Long before the president got anywhere near the east room for the press conference, john kelly called up Jeff Sessions and told him again, probably one of the worst kept secrets in washington over the last few months, that the president wanted his resignation litter. We dont know if this was a Resignation Letter that Jeff Sessions had in his back pocket, sitting in his desk because it was updated. Jeff sessions sent the letter to the white house. We confirmed that Matt Whitaker will be taking over as the acting attorney general while the president sought a permanent replacement for the attorney general. The president was asked about changes to the cabinet, specifically sessions. The president said asked me about that at a later date. We didnt know it would be 90 minutes later. I talked with members of the president s legal team a short time ago who said as far as theyre concerned, Rod Rosenstein is still running the Mueller Investigation and they have not made a decision yet whether the president will submit written answers that they prepared for robert mueller. So i think the big issue is whether the report gets released and that will very likely not be up to rosenstein but be up to the new attorney general. You can see how this is politically escalating. What do you make of that . First of all, im surprised at the acting. Typically its something that has been confirmed. You know, theres a lot of season and and experienced individuals at the department of justice. They have to have confidence with the person at the top. I dont know Matt Whitaker<\/a>. I dont know his background. I know he doesnt hes in the confirmed position. Its surprising to me. As to whether or not he should recuse himself, what he needs to do is have a conversation with the career folks in the department, lay out the facts and let them advise him, let them recommend to him whether or not hi should recuse himself. I dont care what Chuck Schumer<\/a> says. Listen to the career individuals at the department. If they say recuse like they said to Jeff Sessions<\/a>, he should recuse himself. So naturally follows he would be the acting attorney general. Neil but thats not happening. I know. But there will be some issued raised about that. That is the order of succession. Neil what do you mean i think my point is, theres going to be a lot of questions. Why. Why would you go outside the regular order . President trump has shown a willingness to go outside the regular order. Heres a key fact. For all of his abilities, i met him, i dont know him well, be mr. Whitaker has not faced questions before the Senate Judiciary<\/a> committee with respect to issues broadly affecting the administration of justice. He was duly confirmed a United States<\/a> attorney and a very important position as judge gonzalez was saying. So theres no doubt about his qualifications. So we are have here a genuine issue with respect to accountability. Im not saying its beyond the president s power. But when, for example, theres a saturday night massacre years ago and they talk about this in my book, so elliot richardson, the attorney general resigns. Bob vork becomes the attorney general of the United States<\/a>. The acting attorney general. Neil and that spiralled out of control and got crazy. This is just hypothetical. You can ignore it. You deal with a lot of crazy questions. But im wondering if rosenstein is not to happy hes the logical even acting replacement until they have a permanent replacement and whitaker moves to the front of the line. What if he were to say, ken, im out of here . Then we have instability in the department. Thats the other dimension. Todays story as well, how did this happen, et cetera, the questions being raised will have to be answered including in confirmation hearings in the fullness of time. The department of Justice Needs<\/a> stability. So anything that does not promote the stability of the department so that the department can go about its important work, the thousands of men and women that serve very well, im concerned. I want to see the department, which i love. I had two tours of duty there. I want to see the department do very well and i hope it will with this changing of the guard. What was interesting, i ran into the Resignation Letter<\/a> on the part of Jeff Sessions<\/a>, he made it clear this was not a volunteer effort. You know, he made it clear the president asked him to do this. Yes. I like Jeff Sessions<\/a> very much. Ive known him since he was a United States<\/a> attorney in mobile, alabama. This is his dream job. Neil and youre very old. Not as old as i look. But every lawyer who serves in the Justice Department<\/a> has this deep respect for the attorney generalship. Its as old as the republic. Edmond randolph, the first attorney general, through some ups and downs. So its a venerated position that people in the department respect and want to respect and admire the attorney general even though they dont agree with the policies. Its one of the great anchors of the rule of law. So the other issue that will come out with respect to integrity of mr. Whitaker and his relationship with the president of the u. S. Theres nothing wrong with my view that the president knows him and the president thinks well of him. With that. History shows Robert Kennedys<\/a> Outstanding Service<\/a> under his brother, john and john kennedy says he needs to get some experience before he goes out and practices law. So that was one thing neil i think the president s father was pushing for that. The point is confidence. The president needs confidence in the attorney general. The Department Needs<\/a> confidence in the integrity of the attorney general. Neil being a former senator, Jeff Sessions<\/a> has a lot of friends. Chuck grassley among them. He said Jeff Sessions<\/a> is a dedicated Public Servant<\/a> and i served with him for 20 years. His leadership as attorney general are admirable. Jeff deserves the thanks of the nation for service. Im grateful for his valued