Targeting undocumented raids across the country. Sources tell us they are set to begin in just a matter of days. Down pennsylvania avenue im told the president is gearing up to escalate his legal fight over the controversial Citizenship Question on the 2020 census. Hes set to take executive action this afternoon. We have a busy one. We start with casey hunt on capitol hill. Where will this go down and how do you expect it to play out in the next little bit. This is democrats trying to set up a key test for the Trump Administration. I think over the last several months we learned not to expect the white house to comply with what Congress Demands of them. What they have been doing is build a case for the courts to try to get them to intervene and say to the trump add manage, no, you actually have to do what the coequal branch of government demands that you do. This is a real blockbuster list of names they are going to subpoena here. At the top of it, jared kushner, the president s soninlaw, who, of course, the president has wanted to protect from things like there. Theres also michael flynn. You can see all the people were expecting them to subpoena in just a few minutes. Theres also cory lewandowski, the former campaign manager. The big question is how does the administration go claiming privilege in each instance. The campaign is not protected by that. They do in theory have to answer about their time before the white house. White house lawyers argued strenuously the time during transition or during the white house itself is off limits but they have been pushing the bounds of that with hope hicks, andy donaldson, democrats, have a record of how aggressively the administration is not allowing answers for anything related to this investigation. I think youll see in the committee this move really expeditiously but probably contentiously as usual. Just to let our viewers know, another look inside, we expect Opening Statements from the chairman and ranking member, nadler, doug collins. Were going to bring those to you live when they began. Bob, let me come to you, what are you hearing from your sources about the latest white house subpoena move and broad investigations they are continuing to push against the president. The war wing inside of the west wing and White House Counsels Office is humming today as it has been since january. When you talk to white House Attorneys and aides, for the first two years it was about judicial nominations, don mcgahn, white House Counsel, now the white House Counsel that placed mcgahn. Its bougt preventing getting witnesses to the hill and documents to the white house. Thats what a lot of their focus is day in and day out. As were having this conversation, President Trump is tweeting about the exact issue we are talking about. Were going to get that up on the screen for you here. He says, according to the president , now the democrats have asked to see 12 more people who have already spent hours with Robert Mueller and spent a fortune on lawyers in so doing. How many bites at the apple do they get before working on border loopholes and asylum. Bob, this is similar to what weve heard from the president in the past, trying to turn the conversation away from the special counsel investigation and focus instead on what he perceives as shortcomings for congressional democrats. Also apples and oranges, not just a bite at the apple. Federal investigators, Robert Mueller, special counsels office, looking at russia interference and possible obstruction of justice. Congress is a separate and coequal branch of government, wants to do its own investigation. They want to explain the narrative to the American People. When you talk to house democrats, they say most americans havent read the Mueller Report and they dont know these characters. They dont know about the Decision Making inside the white house. They feel compelled to pursue investigations and bring these people up. Caroline, what do you see more broadly as why the significance matters with what were going to see go down there. Talking about democrats want to see these dozen individuals. The president went on with his tweet to say, enough already, go back to work. The first thing bob alede lewded to, shes writing a letter based on bad legal theory. Referred to executive privilege. But the legal theory saying hope hicks shouldnt testify recently was this theory about constitutional immunity, which is sort of like a blanket immunity. When any administration has made that argument, courts have said, absolutely not. Theres no such thing as a blanket immunity. You can make specific request based on executive privilege but you cant say were not going to do that. Also some of the names on that list, Keith Davidson, theres no argument they cant testify. I think youll see they are looking into this Campaign FinanceLaw Violation and the question of the whole the second most famous of President Trumps most famous dalliances with playboy playmate karen mcdougal, the whole catch and kill ami issue which has gone unnoticed recently, i think thats going to come back into the forefront here and they are going to get to the bottom of it. Caroline is right on the money about the fact the Campaign Finance piece is going to generator more interesting information for house judiciary than these potentially pyrrhic efforts. If you try to bring in do not mcmcgahn, jared kushner, i hope you enjoy a long legal fight. But the lawyer that negotiated hush money deals between stormy daniels, karen mccould goal, Keith Davidson is going to make any argument same with the head of national inquinational enqu. He wont be able to make that argument either. This is a kitchen sink day. Weve seep this process devolve with the white house not wanting to give an inch. Some negotiations around the edges but today they are basically throwing subpoena authorizations at the white house and other issues. This is russia investigation, this is obstruction, hush money payments, this is the border situation, this is zero tolerance. There are so many things they are going after basically hoping a few of these things will creep through and they can put a spotlight on issues they dont feel like have gotten