High School Friend took advantage of drunk girls and were present while some were gang raped. These allegations are absolutely breathtaking. They are a gut punch for this nomination. Kavanaugh allies see a lack of evidence with all of the allegations as a reason to move forward with a Committee Vote quickly. I dont believe Brett Kavanaugh is a serial rapist. Theres nothing in his background the way he lived his life to give legitimacy to these claims. I look forward to hearing from mrs. Ford tomorrow. Chuck grassleys investigators are working right now to try to flesh out the latest batch of accusations and while they do, theyre saying tomorrows hearing will continue because to cancel it in light of anything else would not be fair to dr. Well get to the implications of that because republicans could really afford to lose one vote among their peers. They lose two, this is not happening. Assuming that all democrats vote against the judge. That is not a given but it seems to be a growing consensus here that this latest dust up over the judge and these allegations provides cover for some of those democrats running for reelection in states that the president won big might have an excuse not to vote for the judge. It will concern his future there. All of this after comments that Rod Rosenstein allegedly made back in 2017 wondering whether he should wear a wire and whether the president was fit for office and invoking the 25th amendment to kick him out of there. What will happen tomorrow with the president . Does he fire him . Maybe Rod Rosenstein quits . We have no way of gauging this. Lets get the read from house judiciary member, matt yates who says the guy should resign but for other reasons. You have a host of reasons. If you took it in the light most favorable to Rod Rosenstein, he would have been joking about wearing a wire on the president of the United States. That is an inappropriate thing to do when you lead the Justice Department. You dont make jokes about destabilizing the presidency in front of your colleagues and subordinates. In an administration where theres a culture to resist the commanderinchief, it seems as though this is the type of contribution to that ecosystem that is very unhelpful. So its my expectation that if Rod Rosenstein is not before the house Judiciary Committee to give testimony about what happened and the context that we may force a vote on his impeachment. So if the president says i want you to stay and youre working with your colleagues and the House Freedom caucus and elsewhere saying we kick you out, youre not on the same page . We have an obligation separate and distinct from the president. Our job is not to work for the president. We work within the congress to conduct oversight on the department of justice. Its literally our job in the Judiciary Committee. I wouldnt care if it was a republican president , a democrat, a president i liked or didnt like. If you have employees at the Justice Department making these jokes or maybe it was a joke to try to gauge peoples reaction to see if it would lead to further conduct, we dont know. Its really bad for the country to be addressing these questions in the absence of facts on the record under oath. Thats why mark meadows is meeting right now with Speaker Paul Ryan to see if well secure a hearing for mr. Rosenstein to give that sworn testimony before the congress breaks for october. Neil we dont know what really happened and whether he really made the remarks. They were in gest or earnest or taken out of contest and how things have changed since they were allegedly made. So much we dont know. Congressman, im curious to get your gauge on lets say you get what you want. Maybe be careful what you wish for because now you have a guy who would turn into a witness for james comey or certainly bob mueller going back to the comey firing and everything else. That could create a bigger mess for the president. I dont think its about making a mess for the president. I think its about transparency for the american people. Whether the information is good, bad. Its good to have things play out committee on the senate side urging the democrats to postpone the hearing. Many democrats think its a combination of charges here that the judge is damaged goods and should step aside. How do you feel about that . I think its particularly disappointing that senator hirono from hawaii is fundraising off of this. Making statements about the appointment and using it to dry to generate campaign contributions. That is not helpful to the process were in. I also think its dangerous if we say that the sum of allegations, the volume of allegations is sufficient to not have to test the voracity or truthfulness or legitimacy of those allegations. We dont want to live in a country where the allegation and the conviction are synonymous. We have to test those claims.