friendship over the years. Others have gone on to say whatever you make of the timing of this is that something more potentially sinister afoot. That is the Mueller Investigation<\/a> potentially wrapping up. This is a way to force either that report or to force something else. What do you think . Dont read too much into it. Its clear that jeff was on his way out the door. Attorney general sessions was on his way out the door. Everyone recognized that. So the timing. I expected it. I expected it promptly. Neil everybody did. I didnt know in it would be today but i know i dont have your confidence, this is the time to step down. The one thing you can take to bank is senator Charles Grassley<\/a> is a person of integrity. He will insist the attorney general to turn square corners a and do it right. The country has to have confidence that the Justice Department<\/a> is doing it the right way. Obviously you said before this, you had not seen anything to your knowledge that looked close to an Impeachable Offense<\/a> how would you now . Youre right. I have not seen. Youre asking the right question. How do i know . We now think having an attorney general, Matt Whitaker<\/a>. This is not a household name. He was serving as chief of staff for Jeff Sessions<\/a>. He was a u. S. Attorney. My contacts say that he has behind the scenes pointed to the declassification of the russia records that are specific to the surveillance warrant that was obtained in october of 2016 for a Trump Campaign<\/a> aide. Significantly today at the News Conference<\/a> with reporters, the president indicated that those records could be public soon. Its amazing how people on the other side dont want those documents released. My contacts in the Justice Department<\/a> and former people with the fbi have all of this concern act the facts that they had a twoyear period where theres not been an attorney general in firm control of the department. That began with Loretta Lynch<\/a> in the summer of 2016 when she recueded herself from the clinton email investigation and Jeff Sessions<\/a> recused himself from the probe over the contacts with the russian ambassador. As a final point, every time weve seen Jeff Sessions<\/a> at the Justice Department<\/a> at the announcements, whether its the opioid or immigration, hes always, if i could use this, really classy even though he was under a lot of criticism from the president and others and seemed committed to the mission and that was reflected in the letter to president today. And jerry nadler signalled that in a tweet. He will be the chair of the Judiciary Committee<\/a> in the congress. This will be a fine line that democrats and the house of representatives will have to walk. The incoming speaker of the house, nancy pelosi said she wouldnt have scattered freelancing investigations. She said that before the session news broke. A lot of people on the republican side predicted that the democrats would get their hooks in the administration. Heres another thing. Congress comes back next week, the First Time Since<\/a> the midterms. The midterms are about protecting bob mueller. Theres Bipartisan Legislation<\/a> in both the house and the senate. Tom tillis from north carolina, cory booker from new jersey will protect mueller. Theres pressure to try to move this in the lame duck session. This will be a top priority of House Democrats<\/a> when they come up. Heres a statement from Chuck Schumer<\/a>. He said if they were to get rid of bob mueller here, it would create a constitutional crisis and especially in the departure of Jeff Sessions<\/a> were a prelude to ending the mueller problem. Lets go to the outgoing house judiciary member, congressman darrell issa. We talked about jerry nadler stepping in soon. Already, theyre raising the red flags. Are you . The challenge is that legitimate oversight is the obligation of congress. Unfortunately incoming chairman jerry nadler has a longstanding grudge with the president. Hes made it clear impeachment is a goal. That makes his investigation suspect. Theres no question at all as a longtime investigator, congress has a role and this administration has and needs to even more provide cooperation with legitimate inquiries for the interest of congress in its oversight role. Im hopeful the administration will do it. Certainly the million documents and white House Counsel<\/a> being produced is a good example of cooperati cooperation. Was there when bush lost control. Neil theyre making a big issue that the president will try to do something to mueller. Either discredit or even push for his firing. That would not appear to be the case but they want to guarantee he cant do that. Ive seen some of the legislation. The reality is that if mueller cannot come up with a single indictable event that went on in this administration during the campaign by any of its highranking people in the next few months, then his campaign to look for it should end. Two years is a long time neil and we are told something will come up soon and the timing is odd. The timing after the election is one 0 the appropriate things to come up. They did indictments last minute of two members of congress. Doing it after the election would be appropriate. If that had somebody that did something wrong working on the the president , great. Bring it forward. Up until now, every one of these indictments has been completely outside his mandate. Thats one of the areas that is frustrating. Do we want to protect mueller if he has that and hes going after it . Of course. At the same time, you dont have a special prosecutor to look for a crime. I dont know yours or anyone elses private lives but very few people have never done anything wrong, including jay walked. So if you put something on someone long enough and you tell them just to go look for something, eventually theyll find something on somebody. Neil the president has always called this a witch hunt. It is but is it in your eyes that . It is a false narrative created by Hillary