A family from san bruno is demanding answers tonight after the young child was badly injured when a massive tree branch snapped over the weekend at Menlo College on the peninsula. We have new information tonight from ktvus azenith smith. You talked to the little girls family. Shes back home recovering with a fractured skull. Doctors say it should take weeks to heal and she should recover on her own. I wanted to show you this campus, covered with these large oak trees. They have no idea one of the branches would come crashing down. Reporter 2yearold zealyn is resting in her fathers arms on pain killers and antibiotics after part of a large tree branch collapsed on her and her mother, jasmine garcia. I could see it on top of me, just like the limbs and everything crashing on top of us. I was shocked. I didnt know what to do. I didnt know the tree was going to fall. It just happened so fast. Reporter it happened saturday afternoon. The family was at jasmines Company Picnic at Menlo College. This is video of zealyn with the mini mouse balloon. The two went to throw away trash, when out of nowhere jasmine heard an unusual sound. Almost sounded like a house or something was like collapsing. I never really heard it sound like that before. I wasnt sure really what was going on. Reporter it turns out a branch from this heritage oak tree snapped. The branch estimated to be 50 feet long, 3 feet wide. Zealyn was discovered covered in blood, gashes and lacerations on her eyelids. I was hysterical. I didnt know if she was even alive. Reporter jasmine suffered a broken toe. The two were rushed to stanford hospital, zealyn undergoing surgery. She has a fracture from the top of her forehead down to the orbital. Thats the cause of the bruising around the eye. Reporter zealyns father chris was 50 feet away. He witnessed both of them getting hit and falling. He says the branches came down like a huge blanket. I thought she was going to be blind. It was pretty scary. I was terrified. I was terrified. I didnt know what to expect. Reporter the family is calling for an investigation, wanting answers about the trees maintenance, its age, when it was last inspected, and if the tree was diseased. Attempts to contact Menlo College were not returned. Caution tape now surrounds the tree. The Fallen Branch has since been cut up. Meantime, the familys focus is on zealyn and jasmines recovery, aware the outcome could have been different. You never know. It could have ended up worse. I could have been sitting here by myself. The family tells me a lot of people, a lot of children were underneath that tree an hour prior, and according to jasmine, two other people were injured. One person had to get stitches. Another person had minor scrapes. Just a very traumatic experience. Oh, my gosh. Its amazing that shes still alive and hearing the mom there say i was hysterical, i wasnt sure if she was going to survive. Just really something. And you heard the dad saying he thought she was going to be blind. And hearing the two parents talk about their daughter, its just heartbreaking. At least shes going to be okay. Azenith smith reporting live for us tonight. Thank you. Now to San Francisco where police have made two arrests in the deadly shooting and robbery of a 71yearold photographer at twin peaks. This is the mugshot for 19yearold lamonte mims. He and 20yearold fantasy decuir were booked this morning on charges of murder, robbery, and using a gun. Police say they killed Edward French and robbed him of his camera on the morning of july 16th as he was taking photos of the sunrise. Just days before the twin peaks killing, mims was arrested for possession of a firearm by a felon, making the victims family and friends wonder why mims was ever released from jail. He was arrested on the 7th and he was released just four days later. It makes you question the judicial system when you have a convicted felon in possession of a firearm thats released on his own recognizance and commits such a heinous crime five days later. Mims and decuir also accused of robbing a pair of tourists near st. Marys cathedral july 28th. Residents are fighting to regain control of their private street after the city and county sold it to the highest bidder in an online auction. Presidio terrace is near the golf club. Jana katsuyama is in the neighborhood tonight where homeowners met. Thats right. They met inside one of the houses here in this neighborhood. They wanted to decide what to do next. The city says that by law they were required to sell this street because the Homeowners Association had failed to pay property taxes on this private road. Reporter beautiful multimilliondollar mansions line Presidio Terrace, the private community whose past residents have included Dianne Feinstein and nancy pelosi. The sidewalks and green common areas belong to two new owners who bought them for 90,000 in a public auction. The San Francisco treasurer spokeswoman says thats because the private street was considered a separate parcel and the presidio Homeowners Association failed to pay the property taxes. What the state says is if you fail to pay your property taxes for five or more years you get placed in something called power to sell. Reporter that power to sell was recorded in 2003, and the treasurers record show a notice of sale was sent out in february 2015 with a total of 994 owed in unpaid taxes and penalties. When we get ready to auction, we have to send certified notices to the address of record and publish a list in the newspaper and send the list to the board of supervisors for their approval. Reporter the notice was sent to the Presidio Terrace association at an address of 47 kearney street on the 6th floor of a high rise in San Franciscos financial district. An attorney for the homeowners, scott emblidge, said the homeowners didnt even learn about the auction until this past may, long after the sale. He met with the homeowners monday night, and before the meeting told ktvu the best they can tell is the address belonged to an accountant who might have done work for the Association Decades before. The Treasurers Office says every Property Owner has to keep their record with the city up to date. Their address of record. Reporter the new Property Owners who won the Presidio Terrace auction are two real estate investors. Lam and her husband, michael chang, who say they were surprised to see the exclusive street