Weve been following the investigation quite closely. What have you learned about this particular aspect of what mr. Whittaker said . For the Law Enforcement i speak to in new york and other people that are familiar with these cases, they dont know about this call because the call never was actually made from whittaker to the u. S. Attorney here in new york. One thing that i think people are pointing out its two points i think they should know. The times reported im not in any way disparaging the reporting, certainly not disparaging their reporters. Theyre all terrific and have done terrific work. I dont have any direct knowledge of the phone call. They do say that jeff berman recused himself from the Michael Cohen investigation. One, he did not recuse himself from the investigation. In the current u. S. Attorneys manual, which is called the justice manual, their bible, their guide if you will, to these investigations. It says you cant recuse yourself. Now, the former u. S. Attorney in new york and i were discussing yesterday on twitter, there have been been instances in the past where they have accused themselves. Its not the case here. In other words they said youre not going to be part of the investigation Going Forward and that call came from a Senior Justice Department official. Thats all within normal protocol. He did not recuse himself. Why does that matter . Its showing the Justice Department says this is an investigation into Michael Cohen. Jeff berman hadnt been on the job fr loor a long time. So we have no potential issues with this sensitive investigation, it was the president s personal attorney, were not going to involve somebody who was appointed by trump. Lets address the trump ally. I think its a fair point to say someone who is investigating christopher collins, who was one of Donald Trumps biggest and first supporters in congress, somebody who has indicted the russian leicester ciawyer, that somebody whose actions may be consistent with somebody who is a trump ally. Y as one of my colleagues pointed out to me yesterday, theres been reporting this investigation into the trump inaugural committee, that the subpoena has jeff bermans name on it. When you start to look at kind of all these various examples and look at the investigations hes launched, those two characterization may not be accurate. Other than the tweet, what have we heard from the white house . Reporter the tweets this morni morni morning has said its a enemy of the people. Did you ask acting attorney general Matthew Whittaker to change the leadership of the investigation into your former personal attorney, Michael Cohen. No, not at all. Theres a lot of fake news out there, no, i didnt. Reporter more doubling down for the president. You know, when you look at that times report, whats interesting is the president s attacks on the media have been relatively constant. Theyve been high. Hes said insidious things. A lot of our Campaign Reporters recall that. Where you see the change is his defenses in calling out what he believes the witch hunt is on russia. Thats really where the big increase has been. His attacks on the media have been consistent. Guy . Chuck, what are the implications here if President Trump did in fact ask Matthew Whittaker to take some sort of action in the cohen investigation . Its a good question, craig. It fits into a pattern that we have seen unfolding, unraveling over time. That is the president threatening witnesses or hanging out the promise of pardons or trying to use twitter to intimidate. If the president really was going after Matt Whittaker and asking Matt Whittaker to intervene and to get berman to unrecuse something ive never heard of, an unrecusal. That would fit that pattern of obstruction. Why does the pattern matter . In order to prove obstruction, as weve discussed on air, you need to show intent, corrupt intent. And so its those many pieces put together that begin to form that picture, that the president wasnt simply seeking to have berman put back in place because he thinks hes the best u. S. Attorney in the country. Its that he wants berman back in place on the case because he believes berman will protect him. That pattern of obstructive conduct could be a violation of criminal law. Betsy, are house democrats, are they now likely to take another look at mr. Whittakers testimony before that Judiciary Committee a few weeks ago . I think theres no question. We know that they are now reviewing it. And that jerry nadler, who is the chairman of the House Judiciary Committee has sent a request for clarification to whittaker to elucidate the testimony he gave. Looking back over whittakers testimony, its lawyerly, its cautious, and its clear that whittaker seems to be bracing himself for this question. The operative phrase that whittaker made and the Justice Department provided to the New York Times for their story, that phrase is promises or commitments. Whittaker and the doj say that he never made the white house any promises or commitments v. Z nobody has asked whittaker to commit to anything in particular about the way these investigations are run. Rather, whats been widely reported is that trump leaned on whittaker and tried tod persuad him to take certain steps, especially as the New York Times has reported regarding Jeffrey Bermans handling of the Michael Cohen investigation. My expectation is that whittakers testimony is careful enough its not particularly likely he perjured himself. But i also think its probable that the house judiciary will be able to get more information out of them if theyre able to craft their questions in a way thats a big more lawyerly than the way they did in the very theatrical public hearing that happened about two weeks ago. The report also gives us some insight kinto how the president positioned the departure of mr. Flynn. One of mr. Trumps advisors mentioned in passing paul ryan, then speaker of the house, had told reporters. That mr. Trump had asked mr. Flynn to resign. It was unclear where mr. Ryan had gotten that information, but mr. Trump seized on mr. Ryans words. That sounds better. Mr. Trump turned to sean spicer, say that, mr. Trump ordered. But was that true, spicer pressed. Say i asked for his resignation mr. Trump repeat. Betsy youve covered this administration for some time now. Does that surprise you at all . Its not particularly surprising that trump would hear somebody Say Something on tv and then seize on it. What i think is pretty extraordinary about what the times has reported is that spicer then went to the podium in the White House Press room and made a number of claims that the white houses own lawyers believed were not true. And that those lawyers memorialized the failure of spicer to correctly and truthfully describe the way flynns firing played out. Remember, flynns departure from the white house is a Pivotal Moment in the early weeks of the trump administration. It was a huge setback for trump and it teed flynn up to eventually become what appears to be a significant cooperating witness for mueller and his investigators. The fact that flynn was ousted and the circumstances he was ousted under is something of an historic event. The report that came out from chairman cummings yesterday adds more context to this whole store. Cummings staff argue flynn was involved in an effort to illegally try to move Nuclear Material to saudi arabia. A step that could have triggered an arms race in the already very volatile gulf region. The fact that flynn was involved in all of these very legally dicey situations and that the president could barely even keep his story straight about the circumstances of his departure is something, you know, that even two years later is really stunning. As a veteran prosecutor, what can we expect tomorrow in court . You should expect an unhappy judge and a humble roger stone. That was a remarkably reckless thing to do. I mean, look at larry hogans numbers. 75 of marylanders consider him honest and trustworthy. 70 says he works well with the other side to get things done. He has an 89 Approval Rating among maryland republicans. Trump has an 81 approval among all republicans. Hogan has a 71 approval among independents. 65 among democrats and overall 80 of marylanders think hes doing a great job as governor. He just got reelected. He definitely hasnt ruled it out. He placed his odds at roughly the same for winning two terms as governor when democrats outnumber republicans two to one in that state. I think there are times when he acts irrationally and makes decisions that are not only not and does things in a way that arent great for the Republican Party or for the country or for him and his agenda for that matter. I think sometimes he can be his own worst enemy. I mean, as big named republicans like hogan or even john kasich, as they start to think about whether to run, do you expect well hear more republicans willing to criticize this president . Will the primary process force the gop to choose a side . Look, i hope so. I think this Republican Party needs an awakening. What is happening right now, politically speaking, what the president has done is hes choosing an issue right now, which is the border wall. That issue solidifies democrats, right, theyre all unified against the wall. It splits our own party. When youre running for president , the idea is to unify your party and split the other party.
