Ashley, let me begin with you. Whats the reaction inside the white house to trumps comments he will not promise a peaceful transition of power. Does it reflect what aides are saying behind the scenes . Youre seeing people in the white house publicly in some ways double down on this. White House Press SecretaryKayleigh Mcenany did a briefing today. She was pressed on what the president said and did not disavow his previous remarks. She side stepped and dodged around it. When she was asked very expli t explicitly does the president accept the results of the election, she talked around it. I said does this fit in with his law and order message. This isnt representative of everyone. There are certainly people in the white house who wish the president would not say stuff like this. This person said they dismiss it as noise. Its not going to impact the way voters think about it. They put this not in the law and order bucket. They reserve law and order to refer to riots. This is something the president said they dont think should be paid too much mind. Of course, it is because a peaceful transition of power is a key to a functioning democracy. Were keeping a live eye there on edwards base. Gee, the atlanta reports that the president is looking at losing the electoral college. The Trump Campaign is discussing contingency plans to bypass Election Results with a justification based on claims of rampant voter fraud. Trump would ask state legislators to set aside the pop already vote and exercise their power to choose a slate of electors directly. Is this possible from your Legal Expertise . Well, it is possible but not likely. It is true that the republicans may have an argument, at least on its face, but not a very strong one, that legislators are the ones who appoint the manner of electing. What that means is that all states have determined that voters have the right to select the president , even though they dont have the constitutional right. Thats the manner the legislators have determined that well select the president , by having popular elections. Once weve already made that selection, you cant take it away. While its possible and it is a strategy and i guess it will be a last minute strategy that they try, its not strongly legal. I expect a strong rebuke from the courts if the president tries to use that strategy of setting aside the popular vote and implementing the selection of electors in order for them to take away the results that the voters have provided that is contrary to what they want. When you look at the body that governs or the body of norms and practices and traditions that governs our electoral process, how much is codified in law and more set in practices and norms over the last 244 years . Thats a great point. Both are important. Fundamentally a peaceful transition of power and a recognition of the role of the al electorate to preserve its verdict on our government thats a fundamental key to any democracy, particularly advanced democracies. When you have the chief elected official of the nation trying to undermine the political process, thats a norm thats being violated. Its crucial that we reinforce that norm. There are some legal rights and law that come into play. For example the court has said that once the government provides the right to vote in this context, its a fundamental right. Law does matter here as well. I hope and expect that our legal rules are going to stand up against the attempt to delegitimize the electoral process. Thats what a lot of americans are hoping for as well. Dr. Patel, President Trump appeared to throw cold water on new fda guidelines requiring outside experts to weigh in before the agency actually approves a coronavirus vaccine. I ha i want you to listen to this. Were looking at that. That has to be approved by the white house. We may or may not approve it. Does that sound like political interference for you . What have you found out about people demanding a review process of the fda process . Its ironic. He says its a political move. Thats exactly what the president is making and its clear that this is coming kind of from this isnt just the president by himself, ayman, which is the disturbing part. This has been demanded by the office of information and regulatory activities. Regulatory clearances in the office which is responsible for understanding that the fda by law really has its independence. It depends on it. This is not novel. This concept, by the way, of an outside committee is not novel. Its exactly how the agency conducts its business. Its a validating mechanism for outside scientists to be able to review the data and give advice and counsel on whether or not something, in this case a vaccine, should be approved. For the president not just the president for people inside the white house to delegitimize that, ive never seen anything like this in all the administrations i worked in. Its troubling. Combine that with the electoral process, youre seeing an administration, not just the president , but his internal officials propagating this delegd delegitimizing of science. Ashley, is the president all in or is he going to basically try to downplay the virus . Is that his strategy from your sources . Hes downplayed the virus since we first learned of it. Thats what we learned from the tapes released by bob woodward. Look at the president s comments. He spins a factually inaccurate reality that the virus is not a particularly big deal, that were about to round the corner, that it will magically disappear, that a vaccine is coming. It does seem like a vaccine is coming, but not only time table the president promised. Theres 200,000 americans dead. Thats the reality. I think we should expect based on the president s public and private comments for him to downplay the virus in the debate. Look at his rallies in the past week which he really ramped up to a very rapid pace, his rhetoric is often offensive. Its dark. Its mocking. Theres a world in which he brings that which is not a traditional Closing Argument and not a traditional closing a argument for an incumbent president. Dr. Patel, the president has put his reelection bids on a vaccine being delivered before election day. A secret panel of experts will be reviewing the data. U. S. Tax payers have helped this. This panel has the power to stop a Clinical Trial or fast track it. Calls are growing for the secret panel to be released to see if theres any conflicts of interest. Should we be concerned theres a conflict of interest between some of these officials who could fast track a vaccine and any financial interest they may have in it . I think being transparent about conflict of interest is always critical. The panel were discussing is called the data safety and monitoring board. This is not unique. Its not a unique entity for a vaccine. Its used in any sort of treatment, vaccine, device, et cetera. It is true, ayman, they have the responsibility to declare conflicts. What were talking about is theres been so much public validated mistrust of the process that anything we can do to shed sunshine on