Berkeley could be in for a radical makeover. We are getting a look tonight at some plans to renovate the bart station. Da lin says that is just the beginning. Da. Reporter ken, we standing on Center Street now the heart of berkeley. That growth will surround this bart station. Its the anchor for that growth. And thats why they are spending money to modernize this rotunda and this transportation hub. It looks very old. Not bad. I dont like the rotunda. I dont like it. Reporter this rotunda, like it or not, has served as the main entrance for the Downtown Berkeley bart station for almost half century. Now city leaders and bart are about to pump 10 million into the heart of berkeley transforming this hub into Something Like this. This is a city being reborn right here. Reporter matt nichols is the principal planner leading the revitalization of this transportation hub. He says more than 30,000 transit riders come through here every day. That number is going up. We have at least 1,000 new Housing Units in the pipeline right now. Reporter a few blocks away ucberkeley is expanding. A block away workers are building an art museum and across the street, Developers Plan to build a Highrise Hotel at the bank of america site. Developers tell me they pick these locations because of their proximity to bart. Because theres already so Much Development here, i think that Something Like this is paramount. Reporter this is just a preliminary design of the bart plaza. A glass structure instead of a rotunda. Transparency and coherence are the key goals. Reporter the open area to the left of the glass structure could be used for art performances and farmers markets. Most bart riders say they love the idea. I think opening it up spatially to the air would be beneficial to everyone. Im excited at what berkeley is doing. Its awesome. Reporter they will put in extra lighting to make the area safe and modernize the bus stops to the left of the rotunda. This project again about 10 million. Live at berkeley, im da lin, kpix 5. Berkeley city leaders want feedback from the public to finalize the design of that transit hub. Construction is supposed to start next year and finish in 2017. New tonight the outrage over 3yearold Kayleigh Slushers death includes the question, could something have been done to save the child . Were hoping to get more answers today from napa county child protective services. But as our Ann Notarangelo found out, those answers are difficult to come by. We have absolutely followed our protocol in all ways. We have made no errors in any of the work that we have done in the care. That being said, it does not negate the fact that a little girl died. We take that very seriously. Reporter napa countys Child Welfare director is defending her departments handling of the Kayleigh Slusher case. Child protective services went to court today to ask a judge for permission to release information about it. I think our community deserves to know exactly what we did or didnt do. Reporter the court refused the request until at least the autopsy is completed and its known if child abuse led to her death. Her mother Sarah Krueger and her boyfriend are charged with murder. Fingerpointing is directed at cps and Police Called to kayleighs house 14 times since 2012 most recently the day before she was believed to have died. Cps says cases involving marks and bruises are clearcut but it gets murky when there are allegations of Domestic Violence or drugs. It gets very complicated to be able to prove to the court that theres a compelling reason to remove that child. Reporter and she says unless theres an imminent threat to a child, the police are not obligated to report calls to cps. It would be a disservice to kayleigh if we didnt really delve as deeply as we possibly can and learn from this tragedy. Reporter perhaps in the end well discover it wasnt one agency or one person who failed kayleigh. That realization will make it all that more difficult to protect the next child. In napa, Ann Notarangelo, kpix 5. Cps plans to ask for the courts permission to release information on the case once the autopsy results are in. The drought is so bad now that fishing has now been banned on parts of two major Northern California rivers. The closures on the american and the Russian Rivers are through april. Our own don ford on the nearby businesses about to suffer. Reporter folks in guerneville say they havent seen the Russian River this low in nearly 40 years. Here, you can drive across the river without a bridge. With water this low, the California Department of fish and wildlife is worried about migrating salmon and steelhead. They announced starting in about 10 days, no more fishing on the Russian River for a while. So its been nothing but trying to figure out whats going to happen. Reporter king sport and tackle specializes in Russian River steelhead fishing for more than 60 years. It remains a place for serious fishermen to hang out. The manager says the closure will be bad. The business that we have which is primarily, you know, steelhead fishermen is going to basically turn off just like we dont have any water in the river, were pretty soon not going to have any business. Reporter this person makes part of his living as a guide. He says, sure, he is going to lose money but i think the river needs to be closed, although i dont want it to be closed. I think it needs to be closed. Reporter he says its important to protect his livelihood and closing can the river to fishing in the long run may do just that. The fishing moratorium isnt going to last forever. Its scheduled to be lifted by april 30th. Along the Russian River, don ford, kpix 5. Other rivers in california were closed earlier this month including san lorenzo river. We learned the identify of the person who died in a crash. 