Plus, a new lawsuit against the s Sackler Family. Saying they played a huge role in the opioid chris. This is a one night event this time, not two nights, not 20 candidates, theyre going to be vying for big moments with the focus on key story lines including what will the dynamic be when joe biden and senator Elizabeth Warren face each other for the first time. Can beto orourke and Pete Buttigieg can they reinvigorate their campaign. I want to know, do you have any idea, i know youre in houston, on the on the ground. The fact that he wrote gold chain, that has be clearing my schedule. I fear im going to let you down again, i was pulling for crowd surfing. Okay, lets talk about who you are covering, elizabeth warn two has been growing in the polls. Does she stay study the way she has been going, does she go after joe biden, what is likely to happen . She is probably not going to crowd surf, they want to see what happens, and i know that is a pipe dream for everybody. It would be a policy centric debate. As i have gone out there, you may see a bump in the polls, but if you attack somebody that they has been to like at this point in the race and there is not much of a upside if youre e liz bit warren who has had a smooth summer of sailing. She has been able to rise without much interference. The keyword will be contrast and not necessarily attack. She doesnt need a moment at the expense of anyone else on that stage. That doesnt mean that the other people dont. If the attacks that we have been seeing from other campaign surrogates, like ed rendell, he has been coming out and hitting her as a hypocrite. She was campaigning with big donors in 2018, and that is a pledge that made her pretty popular this time around. Im interested in seeing if those attacks from surrogates will tricken on to the center stage. Now that she is center stage and very much a front runner. And what does biden do about that . His people are thinking about the same conversation that were having, and he has Bernie Sanders on the stage with him but they have been in this context, what is biden preparing for. In the each of the last two debates, he said theyre going to be singularly focused on trump. And he has been dragged into relitigating his own record, his time in congress and in the Vice President si. We can expect the same thing to be in place today. They want him to be prepared to defend himself. I think we may see that again tonight, he is defending the obama record. But it does set this context here. Biden will continue to defend on and i expect that well see a lot of good focus on that. Dont be surprised to see a significant portion of this sangled up yet again. You will have him tangled up with Elizabeth Warren. It could be interesting, if those two can gaits, take on biden and his desire to work on the Affordable Care act as well. Both bernie and elizabeth were in office when obama care was passed. It was hugely popular. Joe biden is not saying lets leave it as it was or is several years in it needs new improvements and it is interesting to watch them say this is not working. But we have to ask you, garrett about beto and Pete Buttigieg. There was so much enthuse yach for them, his most noexble moments have been him dropping the f bomb, do we know the game plan for these guys . They have been better performers on the stump than they have been on the debate stage. That could change for either one of them. This is a home game. It is in his home state. And there is a lot of new polling that suggests that the gun violence issue is at the center right now. They have done everything they can to signal that is what he wants to focus on tonight. His even headedness is part of the reason that he is so popular with voters, but it makes it harder to have a viral moment on the debate stage. He will be lined up with three septigenarians. That didnt work for eric swalwell. But boouttigieg is a more age debater than he was. All right, lets talk more about what were watching tonight. Our friend eugene kothd, what are you expecting tonight. Will it be a replay of the last two debates where they were going hard at each other. I certainly think the candidates will communicate theyre united against president trump. One idea we heard is that anyone on the stage is better than president trump. That is what they want to encourage for them to vote for whoever is the nominee. This will be a night where quite a few candidates are trying to have a break out moment to get out of the second tier of candidates to break out of the single digit numbers. I would not be surprised if we saw them be incredibly aggressive, and if they just had a moment to let voters know theyre the best person to lead the party forward. We have been looking at Bernie Sanders and the candidate that other candidates have been going after in the entire debate. At this point we have seen some candidates plan attacks against e lid beth warn. I think theyre going to try to communicate voters that are not on their team why she thinks she should be there. It could be wonky, perhaps uninteresting and uncomplicated. They are maybe skimming them and not going really deep. I think she is going to communicate that they should be getting behind her ideas. I have no clue. It is something physical, though, the dancing, the crowd surfing. He is an interesting character that managed to keep himself in the news. And with interesting ideas. Yeah, they just wrote about this and he met in a coffee shop and he was like dude, youre not a long shot, youre a long long long shot, and today even said andrew lang officially dumped on me. There are voters that want someone new. We do see sight support but there is still a string of voters open to new eyes and people. Lets talk about kamala harris. Any thoughts on her gamer this . I think she will try to communicate that her ideas are what is best for the party and that she can find a way to move up higher without attacking