How much are they going to actually wind up getting to help him out for the rest of his life. There are three different parties here. They had sued the dodgers. They sued both of the defendants obviously that were in the case, and then also the dodgers actual owner frank mccord at the time. Frank mccourt was found to be not liable. The dodgers are on the hook for 25 , so they found the dodgers 25 liable and the defendants that actually pled guilty 75 liable. So when you break down that 25 , its actually a joint and several liability for what they actually owe. It kind of its split. So even though it looks like 4. 5 million because its joint and several, they get into paying about they could end up paying about 15 million. This is also open to appeals and whatever judgment down the line. These cases, because we deal with them as far as headlines, you get this, get that, but what happens down the line remains to be seen. What did this say about Major League Sports liability. Weve had these problems with fans in the stands at Football Games, baseball games around the country. What does this say about them . I think a lot of the teams and the professional sports teams are going to be looking at this verdict and theyre going to be paying careful attention to what the jury evaluated and how they found the team actually liable, and i know a lot of the owners were concerned and watching this as well. You know, oftentimes when you have a civil case you try and attach the deep pockets, right. You want to make sure that the people can the write the checks and you look for the areas where you have joint and several liability. So do you think Major League Baseball is going to change the way it handles its game days . Are we going to see more security . Its one things to have concerns, its another when someone hits you for millions of dollars. The jurors in this case actually said that they were aware that a security plan was in place, but it just fell through the cracks, so i think what youre going to see across the board is youre going to see a lot of teams and a lot of stadiums making sure that they have more than just a plan but the plan actually is effected with what fans experience when they come to a game. In San Francisco and in other areas we have sort of a rule. The teams are responsible for the security inside the facility and the parking lot and the police are sort of responsible for it outside. Correct. We should add people getting hit, getting arrested outside the stadium. Do you see a time when its possible people could start suing about that. I was beaten up after i left the game . Right, people can sue about anything they want to. In this case in particular, everyone though they had all of those things in place, the things that this jury found particularly relevant were a lack of lighting in the parking lot so that even when the attack took place security missed it because they couldnt see it. So areas like lighting are now relevant, and i think teams are going to be paying attention to issues like that in addition to the security that they have inside the game and around the stadiums. Lets get to a point here thats not spoken, but we only have about 30 seconds left, but what a lot of these attacks or these problems have in common is one thing, alcohol. The serving of alcohol at the games. Do you see a time when possibly somebody could be suing about that . That was a factor in this case. One of the things that came up was the alcohol sales and that it was through the roof, and because of the alcohol sales that the team should have known or should have expected that violence was going to be associated with and after a game. I dont know that youre necessarily going to see alcohol sales curtailed or curbed, but i think you will see a bolstering of security. Youll see things like better lighting. Youll see things more like a review of security plans where police are in place outside of these stadiums. On friday the Coliseum Authority meets again. The Oakland Raiders arent crazy about sharing the stadium anymore because they want to level the coliseum and build a new one. Mayor jean quan is pushing for an entirely new coliseum complex that would be more than a fancy new place for the two teams to play. You have sports venues, hotels retail, restaurants. Oakland would have to demolish the old coliseum in two years or so, and it would also have to pay off millions of dollars in bonds from the last remodeling when the raiders returned from l. A. Phil, youve got a lot of friends and contacts on these boards. What are you hearing behind the scenes . The negotiations are ongoing. It looks as though the Oakland City Council is poised to say okay were going to put aside our longterm plans and try to seal up this leak because if not Major League Baseball is given the green light for the as to look elsewhere. Theres a chance this could be resolved this week. Theres a chance it could be moved towards resolving. As far as resolving this whole issue its going to take a while. Weve got another issue that the clock is ticking on, and thats medical pot clubs in san jose. When are they going to start complying with the strict new city rules. The deadline is friday. Thats when the rules approved last month will go into effect. They require dispensaries to grow their own marijuana and limit the areas of the city where pot clubs can operate. Owners say as many as 70 pot clubs under these rules would be forced to shut down. With the citys regulations it would be virtually impossible to continue to operate, so what were doing is a referendum to change what the city is doing. If theres going to be a campaign, i will lead it. Ill form the committee, raise the money and organize the effort to make sure we protect our children and our schools and our neighborhoods. Club owners and their supporters say theyve collected enough signatures to get a referendum on the november ballot. The question is what happens between the rules coming into effect on friday and and them trying to actually pass changes to the rules. Thats going to be seen. Were going to take a look at that. Meanwhile another battle is working its way through the court. The battle of Public Access at a a san mateo county. Its the Surf Rider Foundation versus Property Owner who has closed down the path to martins beach. Public access to californias beaches is guaranteed by the state. The plaintiffs want the court to impose 20 million in penalties against the owners. He says by keeping the path open to the public hed incur costs and its unfair to him to foot the bill. Its interesting because the beach is public, but the path to the beach is private. Its on his property. So its an interesting dichotomy. What do you do about that . You take it to court. Spend a loft money a lot of money on lawyers. A state bill that would require the legislature to reopen the beach or that pathway is working its way through the state assembly. It was introduced by jerry hill. The bill has already been approved by the state senate. It would order the state Lands Commission to negotiate to purchase the private beach road. If no deal can be reached by 2016, state commission could seize that road under eminent domain. Will it be solved by the courts, will it be solved by the legislature. Well