Clinton<\/a> and the dnc that lead to an investigation that is looking for a crime alleged in that false dossier. So it just because it was a false dossier doesnt mean something didnt happen but at the same time, the case, the legitimacy of this investigation and special counsel was created by what we now know are discredited documents. Your district is split. But im wondering, what is it going to be like the next couple years with democrats in charge of these key committees, in charge of the house . I know what its like to be a chairman and i know what its like to be a Ranking Member<\/a> and try to hold the chairman to do what they should do. Theres plenty we have 74 Inspector General<\/a>s that are just teaming with things that go wrong in any administration. Neil youre thinking were going to see a lot of investigations, subpoenas and on and on. I would think the first thing the incoming chairman would do is look for the waste, fraud and abuse that exists in government and go after that. Henry waxman found out that we had flown countless millions of dollars wort of 20 bills to iraq and lost track of them. Cash that disappeared. Those kinds of things are part of congresss oversight. So there there be legitimate oversight. Ranking members now republicans have to support that on the bipartisan basis. There will be clear witch hunt. There will be attempts to smear the administration and the minority has to step up to the plate and call those balls and strikes so the public understands that republicans have to be for making sure that waste, fraud and abuse is taken on. Because it happens in every administration. At the same time, theyve got to be the ones that say well protect if you will the administration against unnecessary an very expensive intrusions into their prerogatives to work with this bureaucracy to make it work better for the American People<\/a>. Neil you think its going to be crazy for the next couple years . Out of the election, the president said we did better than most administrations and the first midterms and the republicans did gain more seats in the senate. But its not going to be a cumbaya washington. No, its not going to be a cumbaya washington. It hasnt been since people said that president bush was appointed. As someone like you looks at business more often than politics, the market made a statement today. The market made a statement. Neil i agree with that. The statement was strong neil they were panicked about a constitutional crisis, they wouldnt have done what they did. And i believe neil the market is telling you this wouldnt develop into one. What do you think the gut read is . You think it right . I think their gut read that you can create investigations in the house and some are appropriate and the senate will be that cooling saucer that was described historically that is not going to let unreasonable things from the house spill over into legislation. That will be a big part of it that you can pass anything out of the house by simply ordering your party to vote that way, but senators arent of either party are not willing to take what comes from the house and rubber stamp it. I think the split congress is one where the markets are quite happy. I think theyre also happy that nancy pelosi doesnt have some huge majority where he can run rough shot. In fact, theres people like Collin Peterson<\/a> and other moderate democrats that quite frankly are not thrilled to walk a plank for nancy pelosi. Neil real quickly, were told, chairman, that Rod Rosenstein<\/a> has left the white house. We dont know what happened there. But this was apparently a prearranged meeting. If he wasnt fired or asked to resign, what do you think it was about . Well, you know, i would hope that he understands he has a new boss neil wouldnt he be offended that he is the acting deputy hes the deputy. Neil youd think he moves up. Clearly theres a conflict. Hes been overseeing the Mueller Investigation<\/a>. If he continues to have the daytoday responsibility for that neil Chuck Schumer<\/a> says its a conflict. Whitaker probably has no conflict. To be honest, now we know what we know about the investigation, the reality is attorney general sessions didnt have a conflict but he erred on the side of being very ethical. Its a great sign for the market today. This is more than a relief rally. Its real buying. Institutional buying. The market broke out. In the morning, we broke out around lunchtime and we are up in the afternoon. This is finally what we wanted to see. We got more than 50 over the selloff from october and we are over the hump. This is a great sign. I thought it would happen with the earnings but the earnings in the last two weeks didnt report well. Apple, amazon, google. What really worries me is when i look across at europe, we have a real existential crisis going on in 2019 in europe between whats happening with brexit and in italy, theres a lot of tension they could do some serious damage to the eurozone. If that happens, that could put pressure on the u. S. Dollar up words which would be difficult for those u. S. Companies that generate a lot of their revenue overseas. And you also have china and the Banking Sector<\/a> looks like a massive house of cards. If we see a problem there, theres no way it doesnt affect the rest of the world. While the markets tend to like to see a government divided because not a whole lot of craziness goes on, if we have some really big problems that happen outside the u. I think the market is going to move forward. It doesnt matter what happens necessarily in europe. I think the market is fundamentally strong in the economy is strong. We need to keep moving in the right direction. We saw the current tax cuts in place. What would be bad for the market is if we dont resolve the issues with china trade war going on. If that drags on into 2019, i think it will be bad for the markets. Otherwise im bullish on the market and i think if the democrats try to impeach drum, that would be bad. Impeachment bad.
