President obama announcing his nominee for the Supreme Court. Yeah, the president selected judge merrick garland, who currently serves on the u. S. District court of appeals for columbia. Reporter there are at least three candidates considered for this position in the beginning. Sri srinivasan, an Appeals Court judge in d. C. Paul watford, an Appeals Court judge here in San Francisco. The president chose a judge born and raise inside his hometown of chicago, merrick garland. He says he is an exemplary judge. He oversaw the federal governments response to the deadly bombing in Oklahoma City in 1995 and extensive experience as a law clerk and prosecutor. During that ceremony, the president talked about guards background, which included being raised in chicago and working his way through Harvard Law School by jokingly saying he had to give up his comic book collection. Garland gave praise to his family and special his father for instilling in him the drive to get where he is right now. He got emotional in his comments this morning. My father, who ran the smallest of Small Businesses from a room in our basement, took me with him as he made the rounds to his customers, always impressing upon me the importance of hard work and fair dealing. These qualities and his long commitment to Public Service have earned him the respect and admiration of leaders from both sides of the aisle. He will ultimately bring that same character it bear on the Supreme Court. An institution in which he is uniquely prepared to serve immediately. The president says the selection of a Supreme Court justice should be above politics, but republicans at least appear to be holding firm. Senator Mitch Mcconnell is speaking on the senate floor right now saying the gop will give the people a voice for court vacancy. In the meantime, pat roberts, who first confirmed garland in 1997, says he is opposed now. He tells the ap its not about the nominee, but about the process. Back to you guys. Thank you. Then the reporter asked him, do you know him . He said no. Is the judge going to get a hearing . I dont think so. Merrick garland is well known in legal communities. He is seen as a brilliant mind that both sides really like. Mitch mcconnell said he will not get a hearing. This is about the process to them. Not about the person. As president obama said, this is really probably the best situation that could happen right now. He is a progressive moderate. This is really a master stroke by the president. Its hard for republicans not to give him the hearing and not to vote him in because he is liked on the republican side. And the president wants to keep the politics out of this. And he is actually throwing them a bone in many ways. He is 63 years old. He wont be on the court that long. Do republicans want to risk Hillary Clinton winning the white house and putting someone in their late 40 or early 50s who is far more liberal . Do you see this as the president daring republicans to reject a man who republican senator oren hatch last week named as a good replacement for scalia . Well, the president talked about not injecting politics in it. But he made a pick. 63 years old. One of the oldest candidates to be put forth. Nominees. Its a situation he is saying to the republicans go ahead. Say no. So what the republicans are saying essentially is they perhaps want donald trump to pick the next nominee . Its look like he is going to be the nominee. You know, if he becomes president , they are more comfortable with his choice than this choice . Apparently. You know, at the end of the day they have said for quite some time they are not going to interview anybody. This is an off the table kind of discussion here. All this talk about the process. There is ten months left in this administration. I mean, clearly, during the entire obama presidency, republicans have obstructed, obstructed, obstructed. Its not going toed to end here. He has done his duty. He is asking the senate to dozen theirs. Even if he does not get the nomination, this could have big consequences for the senate races. There is one other point ill make. It is also true that mcconnell, Mitch Mcconnell, and chuck grassley, both voted against this guy in 1997. They have a record of saying no to garland, i want to ask, is Hillary Clinton basically unstoppable right now . Well, you know, when you look at the numbers, it seems impossible that Hillary Clinton does not get the nomination. But it is not a done deal yet. You know, there is a lot of talk over the super delegates. If she didnt have the super delegates right now, she wouldnt be that far ahead. When you look at the numbers closely, she is 300 points ahead even without the super delegates. So it really looks like Hillary Clinton is closer than ever to getting the nomination and you see that in her own confidence and she is pivoting towards a general election. You see the big smile on her face. A huge win last night. Yes. Brian, donald trump. More than a Million People voted for him in florida. Yes. He won that state resoundingly. How can a party and im not speaking about trump per se. But anyone who has won so many states and its mid march be denied the nomination . Mathematically, he may be denied the nomination. He cant get to the number. The question, i think, underlies that whole discussion is if he is close, should not the republicans say, hey, you won everything, we are going to nominate you and make it happen. But because the Republican Party is so divided, it opens up the question of whether they try to move around him in what is known as a brokered or open convention. Its clearly john kasichs strategy. He really has no path numerically other than to wait for the convention and hope that its a contested convention. That seems like a bad move for republicans because donald trump so unpredictable and volatile. If he does not get the nomination at the convention, you can imagine he will run as an independent. Kasich said with his win in ohio last night, this would set the tone for a different, you know, campaign here on out. Well, his complaint all along well well, his complaint all along is he is not getting questions in the debates. Thats true. He is not getting enough media attention. He thinks that is going to change starting today. I dont see it changing even this morning on the morning news cycle. No one is really talking about john kasich. Speaking of debates and questions. The man who has been, if you will, hogging much of the debate stage, time and sound, donald trump saying just this morning he is not going to participate not only is he not he