Work rules. At issue, work rules, specifically overtime and schedule changes. Management at this time does not have control over its scheduled, overtime, how we divvy up work. What the job looks like, 10 or eighthour shifts. Reporter the unions say they were making progress on wages and benefits until these work ruled were dropped on them at the last minute. Bart says not true. These rules were in writing as of april 1. This Contract Negotiation is a package deal. You cant take the money and run. The unions right now want the money. They want the raises. But they want to abandon everything that bart wants to help provide a Better Service to our customers. Reporter bart contends work rules are worth tens of millions of dollars, a way to pay for the compensation package. Bart says the Transportation Department alone went 9 million over budget in overtime last year. Both sides say they will consider arbitration. But when . And how long will the public pay the price . Colleen mccann is a train operator on strike and without pay. She said theres no way managers can operate trains anytime soon safely. There was that talk and it was ridiculous because were trained for 15 weeks. Its very skilled. Reporter and while the unions have offered up a compromise to get trains rolling as early as 10 00, liz and ken, bart management has to release their side of it. They are going to have a News Conference at 6 30. But again, they have been saying, cant just divvy up certain areas. Contract for arbitration cant divvy up certain areas of the contract for arbitration. Its a full package and they have to agree to it in itstirety. Thats why that long line of cars stretching into downtown and really these drivers are kind of the lucky ones closer to the bay bridge and closer to getting home than most. Chopper 5 is up and out overlooks like its over the bay now over the water but we did see pictures earlier of northbound 101 packed from beyond silver avenue to the approach of the deck of the bay bridge. San francisco commuters who opted to take the boat instead have been experiencing long lines was we go to the video waiting in the lines at the ferry building. Even though the lines have been long, we have not heard of major problems for any of the ferry systems so they have been doing a great job of getting people where they need to go for this evening commute. We did hear from the San Francisco bay ferry that they more than ducked their usual passenger load on day 1 of the bart strike. Going back to the pictures of the gridlock situation in San Francisco where its taking folks up to two hours just to get through San Francisco on to the bridge. Bumper to bumper situation on embarcadero, beale, battery, first street, so many streets affected right now with this traffic. In fact, theres construction at first and mission thats making that commute much worse. The bay bridge toll plaza has been crowded all day long still slow into the macarthur maze and northbound 101. Leaving San Francisco is crowded through marin county approaching the Richmond San Rafael bridge turnoff with more heavy traffic leaving novato all the way into petaluma so by and large its been a slow frustrating commute. On the left side of your screen eastbound 92 bumpertobumper all the way across the san mateo bridge leaving hillsdale boulevard in san mateo approaching hayward. Thats a look at traffic. Many transit riders who usually take bart in the east bay instead lined up at ac transit bus stops in order to ease the commute crunch. Only buses, carpoolers and commercial trucks could use the west grand approach to the bay bridge. I just want to be able to get to work and others dont want to, then they shouldnt make it our problem. If there is a silver lining, at least these folks could catch ac transit. Earlier this week if you remember, ac transit workers threatened to strike. Governor brown stepped in and delayed that. Lots of riders who caught buses into San Francisco this morning are boarding buses at the temporary transbay terminal to head home right now. Some of them already vowing never to ride bart again. Im just kind of tired of this so i actually take the ac transit bus routinely because i have a personal boycott of bart. Barts last shuttle bus will leave from the transbay terminal at 7 p. M. Tonight. A lot of people lined up before dawn to snag a seat on one of those charter buses. Bart sent buses to this station in walnut creek and seven others in the east bay offering free rides to downtown San Francisco. But riders who didnt get on a bus by 8 a. M. Got left behind. I wanted to retire here and live out here to walk to bart and get on it. We are dependent. Bart says it will run buses all weekend. Heres what House Minority leader nancy pelosi had to say about the bart strike when we caught up with her today. I hope they can come back to the table to have a fairest losing of this thats good for the workers and good for management and is about safety and about respect for the workers, as well. Pelosi said she was planning to meet with labor leaders while she is in town. The strike is hitting businesses hard. Workers at fast food places and cafes told us there is were fewer people in the city working today. And that meant fewer customers. Business downstairs it looked like basically got cut in half. This accident happened near 15th and castro in San Francisco. The truck flipped over as you can see there blocking lanes. People are now taking everything out of that truck so it can be uprighted and towed away. A 2yearold boy was hit by a stray bullet that traveled about two blocks. He was playing at 92nd and sunny side in east oakland down the street from where some rival groups had a shootout. Witnesses told da lin what they saw at the scene. Reporter a scooter and a toy lying on the sidewalk. This was where the 2yearold boy was playing when gunfire broke out blocks away. A stray bullet hit the toddler in the upper body. Its a cowardly act. Some of these individuals have no concern for life period. They dont care who is around, who is watching. Reporter Police Say Two groups of people shot at each other near sunny side and 94th avenue around 1 00 this afternoon. A lot of people heard the shots. Some even witnessed the shootout. Just a bunch of cowards on the street. You know . And children are dying at the hands of just senselessness. Its just crazy. Reporter no motive and no descriptions of the suspects. Just a lot of shell casings left at the scene. Police had to come for neighbors traumatized by the shooting. Officers interviewed many of the 30 people on the bus and police also plan to check to see if any of the buss videocameras recorded what happened. At this point we are getting a lot of conflicting reports. So its too early to say exactly what happened for sure. But well continue to work with everybody involved to find out exactly what took place. This is the fourth time this year that a bicyclist has been struck and killed in the south of market area. Police are investigating a shooting on Treasure Island last night. One person was shot in the arm and was still on the scene when police arrived. While the other walked into San FranciscoGeneral Hospital for treatment. So far, no one has been arrested. A big rig flipped on its side blocking all lanes going north and southbound on highway 101 near woodside road in redwood city about 11 00 this morning. Traffic backed up for more than two hours. Reporter Arnold Schwarzenegger would need to change the constitution to be able to run for president. And he has two options. He can either petition the state or petition the house of representatives. I think the first thing to do would be to convince twothirds of both houses of congress to do it. That would probably be the easiest route in his case. Reporter constitutional law attorney Timothy Sandifer says changing the constitution will be a struggle. Because youre fiddling with americas fundamental law and so the Founding Fathers wanted to make it difficult but not impossible to change that law. Reporter and he says theres a gray area because the word citizens is debatable. The term natural born citizen is really not very well understood. There have been i dont believe there have been any cases defining that term. Reporter when the constitution was first written, the word citizen wasnt defined during the civil war. Even if the constitution is change, could he win . He had scandals from a love child with his housekeeper to a split from his wife and some question what kind of governor he was for our state. We have had a lot of difficulties when he was trying to run the state of california. And so i dont know how that would end up turning out for his run for president.