people that she is competing against that many voters love. Even though there are voters that have a problem with bidens past, some other issues related to race. And them being attacked felt like they, themselves, were being attacked. I think she is trying to say i have better ideas than the bern i respect him and i respect you, and i just want all of you all to get behind me. Good to see you as always. Dont forget to watch msnbc for our exper live analysis for our third democratic debate. Tonight, starting at 11 p. M. Eastern here on msnbc. And you should be able to make it to this after your softball game tonight. Oh, im sorry, are you. It does look a little bit like a softball jersey. Im sorry that i disappointed you with what i wore on tv today. Its been a long time. Why dont you just take it from here. Im happy youre back. Im so happy. Im so back that youre back and not in rain gear, and youre not the first, my husband also asked me if i was playing baseball after the show. Now to another top political story were following. President trump is calling the Supreme Court ruling a very big win. They overturned a policy decision. Here is what it does, it turns away anyone that passes through another country on the way to the United States and doesnt seek production in that country. If you dont know what i just said, i basically mean people from the northern triangle, on their trip to the United States, when theyre going through mexico, they are saying you need to apply for asylum in mexico. That is what the president wants. Julia is joining us now. It was expected to have a court challenge, is it going to have a win . It means that while this continued to play out, the Supreme Court said the Trump Administration can deny the right to seek asylum for anyone that passes through mexico and it applies retro actively. So anyone that came in after july 16th, and didnt go through their initial interview, if they did not have that interview yet they are not allowed to seek asylum. This is the toughest action against existing asylum laws yet. We knew there would be a court challenge, it was instantly challenged, but the surprise now is the Supreme Court says that while all of this plays out they should let this stay and allow citizenship and immigration services, that they can go ahead and do this in the interim time. Help us understand when you say it is retro active, how many people have come through since july . How many people is that . Right, so were looking around 80,000 a month. Not all of those seek asylum, but the majority of them are. The asylum numbers are where they have been. Many of them will have so be returns back to mexico. The place where they pass there is a remaining policy in place where they have to go back to mexico and wait while they get a Court Hearing date. It is already tough, this will not en allow them the right to wait for that court date because it is not coming. It is not as simple as going to mexico there medical examiner owe is much harder on they don process that we have here. There is far few er here. It is harder in mexico. Thank you for your coverage of this. Joule yay for us at the justice department. If you have not read it yet, know your values page, read her piece, it is awesome. Pennsylvania just filed a major new lawsuit. Were going to speak to the attorney general who says the nationwide fight against the family is not over. Applebees handcrafted burgers now starting at 7. 99 now thats eatin good in the neighborhood. This morning, pennsylvania is files suit against purdue phama. It comes after several places rejected a deal. They say it doesnt go far enough. Under the terms of the deal, they would give up control of purdue. They would be converted into a for profit trust and profits from drug sales will be paid out to the plaintiffs. The sackler fame said this is the most effective way to address the emergency of the current public crisis. Joining us now, first help us understand this. What does it mean when there is a settlement or a rurling and 2 states dont accept it. How does that work. It is not a settlement. I think there is a framework and i would differ from how you presented that frame work. They p want us to believe it is a 10 to 12 billion deal. That is complete nonsense. Among the 20 states, pennsylvania, other big states like new york. Other hard hit states are saying no this is inadequate, it is a lap in the face to the people suffering here in pennsylvania and across the country. This is really a story about a bunch of greedy billionaires, that is the Sackler Family, purr due, being unwilling to reach into their personal fortunes to pay for the damage they created here in pennsylvania and across the country. There is a punitive part, on the other side there is the idea that it cost states like pennsylvania and the whole country multis of what this proposed settlement would look like. So what do you want to get . What would feel like success to you . The sacklers admitting responsibility and paying out of their personal fortune may feel good, sbu the goal to pay for the damage mitigated by the crisis. I think we need Real Transparency here. There has to be an acknowledgment of the wrong doing. They have benefitted to 10 billion in profit. It has lead directly to the heroin and fetal crisis claiming the lives of 12 pennsylvanians each and ere day. They need to dip into their own fortune. Theyre willing to sell off other companies to pay for this, and as part of the frame work they want attorneys general to sanction or support the overseas sale of opioids to fund this. I think the more people that study the deal will realize it is not 10 to 12 billion. They dont dip into their pockets. They will not give up their gain thats are a result of these sales, and it is just wrong and unacceptable. Were not taking it in pennsylvania. Thats why i sued them personally. I realize they say theyre going to declare bankruptcy, that