Prosecutors say 27yearold barry white was in the jewelry mart and got into an argument with the owner over the price of a gold chain. The prosecution and attorneys had said that he shot those two clerks, slitting one of their throats and critically wounding the owner but their viewpoints differed. The defense argued whites actions were the result of an untreated mental condition. A guilty verdict has been reached. More fallout for the city, Santa Clara County and the Water District after a half dozen residents file legal claims. Back in february more than 100 residents were forced from their homes when coyote creek spilled from its banks, causing many people to get trapped. Our south bay reporter jesse gary with more on the legal action and reaction to it. Reporter good afternoon. This is not a lawsuit but the initial steps taken before a suit is filed. Proponents and their advocates say the governmental agencies including the Water District knew of the flooding dangers and failed to take the appropriate steps to protect people and property. They need to take the steps to be sure this doesnt happen again but they also need to address the claims and take them seriously. Reporter flanked by Haunting Images of flooding victims gathered to put city, county, and Water District officials on notice. The first step before firing a barrage of legal action is being taken with the damage claims. I think this was preventible. Weve seen a lot of evidence that it was. We need to hold the district and the city to account. Reporter a late february downpour became a fight for survival for over 500 south bay households. Days of heavy rain and a release of water from Anderson Reservoir sent thousands of gallons into coyote creek. The result, water swallowed three neighborhoods. With us paying our taxes to prevent floods and the city not having a Warning System in place, hopefully that will change. Hopefully this will bring change. Reporter claimants want restitution for the loss of property. The attorney sees a structured negotiation as one option. The chairman for the district e mailed a response saying, quote, our hearts go out to everyone who sim pact, and the district will give each claim due consideration. The county and city both responded similarly. The city received the claims yesterday, and our Attorneys Office is going to review those, and thats all we can really say at this point. Reporter she and others gathered here hope reason will trump legal strategy, allowing those most impacted to take the next step forward to being made whole. Hopefully we will get some closure that they are on top of the problems rather than kicking them down the road. Reporter there are two more informational meetings scheduled this month for folks interested in filing a claim. One on the 15th, the other on the 22nd. The Company Plans to donate 100 through rebuilding together silicon valley. The money will go towards Building Supplies and helping people affected by the flooding last february. The executive director says the donation from google will be a big help. We have been working since the floods and theres a lot of work still yet to be done for these homes to be safe and healthy. Google is investing in the community and seeing the impact that we do to ensure that all of our residents have safe and healthy homes. Rebuilding together has been making critical repairs for months especially in one mobile home park. The organization usually works on 360 homes a year but this year that number has skyrocketed. Right now crews are at the scene of a grass fire in south livermore. The fire was reported shortly before 2 00 near the intersection of east vineyard avenue and vallecitos road. There are no reports of injuries. Crews were able to keep the flames from spreading to nearby homes. Lets check in now with chief meteorologist bill martin talking about the hot weather. For us, along the coast that fog is going to sit at the coast and be very patchy and very shallow. With a shallow marine layer, that means the fog is not going to get very far inland. Instead of a courtroom, it all took place at a hospital. Crime reporter henry lee joins us now. Henry, the defendant was arraigned from his hospital bed . Reporter yeah, its relatively rare, but because the defendant was hurt in the crash, the judge and the court came to him. From his bed, wilson was formally notified of the charges. Two counts of murder, hitand run, and dui. A judge, prosecutor, defense attorney and bailiff came from Contra Costa County for the unusual hearing. Ktvu spoke to the prosecutor after the hearing where cameras were not allowed. It went fine. Pretty routine. It was a hospital arraignment. The arraignment was put over for two weeks. No plea was entered. Reporter wilson is accused of fleeing the scene after he crashed his car with a woman and two children inside. The two children were killed. Its very apparent you can only begin to imagine how terrible the loss is from both sides. This is just a horrible thing. Reporter the chp, which investigated the case, says wilson has three dui convictions and was drunk and driving on a suspended license at the time of the deadly crash. That factored into the decision to charge him with murder and not vehicular manslaughter. When somebody intentionally commits an act which they know is inherently dangerous and they do that act and somebody dies, its called implied malice. Reporter the boys mother, who was hurt along with her son, says she hopes wilson will be prosecuted to the fullest extent of the law. The San FranciscoPolice Commission has approved a new updated policy on the citys sanctuary city laws. The update clarifies that San Francisco police are not allowed to ask about a persons immigration status. It also bans police from cooperating with federal immigration authorities except where state or federal law requires it. The revised policy follows last weeks decision by the board of supervisors to approve a 190,000 lawsuit settlement filed by an undocumented immigrant who was turned over to officials in 2015 after he reported that his car had been stolen. Meantime the stage is set for a showdown between the Justice Department and sanctuary cities. Attorney general Jeff Sessions had given 10 state and local jurisdictions until the end of last month to prove that they share information with federal immigration officials or risk losing some department of justice grant money. Joining me now to talk more is david levine, professor at u. C. Hastings college of law. What do we make of this, this proof that attorney general Jeff Sessions is asking for . Well, some of it might be kind of proving the negative. Some of it might be clear because if there are written policies which prohibit the communication of information as required under federal immigration law, then a city or state might be out of compliance. But otherwise, if the words of the ordinances seem to be in compliance, then just because some lowlevel person perhaps didnt make a phone call they might have made, that doesnt mean that a jurisdiction would be out of compliance. Lets talk about the sort of crux of all this and the 1373. Spline what that requires. This is a federal statute. What it says is that you are not allowed to have a prohibition against communicating with federal officials. So that as long as a city or a state does not make that prohibition theres very little that the federal government can actually do. To some degree we are seeing a lot of storm and not real nothing real. So, for example, when the litigation took place in march with San Francisco, San Francisco said, look, the executive order the president signed might put us at risk for more than a bels of our budget, but when all is said and done after the judge issued an order clarifying, it was only a million dollars. So there might be much less at stake here than we might think from all the headlines. So ken just read a story about what San Francisco is now ordering its police not to do. If you are attorney general Jeff Sessions and are looking at that, are you saying, oh, they dont comply . What the law talks about is communication between say a local jurisdiction like San Francisco and the federal authorities at homeland security, at i. C. E. So just because the police dont ask for a piece of information, that means they dont have a piece of information to give to the federal authorities. That really the way that cities and other states are going to sort of work around that, do you think . That is probably some of it, because at least as written now now, it might change because the house passed a piece of very different legislation last week, but right now the piece of legislation, this one statute, is a very low bar for cities to clear so they can proclaim that theyre sanctuary cities on the one hand, and on the other hand they can quite truthfully send in the certifications saying, oh, were in complete compliance because the statute requires so little of the jurisdictions. Final question. As the Justice Department is reviewing the statements by these jurisdictions what do you anticipate them doing once they review the documentation and what could the potential outcome be . Well, the potential outcome is that these jurisdictions might not be eligible, then, for a very small number of grants. The whole issue is that you can make incentives to have jurisdictions take a grant, but the strings have to be clear upfront. What are the requirements . So that what might possibly happen is that in the future some jurisdiction might not be a able to continue to take a particular grant. But the grants that are at issue are so small, it hardly matters. So to take San Francisco as an example, San Francisco sued in federal court because they were afraid of losing 12 of their budget, more than a billion dollars. But the actual amount of money at stake was only a million dollars. Thats hardly anything. Professor, thanks as always. We are continuing to follow breaking news.
