Outside parliament there, including teachers and school children, many of them waving flags, big smiles on their faces. King charles himself seemed to be in a better mood today. Put its also a very busy day in politics. Dramatic developments into multiple Government Investigations involving former president trump. Judge cannon refused to let the probe of those classified documents go forward until a Special Master looks through them. A job that could take ten weeks. At same time, were getting our first look at the scope of the governments massive investigation into january 6. Dozens of new subpoenas covering communications and documents on everything from fundraising for the January 6th Rally to alternate elector schemes in six states. I want to bring in justice and intelligence correspondent ken dilanian. Joyce vance is a former attorney and an msnbc legal analyst. Sam stein is our white house editor and nbc news contributor. Ken, lets start with i want to put on the screen some of the topics of the subpoenas, as laid out by the washington post. Along with the kmoun indications about alternate electors, they want any communication with anyone in the doj, anything related to election certification, fraud or fraud claims, any information they got challenging fraud claims, anything sent to officials regarding fraud or the election, anything related to the save america pac or sent to the January 6th Committee and they are asking for all of this from dozens of people. What is going on . Just to be clear, these are the same subpoenas that nbc news told you about a few days ago first reported by the washington post. As many as 30 subpoenas out to various people in trump world. What the post has done here is gotten some more details about whats in the subpoenas and the vast array of documents and Commuications Records that they are seeking. We were told by bernard carr risks lawyer this was one of the broadest subpoenas he had ever seen. Now we see the evidence of what hes talking about. There seems to be three distinct areas they are looking at. They are looking at the rally leading up to january 6th. They are looking at the false elector scheme, ander they are looking at fundraising by the save america pac and whether there was fraud in fundraising around allegations that the election was stolen. So those subpoenas went out on the edge of the 60day quiet period where we dont expect the doj to take public action around an election. So what they have done here is they have put out requests for a ton of documents that they will now get to chew on for the next two months. Ken mentioned the attorney for bernie, who received one of the subpoenas, who said, the widest and most obtuse subpoena i have seen in my years practicing criminal law and a scatter shot for anything related to donald trump. Im wondering if it seems overly broad to you or is this the norm when you have an investigation this big . Thats his assessment. He certainly might have an ax to grind with regards to the investigation having received a subpoena. The reality here is this is an extra ordinarily complex situation. Doj is investigating at least one, possibly more than one potential conspiracy that span a period of many months that have a lot of moving parts, but all of them have is their object. The prosecution of the former president s big lie about fraud and the election. That to say, i think these subpoenas seem appropriate. They ask for evidence that these people have. They are trying to avoid a situation where one of these people who receives a subpoena could say, well, the subpoena wasnt broad enough to reach certain information, so i didnt provide it to you. Doj wants to get it all at once. It knows it will have a fight on uts hands some of the witnesses may try to duck the subpoenas. Some of them will tla their compliance. So i suspect doj will spend months gathering this evidence and a few more months trying to look through it. So then you have the florida judge refusing the dojs request to restart their investigation into the documents seized at maralago. What were the grounds for refusal and where does it go from here . It was not just that she handed a defeat to the Justice Department. Its that this judge baseically told the Justice Department that she cannot rely on their assurances on some very basic things in a criminal investigation about documents gathered pursuant to a lawful warrant. She could not rely on their assurance that they were classified nor that they werent subject to privilege. Led me read to you. The court does not find it appropriate to accept the conclusions on these important and disputed issues without further review by a neutral third party. So thats why shes imposing the Special Master. She wants that master to review all the 11,000 documents seized, including the 100 classified documents she rejected the dojs request that she temporarily stayed part of the of the order and immediately allowed them to use them in the criminal investigation. They told her this was a matter of National Security. The United States was suffering irreparable harm. She rejected that. You havent even shown me these documents got to the wrong place. Thats exactly what the doy is investigating. Its really a remarkable thing for a judge to do. Its one thing to be skeptical about the governments claims. Its another thing to essentially suggest that they are not on the level. The fbi agents filling out sworn statements. The National Security division of Justice Department. If thats what shes done, we are expecting an appeal. Joyce, i saw your tweet on this. You called it a terrible ruling. Why . It is a terrible ruling for the rule of law and for americans confidence in the integrity of the courts and of the Justice Department. Perhaps this is a little bit in the legal weeds. I think ken does a great job of explaining it. But judges are supposed to make decisions based on the facts and the evidence thats put in front of them. Theres no evidence here that suggests that doj is representing classiication of documents in an improper way. No evidence that suggests that there are any problems at all. They were seized pursuant to a lawful subpoena. But the judge simpy rejects dojs representation that documents that are clearly stamped and marked with classification markings have, in fact, been classified by the government. Its a little bit mind bogglingly difficult to have to explain how this could ever will the case. Anyone who worked in government, who handled classified materials, will had tell you that they are presumptively classified if they carry that marking. This judge has no evidentiary basis, no reason that she articulates for rejecting dojs representations. She just says i dont trust you, and i need a neutral third party to advise me. I suppose thats the final irony here. Because she actually is the neutral third party. The federal judge appointed, received tenure to ebb sure her decisions are objective. Shes supposed to make these decisions. Why were undergoing a delay of a magistrate judge a z a mystery. We also heard from donald trump. He was talking about what would happen if he was