78yearold Isaak Berenzon. The man who hit his is charged with vehicular manslaughter. Ryan takeo on plans to improve safety on sunset boulevard. Ryan. Reporter hi, liz. Last night we told you how neighbors have been complaining about this crosswalk at yorba and sunset for years. Take a look right now it is a flashing yellow light. Today we learned that there is a plan in place to replace that with a traffic light. And it may not have come soon enough. The only reminder from yesterdays horrible scene was a bouquet of flowers. Police say 78yearold Isaak Berenzon was walking in the crosswalk at yorba and sunset yesterday when jenny ching hit him. The impact was so severe, he was left pinned to the cars windshield. Crashes are nothing new to sunset boulevard. Its part of the 6 of San Francisco city streets responsible for 60 of the citys pedestrian crashes. To find the trouble street, follow the crowds. Sunset is one area that we have identified needs more engineering. Reporter the sfmta says it installed three traffic lights on sunset in december. Its an evident to get drivers to slow down. A traffic light is supposed to be coming to the scene of yesterdays deadly crash next month. We wanted to know why its not there already. What took so long . Well, moving forward with a lot of these projects takes time and takes a lot of money. And in order to do that, we have to apply for grants, which we do for all these projects. Reporter the local leaders are trying other less expensive lower Tech Solutions too. There are six of these painted sidewalk extensions in midmarket. These rocks and plants are supposed to give pedestrians more room and lead to fewer crashes. Not only cheaper but faster to install. Its low tech, low maintenance but i was able to allow to us to expedite the process and provide and immediate safety mechanism. Reporter to give you a quick cost comparison, those six sidewalks extensions in midmarket, those cost a total of 15,000. One traffic light costs at least 3 million. For an interactive map to see the most dangerous San Francisco streets for pedestrians, you can go on our website, kpix. Com. Click on links and numbers. Live in San Francisco, im ryan takeo, kpix 5. This is the scene of yet another crash in San Francisco. Police say an suv driver struck a pedestrian near city hall earlier this morning and then took off. The victim is hospitalized in critical condition. Police are still looking for the driver. Other bay area headlines tonight, a stretch of Stevens Creek boulevard near i880 was closed nearly all day. This is live picture now of that scene. It was all because of a big rig carrying an oversized load. About 6 a. M. This morning the rig hit telephone lines and power pole and a traffic signal. A man first accused of stabbing a san jose state student to death had his murder charge dropped. Prosecutors plan to charge his twin brother. Juliette goodrich reports. Reporter well, ken, with this murder charge switched from one twin to the other, legal analysts say the prosecution has a challenge ahead. This is a prosecutors nightmare when it comes to trying to prove identity. Reporter 18yearold duc tong was charged with murder last week. But not for long. Now his twin, ahn tong faces the murder charge. And duc a lesser charge now in connection with the stabbing death of 22yearold richard phan, a San Jose University college student. How do you know its this guy and not this guy . Reporter this legal analyst, steven clark. A jury will look at this case with skepticism because the prosecutions theory shifted from one twin to the other. Reporter police say the twins were uninvited guests to a 21st Birthday Party for the victims girlfriend. A latenight fight spilled out on the street. The victim was trying to play peacemaker and was stabbed to death. I have never heard of any case like this in the United States where two identical twins are charged with the same homicide. Reporter clark says murder investigations at party scenes are difficult when witness accounts are clouded by alcohol. But in this case, its even harder with the suspects being identical. You have problems with dna because they have the same dna. And you also have significant problems with identification because people are going to say point at each one of these people but they have no facial distinction. Reporter so it will come down to clothing the twins were wearing. Witness accounts and possibly video that may have been taken at the scene of the crime may also aid the investigation. As for the victim, 22yearold richard phan, friends and family were at his service today. In san jose, juliette goodrich, kpix 5. Ahn tong will be back in court this week to be arraigned on the new murder charge. We have all her a lot about our water shortage lately and the drought emergency. But only on 5 wait until you hear what allen martin found out about who