a thorough vetting in the public. Were looking at chairman jerry nadler. Its important to note this committee, if they authorize these subpoenas, which would not be a surprise, doesnt mean the subpoenas will be going out. There is a window, perhaps, after todays vote. Can you talk about that . Absolutely. Theres always a back and forth in terms of the threat to negotiate the subpoena, threat to issue the subpoena, back and forth, in my dealings i represented George Papadopoulos in his congressional testimony. There are numbers of different ways you can go about open door testimony, closed door testimony, what types of things you can talk about. You can negotiate with that before. The sort of last and worst Case Scenario is that you go testify under subpoena because its much more difficult to negotiate before what types of things youre going to talk about. I think this whole thing is really a buildup to Robert Mueller testifying next week and democrats wanting to ride that wave and really get some momentum in terms of creating a broader picture of what were seeing, filling in some of the blanks that maybe Robert Mueller is not going to testify to next week. Kasie, does that sync with your reporting on the hill . Sure, it does. I do think we dont want to underestimate the degree to which the focus among judiciary members and Intelligence Committee members as well, obviously, but especially judiciary on how that testimony is going to play out. We know that they have been behind closed doors, gaming out what that is going to look like. Theres concern hes not going to be able to testify for as long as democrats might like him to. Theres going to be an abbreviated sort of time line for this. They are going to have to limit everybodys questions or have some meme not ask questions, which you can imagine doesnt go over well in the congress. I think this is something that is intended to keep the ball rolling, but that right now the real focus is on making sure that they dont totally miss their opportunity next week with bob mueller. Kasie, caroline, betsy, i want you all to stand by if you can. We are watching the hearing. When it gets started were going to come back to it but we have a lot of other news in the interim. If you thought President Trump was going to let a Supreme Court ruling stop him from trying to get that controversial Citizenship Question to the census, you dont know donald trump. Today were told hes going to issue an executive order to try and do it. This is something hes been hinting at every since the Supreme Court temporarily blocked it. It comes hours after a second judge denied the justice departments request to swap out the legal team. Im joined by justice coordinator pete williams. Whats the deal, does the white house have a legal leg to stand on with the action . The Supreme Court doesnt say you couldnt do this. What the Supreme Court ruling stands for is narrow, have you to have a good reason, commerce question, for why you want to put this question on the census form under administrative freedom act, what you gave about voting act is a tall tale, doesnt wash, and thats it. In theory it leaves the door open for some kind of president ial action. The president isnt subject to the administrative procedures act. I would say two things about, this hallie. One is, this doesnt necessarily and doesnt at all violate the Supreme Court ruling. Secondly, it doesnt mean they are going to get a free pass here. Whatever the president orders the Commerce Department to do, as soon as the commerce dependent decides to do it, they will be subject to more litigation, lawsuits. There are a couple of problems for the government. The opponents will argue the same argument, this will not lead to an accurate account, discourage people to respond to the accepts us, even if its an addendum, second piece of paper that goes with the short form, they will say the government doesnt have the Legal Authority to do this. Theres also the question about repeatedly telling the judges, both the Lower Court Judges and Supreme Court, we have to start printing these by the end of juju june. The president s answer will be, thats the beaurocracys view of it, im ordering them to spend more money, start over again, use more printers, whatever has to be done to do this. It doesnt violate the Supreme Court decision, i dont think. But secondly, it is going to be subject to further litigation and further delay. You know, i dont know whether the president this will ultimately prevail legally or not. Its going to face some serious challenges. Pete williams, thank you for that. What does the aclu plan to do here . I think we have to see what the president is going to do first. It looks like what hes going to say, hes going to openly defy a ruling of the United StatesSupreme Court. Obviously that cant possibly stand. The Supreme Courts opinion a couple weeks ago said two important things. One, were deciding this case now because the government has told us that it needs a decision by june 30th. Two, the government loses. The government lied about why it wanted to put a Citizenship Question on the census. Theres no doover at this point. If the president tries to go forward now, i think its pretty clearly in violation of the Supreme Courts ruling. It looks as though based on our reporting the president will, in fact, try to move forward with the executive action to get the question on the census. So will the aclu file a suit here . Weve already filed a suit. Will you continue we have a pending motion in the lawsuit we filed to permanently prevent the administration from adding a Citizenship Question based on their repeated representations that june 30th was the, quote, drop debt date anywhere changes to the census questionnaire. So that motion is going to be heard in federal court in about a week and a half. Theres pending proceedings in the federal court in maryland about whether or not this attempt by the administration was motivated by a desire to weaken the political influence of hispanic communities. Yes, i think if the administration does, in fact, come forward with a new decision, trump adding a Citizenship Question youll see more action by the aclu.