didnt know there was another debate schedule the. I will ask you real quick. Brian, smart for donald trump to say forget this next debate . I think there has been enough. Does he need to stay in it . It will be interested to see if he decides at the last minute to miss the debate. He may be just talking. On the other hand, after 12 debates, i think people are a little tired of the whole show. Thats what he said this morning. He said he had a speech, you know, scheduled before he found out about this. It is true that this debate was added at the last moment. Phoenix is going to be hosting the debate. I was at the fox debate in des moines when donald trump didnt show up and that was a bad move on his part. If he doesnt show up on monday, i think its again another bad move because ted cruz is a very smart man. He is going to take full advantage of this. And john kasich, this is more of an opening for him as well. It seems as if trump and Hillary Clinton are beginning to act like they are the nominees now. They are talking about the general election already. Are they too far ahead . I dont believe they are. You are going to see the attacks start shifting towards each other. Everyone last night was attacking donald trump, for instance. I think thats where its going right now. You know, donald trump, he had a huge win last night. We started to see some of the chinks in the armor. You know, in florida in particular you saw that he did not get much of the hispanic vote. So it really is turning out that Hillary Clinton has all the minority votes in her races. Donald trump has the socalled angry white voters. And across the country he cannot win in a general election with just that. He has to start reaching out to minority groups. Hillary clinton has that part locked up. So its interesting that its shifting to the general and its interesting we are starting to see whats happening with the electorate across the country. Real quick, marco rubio is back. Does he come back in 4 years . He is a young guy. Hell come back. I will make a final point on hillary. I think she has got a different situation than donald trump. She is going to be the nominee. And Bernie Sanders will now be the conscience of the democratic party. Donald trump still has to take care of a big problem. How do i get nominated . You know, let me take a quick point about marco rubio because i covered him in florida for five years. Really quick. Really quick. You know, he had problems long before this in florida. A year in his senate see he was having problems with lying about his past, how his family came to america. When they came. It turns out they came before castro took power. Florida knows that. Thats why he was defeated so soundly in florida. Across the country if people got know marco rubio more, he wouldnt have done as well as he did. Does he come back . I doubt it actually. Here are some of the top stories. Police in berkeley searching for a shooter who shot and critically injured man and woman in a car early this morning. It happened mere the ashby bart station. Investigators still in that neighborhood collecting evidence. But already they think the victims were targeted. But we dont know why. They are also trying to identify that shooter. Police are not releasing any other information about the victims. The chp is also investigating another shooting on interstate 80. It happened last night in pinole near appian way about 5 15. A woman was driving on the freeway. Someone drove up next to her, pointed a gun at her, and fired several rounds. Luckily, no one was hurt. This is just the latest in the string of freeway shootings on interstate 880. There have been eight similar incidents since november. Two were deadly. Police in richmond believe its part of a gang war. We are learning more about Sexual Harassment allegations against a cal assistant basketball coach who was fired this week. Uc berkeley says an internal investigation revealed he violated harassment policies. Reports say he admitted he tried to lure a female reporter up to his apartment for sex. She told investigators he repeatedly sent Text Messages with sexual comments, and when she turned him down he blocked her from getting information she needed to do her job. Now ktvu has learned that that department wants to fire a sergeant linked to both of them. The first incident was a fatal officerinvolved shooting over a fake gun. That was last fall. Then just weeks later the second incident started with an off duty drinking episode at a bar and ended with a woman in the Oakland Hills saying she was assaulted by what she thought was a home invader but turned out to be an officer. Henry lee has been on the story and has more details. Reporter four Oakland Police officers shot and killed Richard Perkins on november 15 after he allegedly pointed a fake gun at him in east oakland. And pull out a replica pistol from their waistband and pointed it in the general direction of the officers. Reporter among the officers was Sergeant Joseph turner, a seven year veteran seen in an earlier interview with ktvu. Three weeks after the shooting sources say a group of offduty officers was drinking at a bar. They decided to go to sergeant turners house. One of them apparently got left behind and got lost on the way there. He ended up on the wrong street and while allegedly drunk showed up at a womans home, jumped on and attacked her and demanded entry, the woman says. She is an Alameda County probation officer. I told my kids to go back inside, and they were crying and they were really afraid. Reporter the officer was arrested on suspicion of assault and public intoxication but no charges were filed. Sources tell us the two face termination. A year before turner and other officers shot and killed perkins, turner wrote a letter in response to Police Shooting protests. Wrote, as an officer and a sergeant who supervises officers, i am concerned with the level of vitreol towards police officers. However, as a person of mixed race and citizen of oakland as well as being employed by the city, i am concerned about how our department can engage more effectively with all of our citizens and deliver our services in a way that is not only fair, but also effective. Perkins family and supporters says perkins was trying show the officers that he had a fake gun and never pointed it at them they are angry at police for showing an edited video of the aftermath. I told Perkins Family about the same sergeant being involved in both incidents, now facing termination. They trying to cover up. Thats why he was drinking. They was somewhere drinking.