up for sale. Im a first generation immigrant. So i just want to feel like i have a place in the city of San Francisco. So i dont really have any plans to make money i just want to hold on to it. The Homeowners Association says a title agent for the new owners approached them about buying back the street. Now the association has sued those two new owners and the city and theyre asking the board of supervisors to rescind the sale completely. New at 10 00, police have named a suspect in a deadly shooting over the weekend in belmont. Police are looking for 27yearold Javon Alexander stewart. Investigators say stewart might have changed his hair style to short dreadlocks since this photo was taken. He should be considered armed and dangerous. The shooting happened Early Saturday Morning at an apartment on ralston avenue. Jones of union city died at the scene. Anyone with information is asked to call police. The fbi is offering a 3,000 reward to track down a bank robber theyre calling the smiling face bandit. Today the agency released surveillance pictures of the man whos robbed six wells fargo banks in less than three months. The first was south market on may 20th. The most recent was saturday on irving street in sunset. The robber is described as white, between 56 and 58 tall. They say he sometimes wears a wig or hair piece along with dark sunglasses and a baseball cap. They say each time he handed a teller a note, demanding cash and in some cases claimed to be armed. Police say this man, 42yearold Mario Christopher washington of berkeley, was arrested and is accused of attacking two passengers in the Transit System for no reason. Washington was arrested nearly three hours after b. A. R. T. Police released surveillance pictures of him during a News Conference monday morning. Police say an oakland fire inspector spotted washington near 9th and broadway in downtown and contacted b. A. R. T. Police. As our officers were responding to the area, the same oakland fire investigator saw one of our patrol sergeants in the area and flagged him down. The first happened last thursday night when Police Say Washington hit a man with boat cutters in san leandro, also punching and kicking the victim before leaving train. What a difference a week makes. Last monday we told you about a school on the verge of eliminating its varsity football program. Now theres enough to field a team. Debora villalon is live where the Community Gets the credit for this win. A week ago some unpopular calls, the head coach quit, then the school said no more varsity football. Thats when supporters went up against the clock. Reporter with their first games just weeks away, novato high finally has a varsity team. Everything runs away from you, you stay still. Reporter and a new coach brought up from the frosh soph team. Theyre recognizing we have a lot of work ahead of us. Reporter this was the day to put up or dont play, a deadline from School Administrators who said too few athletes were coming to practice. You have to sometimes set a goal. And our goal was 20 to 25 juniors and seniors and our Parent Community came through. We were not going to let them pull the plug. Reporter credit in particular, some determined moms. Theyre working hard. Theyre all here happy, excited. This is a huge hurdle. Reporter they spread the word and rallied opposition when the abrupt decision was made to dissolve the team. And they plan to keep these tshirts handy. Some feel a lack of trust in the process. At a recent football meeting, no one was allowed to speak. Really . This is a meeting with the parents and the players and the coaches. Why cant we talk . Why cant we talk . This happened because of parents and kids, not because of administration. Were still feeling a lack of support. In the end, you have a team. Thats the most important thing. And theyre acting on what they had at the time. But notes its suffering a downturn as parents worry about concussion and long term effects of head injury. Id say its the nfl. Watch an nfl game. Youre a mom, your kid wants to play football. Do you want your kid playing that way . The nfl glorifies a lot of things that shouldnt be glorified. Reporter on the field, the boys only know they have some catching up to do. Reporter but at least they can concentrate on the game. Not stressful anymore. We can finally go and play as a team and not worry about if we have numbers. So it feels really good. Reporter and no matter their winloss record, their new coach promises to make this a good year. Really try to rebuild a program from the bottom up. Give these guys a chance to put their mark on novato high school. Were the team that almost wasnt but now were here to rebuild a positive culture. This was a Powerhouse Program not so long ago. And with younger players coming up, if the coaching remains stable, it could dominate again. But many teenagers who might have chosen football in the past are going out for lacrosse and soccer and those sports are more popular than ever. But you can tell the community really stepped up there and i was wondering, these sophomores and juniors, do some of them not even have experience but wanted to join to keep this team alive . Some of the players who showed up today havent played football before but they do fit the age requirement to play varsity. So theyre going to get their first taste of it this season. The city of portland, oregon has named a veteran officer from oakland as their new police chief. 41yearold deputy chief danielle outlaw has been with opd for 19 years. She rose through the ranks starting as a Police Explorer when she was a student at holy names high school. The mayor of portland says outlaw will help their police force improve their diversity and relations with the community. Outlaw will be introduced as the new chief in portland this thursday. Ktvu has learned the city of oakland plans to start interviewing candidates tomorrow morning for oaklands new Citizen Police commission. A panel chose 28 applicants to interview from 144 people who applied. The ninemember board will have unprecedented power including the ability to fire the police chief, subpoena police personnel, and take part in disciplining officers for misconduct. Applicants include local attorneys, community activists, and faith based leaders. The u. S. And its allies are hitting north korea with new economic sanctions over its Ballistic Missile test.