is stealing water. Reporter agriculture accounts for about 80 of the water used in california. That probably does not include marijuana farms. But it turns out at least one county is on the hunt for growers who illegally get their water for their illegal crops. To say Mendocino County has a pretty mellow tolerance when it comes to pot might seem like a huge understatement. But this year, there is no tolerance for pot growers who are stealing water. We are now becoming the water police. Reporter sheriff tom allman has a new mission. We know in the following year we are going to be seeing upwards of 5 million gallons of water per day being used for illegal marijuana, not medical illegal. Reporter and thats water Mendocino County simply doesnt have. Despite a slight drizzle at the end of january, the Mendocino County town of willits, which relies almost entirely on rainfall to fill its two reservoirs, is actually looking at running out of water in about 90 days. And while residents and businesses make sacrifice to conserve, the townsfolk know whats happening just outside city limits. People will just be taking water out of the shared out of a creek or other water source. So its having a really negative impact on our forest lands, on our streams. Reporter this is one of the concerns that the sheriff has, illegal marijuana growers tapping into these open irrigation canals like the ones here in potter valley. If you take your water tank at night and you fill it full of water by sucking it up, were going to arrest you for grand theft not petty theft. This is grand theft of natural resources. Reporter the sheriff says some growers actually drill illegal wells. Others tap into their neighbors water tanks and bury the pipe. And the most flagrant . They see it about 4 times a year. Somebody will take a pvc pipe and just in front of god and everyone just put it directly into one of the headwaters of our rivers here and pump water out of that and send it to a holding tank. Reporter i can hear people saying, oh, wait a minute, they are more concerned about water theft than they are about marijuana . Yes, i am. Yes, i am. This is a drought you know . We dont have a way to make the water come out of the sky. So what were doing is were focusing our energy and our resources towards the people who are misusing the water that we have. Reporter as far as getting a conviction, the sheriff says thats all part of the plan. Its very hard to find a jury thats going to convict somebody for growing marijuana. But if we go in front of the jury and say, well, they are growing marijuana but they were stealing water illegally diverting water causing environmental degradation and we know that thats going to have jury appeal, were going to get convictions. Reporter now, the sheriff says to be clear, this is about water. He says if someone were stealing the water to wash their clothes, they would go after them just as hard as someone stealing to to water their pot plants. He clearly is very passionate about the subject. Now, any indication of the public as passionate about it as he is . Reporter they have this online forum. Thats one thing. But the sheriff says up until a week ago they were just getting a couple calls a month about illegal water diversion. Since he made this a priority, that has shot up to 30 calls a day. Wow. All these pipes all around add up to a lot of water. Reporter nobody wants to see their water go. At least they are going to get rain up there this weekend. Hopefully. Speaking of which, paul deanno last time i checked was up on the roof with a big pair of spy glasses scouting out clouds and reporting back. Man, we could use this stuff. Reporter yeah, we could yeah could use an umbrella right now. Thats a whole nother story. Didnt pack the umbrella for the roofto shot. For eight or nine months, you didnt need an umbrella. You will tonight and tomorrow. You will on friday. You will over the weekend. You get the story. Lots of green already. The rain is early, round one is early. Kpix 5 hidef doppler let us take you to the south bay. You have seen the at least amount of rainfall of anyone where over the past several months but watch out sunnyvale, milpitas, los gatos, up 280, rain up to San Francisco, daly city, south city, san bruno and heavier rainfall over piedmont and oakland, vallejo, benicia, martinez, American Canyon all the way up into the beautiful napa valley. We are wet on a wednesday night. Its kind of funny, dennis said this yesterday, even the middle of adrought its going to rain in pebble beach for the tournament and it will. Tomorrow rain is likely. We may have some water issues when it comes to getting that tournament finished coming up over the weekend but well get to the weekend in a second. Two storms, one is here now. But it will really hit us mostly tomorrow. The bigger one is coming up over the weekend. Im going to focus on that because it will rain tonight and tomorrow. But the more significant storm is coming up over the weekend. Its tapping into the tropics. Hawaii is where the air and moisture is coming from. We will likely see in the north bay this weekend more than 3 inches of rainfall as the Pineapple Express will be putting a major dent into the drought that we have had over the past several months and actually past several years. Santa rosa tomorrow a soggy 53. Oa