indicted. Take a listen. I think if it happened, i think youd have problems in this country, the likes of which perhaps we have never seen before. I dont think the people of of the United States would stand for it. What kind of problems . I think youd have big problems. I just dont think theyd stand for it. They will not sit still and stand for this ultimate of hoaxes. He also said that being indicted wouldnt stop him from running for president. Whats your take away from all that . On the wasnt hand one hand, hes giving a Permission Structure to riot. Thats what he was talking about. Others have said it. On the other hand, its evident to me from our reporting that he believes and knows that hes under siege politically. This is not an opportunistic place to be. His poll numbers have improved in the context of a republican primary. Yes, hes fundraising very well off the fact that the fbi seized material from his maralago home. If youre donald trump having not just this records probe over your head, but the January 6th Probe and then probes in New York State involving your business, its not just a huge distraction. Its a resource suck. You have to devote millions of dollars and Attorney Fees just to tackle these things. It distracts you politically as well. Were very near the time when youll start to see the formulation of the 2024 president ial campaign. People will start dipping their toes in the water. Trump is going to likely have a lot of these looming legal issues hanging over his head as this process begins. Then you have this new New York Times poll that shows a much brighter outlook for democrats and frankly joe biden himself. The question of whether the country is on the right track. Independents show 18 points on whether biden is doing a good job. Democrats are up 13 points to 83 . Independents up 14 points. I really noticed this one minneapolis voter who was quoted in the article and said he stands with the republicans on economic issue, but is going to vote democrat in november for one reason. And thats to oppose trump. Which is exactly what happened to him in 2020. And its interesting to watch trumps reemergence, he never really went away, but when you look at 2024 and the possibility of him running, that poll was interesting. Those are like literally blaring neon signs as they drive down the street every day. So that feeds into this. And then you have the Dobbs Decision that put Abortion Rights squarely on the political landscape. But i do think theres something to the idea that trump is blotting out a lot of of the news. When this is a referendum on trump and not joe biden, thats to the benefit of joe biden. In some ways republicans have the worst of all worlds in this sight the right now. They have trump in the news for all the wrong reasons. They dont have trump on the ballot, which means trump voters, but they see trumps legal issues being discussed every day. Immigration is a federal issue and needs to have a national response. The second part is recogniing that there is infrastructure. We operate in states from new mexico to north dakota to North Carolina that serve them and theres a way that the federal government needs to step up and coordinate the movements because otherwise what you are going to see is more and more governors getting into this political grand standing. It is a fact that some states are carrying the burden more than others. But ill also say slox i have been a journalist for deades, we have been talking about the need for comprehensive Immigration Reform and it hasnt happened. What is it going to take to get the parties to really confront these complexities ands at least attempt real reform rather than scoring some shortterm political points. Maybe because i had a faith based organization, but the honest truth is a miracle. We know whether its political leaders or administration officials, immigration is viewed as the third rail of american politics. While we have seen bold action from the white house on climate crisis, inflation infrastructure, we have seen far more relctance to act, whether its the southern border. The reason why we have so many coming through the southern border is because there is no real way to come into the u. S. So many people said why arent they coming legally. Last year marked the fewest annual number of immigrants since 2010. How far along are they and do we have any sense of consideration for when a final decision might be made . As you know, Everything In Biden World is deliberative. So probably not going it hear an announcement from President Biden any time soon. It will take awhile. And one of the benefits of building the partys structure opposed to trying to stand up a campaign right now is that it does buy a little extra time. Theres a lot of things they can do through the dnc that are Campaign Activities that dont require that formalized launch of a campaign. So i wouldnt expect to hear President Biden make a formal announcement until after the midterms and maybe not well into next year. Its interesting when you talk about the midterms because if they are talking about campaign messaging, thats got to be informed by whatever happens in november. In part by what happens in november, but they are sort of testing out those themes now. You see testing from President Biden. One of the themes they have been talking about is interestingly promises made, prolss kept, which some folks may remember from Donald Trumps last campaign is one of his slogans. So knowing her, and knowing her faith, what do you think she would want to see on monday . We are, as i said, told that she had many personal touches to the funeral. Well, i think she wants to see a kind of celebration. I dont mean that we dont have any grief, but she cared very deeply for this country an she gave her life for it, for its stability, for its democracy, for its flourishing for awful her life, i think what she would want to see is a nation joined together, sharing love and grief, and also i think some of her faith and hope in god. There was a moment that i shared with her personally, at the end of the evening, theres a reception that her majesty hosts, just after the dinner, and everyone gathered there, and i was incredibly honored to be a part of this, a part of the president s delegation that attended, and im standing against the wall, speaking with some of my colleagues and all of a sudden i see her making her way towards us and my custom is to back against the wall and allow her to pass and she approached me and she came right up to me, and she said, well, and who are you . Ill try not to imitate the queen. I have a habit of doing that. And i said, well im Capricia Marshall the United States chief of protocol, president obamas chief of protocol and she said, she sort of sighed and she said, a very hard job indeed. Well done. Well, i just was about to burst. And i looked around to see if anyone noticed that she was talking to me, and i was incredibly honored, so very, very privileged for that moment, and again, as i said, i will cherish it forever, she made me feel so very special, and also really honored for the position i held in government.