is nonsense. Were going to take on them personally and recover. How does a family, how does a family that is worth billions and billions of dollars, and a giant company that is solvent, how do they have the ability to file for bankruptcy. That is a phenomenal question. Whilebillions, they sucked all that money out. And when they sucked that money out they put it in o ten the mo purr due. They put it in their pocket, and now theyre going to turn around and say you cant have any of this. You cant reach in and get our ill gotten gains. And whether or not they declare bankruptcy or not, our lawsuit will stand and we will continue to go after the Sackler Family personally. Coming up next, congress is not moving so advocates are lobbying another center of power. Corporations. Well talk about how it is working. And we will speak with senator ben carden. What will it take for them to rule on guns. Youre watching it right here on msnbc. Okay, we have some breaking news. Andrew mccabes appeal to avoid criminal charges has been rejected. Joining us now is julia ainsley. Im going to speak for both of us, what . Yeah, this paves the way for an indictment of Andrew Mccabe that could be coming any day now. He, of course, is a former Deputy Director of the fbi. He was questioned by the fbis Inspections Division and the office of the Inspector General about his disclosure about the investigation into the Clinton Foundation in 2016. It was not necessarily e illegal, but he gave conflicts statements to investigators. That is at the forefront of what we believe would be a forth coming indictment. And the Deputy Attorney general has told and rue that his appeal for these criminal charges has been rejected, so now were standing by for a possible indictment. What is the consequence of that what happens if he gets indicted . He would face possibly a trial in front of a court. This is a garage that has been meeting on this. Critic wills say of course that this is retaliation. It is because of his involvement in the investigation into the 2016 election, the Trump Campaign and russia, that that is why he has been targeted and they will point to the recent acquittal of the White House Council for president clinton and obama, he was acquitted for something very similar in his false statements about his work in the rue crane. All of this together means people will see these very differently. They have seen mccabe has someone that was part of the same breath at comey. He was out for the president , and he is in the same scope as someone like peter struck and lisa cage. And that Jeff Sessions was wrong to fire him and 2016 just days before he would have qualified for his pension. A very polarizing story that can now end in an indictment that we were all relying on. A lot of detail and complexionty. Ali went what, and i when the what . And our executive producer assured us that julia will know. A gun control Advocacy Group is hoping that Corporate America will do something. The same coalition that helped pressure walmart to stop the sale of military ammunition is has opened a letter to break all ties with the National Rival Association and stop making political donations to nra backed lawmakers. Leaders from guns down america march for our lives and move on among others wrote to the company that said if Congress Wont act, it is time that you do. Nbc news correspondent heidi hezbollah, are they giving up on targeting congress all together and focusing on Corporate America . Theyre not giving up, but this is an acknowledgment that the road to change in congress is a long one paved with a lot of obstacles and their campaign with these companies and walmart show they can affect change pretty quickly. Theyre starting with this open letter to all u. S. Companies, and that theyre going to have very specific targets to build campaigns around. Companies and i will just throw a couple names out there that will not necessarily be targeted, but that we know for instance make donations to nra backed members of congress such as target, such as dicks sporting goods. They were part of that ceo letter that came out today calling for congress to take action. But they say that is really weak tea. When youre a Major Corporation and you a bazillion lobbiests. You can make gun kol a top priority if not the top priority. So what theyre saying is that share going to evaluate which of these companies are making donations to some of the top nra backed members of Congress Like john borasso. And to build campaigns around those specific companies, going into the holiday season. So that is a very important distincti distinction. We know that every town pulled together 145 ceos that wrote this letter, but unless theyre going to stop giving money to the Mitch Mcconnells of the world, then a letter is just a letter. It is cutting ties with the nra is relatively easy to do. It is easier than a lot of the companies not making donations to people who have supported the nra. Can you help us understand that by giving money to these poll decisions youre essentially aligned with them. Youre making it possible and promulgating the stalemate in congress. It has been decades since any of the members have felt significant heat and were talking about more of the moderate republicans, but the money has always been a big part of it, the town halls where they would show up to pressure members of congress have always been a big part of it. Were seeing a combination of pressure points. Targeting these lawmakers and two now on the money side. Now these trifss are not nye yooef. And they know there will have to be a change in control of the senate. So theyre not giving up on that but they also say hook, were in a crisis situation. The rate of gun deaths is the highest it has been in 40 years, so these companies are in a potion, both through their policies of donating and who they support to actually make change much more quickly than perhaps congre