follow it. The influx of undocumented immigrants flooding across our border. Its an issue hitting home for many and striking a nerve for others. Since october 57,000 kids have fled to the u. S. President obama has asked for almost 4 billion to ease the problem of illegal immigration, but theres not a fast or an easy fix. There isnt, and joining us today is the president of the National Association of immigrant judges, dan lee, who marks youve been a judge for the past 17 years on this. Theres a lot of finger pointing. Some say this was the product of a law passed by former president bush. Others say its the result of a decree by president obama. Whats the story . Well, most experts in the field agree its neither. We believe that its a result of the circumstances in the countries which are causing these children to come, primarily honduras, guatemala, el salvador and to a much lesser degree mexico. Its based on the drug violence and gang activity. What is it about changes or u. S. Immigration law that made them think they could get in here and stay . Thats the idea. These kids are coming up here to stay. There is some information thats reliable that seems to say that the smugglers are exploiting people and telling them that they have a right to remain in the United States. But its simply not true. The 2012 law with president obama the policy that he signed at that point, allows children who have been in the United States since prior to 2007 to remain if they came here when they were under 16. Obviously it doesnt apply to new arrivals, and i believe the immigrant community is aware of that fact. So weve got 50,000 plus children now here. Whats going to happen . How do you get through the hearing process . Where do you house them . How long is this going to take . Whats the fate going to be decided . Are we even built to handle such an influx like this . Its a very thorny problem. One aspect is to make sure the children are safe. Many of them have been through horrific journeys to the United States. A second part and very independent from the first is whether or not theyre placed in immigration removal proceedings and required to leave the United States. Thats separate and different and thats the part that i and other Immigration Judges are involved in. Why wouldnt they be, if they came here illegally why wouldnt they be. Any person whos in the United States illegally has the right to apply for certain benefits under the immigration act if they can show theyre eligible. The one that most often would apply to these children is either asylum, showing theyve been persecuted in their home country on account of a basis that our law recognizes as worthy of protection, and the other would be if theyre reunited with family members or if they have been abandoned, neglected or abused under various state laws. How long would a case like this take for one child . The problem with the immigration courts is that we are so backlogged to begin with, my court docket is out five years now. Im setting cases that come before me in 2018 in the spring of 2018, and its taken those cases a year to get the first hearing before me. Those childrens cases are going to be added into that existing docket. Are we talking five, ten, how many years. Thats only if congress doesnt act. The administration has made it clear that they need Additional Resources and the Immigration Judges for years have been saying we need Additional Resources, that even if youre an adult in the system that thats too long for these cases to be pending. Theres only so many cases that a judge can hear in a given day. So the solution is to hire more Immigration Judges and hire more support staff. Thats going tyke time as well. Were talking years before this gets untangled. Probably so. The United Nations estimates that over 58 of these children are entitled to international protection, and we need to take a leadership role in america. This is what we stand for. Questions being raised about former state Assembly Speaker john perezs call for a recount in the state controller primary race. Perez will pay for a recount in heavy latino counties in an effort to make up the 481 votes that stand between him and betty ye. But its targeting the counties that voted for you and the presingle precincts fair. Thats when we sat down with Carla Marinucci and willie brown and said it is legal but is it fair. Were in the mid midst of a recount, under California Law john perez is allowed not only to pick what counties he wants recounted but what precincts he wants counted as long as he pays for it. Mayor brown is this a recount or is this just a way of rigging an election . He is playing within the framework of the rules, obviously from a pure voters observation standpoint its not a good idea. It always looks like youre not interested in a total recount. Youre only interested in that which they review and thats not good. This shows a real problem with California Law. 18 states and the district of columbia allow for automatic statewide recounts this is a first in modern california history, a statewide recount like this. Our state has no provision for automatic statewide recount. That means perez gets to pick where he wants the recount and, you know, it has to be paid for by either the Campaign Funds or another individual. So its not fair to both candidates. If he selects lets say Imperial County which voted for him and is heavily hispanic, from the looks of things he is picking counties that voted for him and precincts that are heavily hispanic. He can stop the recount at any point, once youre paying for it, you can top it at any point you deem appropriate. If it turns out to where he converts to where hes in the lead thats the point in which you call a halt to the recount if you have been the person paying. What does betty ye do then . She does nothing because she doesnt have any Campaign Funds left. The fact is, if the democrats want to keep this going and legal challenges are almost certain, they may be handing the republicans a chance to win this seat. But youve got to understand, we are at this stage of the game where carla, youre right, we really should have an automatic recount process if it gets below a certain percentage of differences between the candidates because theres always the possibility of some error in the multiplicity of counters and techniques by which these people report when they report. Therefore, betty ye should step up now before the recount really gets underway and insist upon a total recount of the entire state. John perez should join her. The problem is whos going to pay for it. That would cost millions of dollars. We havent had an election this close. I cant remember one that was this close. I was shocked when i found out what the rules were. I had no idea you could pay for the recount and basically control the rules of the recount. It makes you wonder how long could this drag on. Some democrats are already saying look if you dont find those votes quick, pull back. The flip side is if perez does find those votes people are going to say was that election legitimate or did you get to count until you won because the other person doesnt have the money. Thats the rule, so it will go on as long as he wants to pay for it. Is so will this debate.