all parts of it including conflicts of interest and background on the people making the decisions, as well as financial documents, is something we should know. One of the members that chairs the fda panel, a well respected scientist, because of conflicts of interest stepped down. I dont want people to think these are secret panels that are kind of running is he ripty shously. Because of this delegit my saigs of the process we need this to make me feel comfortable taking it or giving it to my patients. Gee, are you concerned this election ends up at the Supreme Court . I am. I think theres a very high probability given if the election is close and comes down to a swing state. Theres no doubt the lawyers on both sides will litigate a bunch of issues. The probability we end up at the Supreme Court is at best 50 50. Its a high probability that we see the court decide this election. Gee charles, dr. Patel, ashley parker, thank you. Another big story, tensions have reached a boiling point in louisville, kentucky after a grand jury decided not to charge any Police Officers in the killing of Breonna Taylor. A suspect is facing charges after two Police Officers were shot in demonstrations following that announcement. Police say their injuries are not life threatening. Protesters are expressing outrage that only one officer was charged with wanton endangerment because fun fire hit the appointment of taylors neighbor. Joining me for the latest is this reporter from the new york times. We spoke 24 hours ago as the news of the grand jury decision was breaking and after the attorney general made his announcement. You were on the scene for the demonstrations in louisville. Tell us how it felt and how different the civil unrest that swept that city over the summer compared to what you saw over the past 24 hours. The demonstrations began peacefully as they almost always do. For much of the day the demonstrators were clearly angry. They were voicing their disappointment and frustration at the grand jurys decision. It was after night fall and we were getting closer to the 9 00 p. M. Curfew that the things degenerated. There were protesters trying to set fire to objects, trash cans. Some of them allegedly had come with lighter fluid. The real clashing point came underneath a freeway overpass near the i65 north off ramp where just before curfew at around 8 45 p. M. Shots rang out and two officers were injured. One was hit in the thigh. One was hit in the stomach. I got done interviewing the commander who was there on the scene who described the chaos that ensued. The real feeling, i think, of apprehension and fear that they felt because they were in an area without any kind of cover and they did not know where the shots had come from. As i mentioned, were 24 hours out from that announcement by the attorney general. Weve had a chance to digest it, look at the charges for the endangerment. What more do we know . What more questions do we have about what was presented to the grand jury, whether it was presented in its entirety, that may have prevented the charges against the officers who killed Breonna Taylor . Its such a tough case because the officers who came to Breonna Taylors door were not the same who had done the investigation. There are issues with the investigation and there were questions raised as to whether the search warrant for her premises was on point and should have been issued in the first place. The people who showed up there at that door that night did not have anything to do with that investigation. They were handed the warrant and said go hit this location at this time. Once they got there, they banged on the door. Theres a question about whether they properly announced themselves, but once they punched in the door, what happened is that ms. Taylors boyfriend who was a licensed gun owner didnt understand they were Police Officers coming in with a warrant. He thought it was an intruder. He left off one shot with his 9 mm. Handgun critically injuring one of the officers in the doorway. What the attorney general explained is therefore the officers in the doorway were justified in returning force. It was those two officers who killed her. We have the ballistics and know it was their bullets that killed her. The only officer that has been charged is the one that broke into the door, went into the parking lot and blindly fired into her patio door and window. Those bullets travelled through her apartment to one in the back where three people were sleeping. Thats where you see the wanton endangerment charges for him. Theyre not for Breonna Taylor because none of his bullets hit her. A lot of Unanswered Questions about all this as you mentioned. Thank you. Coronavirus is starting to surge again. Joining me now is anna bento a coauthor of that study. Anna, great to have you with us. Walk us through this. What more can you tell us about your study and how you got to the conclusion you did . Hi, ayman. Pleasure to be on your show. So theres three main messages that our study highlights. To back up a little bit we are using of course data for daily reported cases at the county level. Were also using safe graph data which is aggregated mobility data at the county level and at the census block which is a little more resolved. Then we were interested in trying to understand given information on when schools were reopening. Were talking about counties that have universities and colleges and we wanted to understand whether there was an effect with the reopening on increases or no effect on the number of daily cases. Two things we saw were that in colleges with facetoface instruction, as you very well said already, we were able to predict on average about 3,200 daily cases. Depending on the county were talking about this ranges between 500 and 1,000 cases a day. One of the things we found in our study was it was due to the increase of people on or around campuses just prior to the reopening and during the weeks following the reopening. Im curious to get your thoughts on this question. In an interview with the wall street journal you said the decision to reopen was far more complex other than just the simple question of will there be a surge in cases or not. Explain that. The decisions to open a university are very complex, as you say, not just because its a question of bringing in students or the forum by which students are brought in, but given the there are of course students that regardless of facetoface or online still have to come back to the place where they study because either they were not able to receive their leases or they have during the year jobs. Theres a lot of different decisions that leads to individuals to not just facetoface or online, but individuals having to come back, students having to come back to campus. One of the things that is important here is also to understand that, while of course having your facetoface regime means all students have to come back, its not really just the interaction of them being in class and on campus, but also the day has 24 hours and the university is not in a bubble.
