This is real stuff. And gop leader, of course, met privately with President Trump at the white house about the strategy for this highstakes trial. Mcconnell saying it could start as soon as monday. Now, considering this rather telling fact tonight, the white house amidst all of this is still trying to figure out who exactly will defend President Trump in the most important trial of his life. And debating whether to deploy lawyers like president clinton did or bring in perhaps a boisterous group of Republican Congress persons to defend the president. Mcconnell is trying to tamp down any madefortv atmosphere as he focuses on trying to hold the senate juror votes. One white house insider is warning it could become a clown show trial if trump insists on deploying some of the his most extreme defenders into the spotlight. Thats debate that continues among republicans. But its also worth noting democrats are not completely united right now either on aspects of this. Some have been pushing pelosi to get on with it and send over these articles of impeachment against trump. Others backing down on that to emphasize it is ultimately her call. I fully respect the prerogative of the leader of the house to ensure that there is as fair a trial as we could possibly secure. Good evening to you both. Congresswoman, i know you are coming fresh off this vote with a lot going on. I want to sbloe in on what we heard from Speaker Pelosi. What does it mean that she is publicly telegraphing that she sees donald trump as nervous and rattled and unable to deal with what many in your team and your side sbrn arguing would be a full and fair trial . Well, i think his words speak for themselves whether its on twitter or at his rallies. He becomes unhinged very quickly. So i believe that the speaker is trying to make sure that this trial moves forward in an appropriate way. And by postponing sending over the articles, we already have found out that ambassador bolten has signaled that he would testify before the senate. A very important person to have speak on this issue. And secondly the center for Public Integrity was able through a freedom of information act to get emails, even though they were grossly redacted. And then when a whistleblower provided the unredacted version we find out there is a huge coverup going on by members of the president s most intimate circle around this issue and that there is grave concern that the president has not listened to any of his experts as it relates to iran. He is using powers he doesnt have in terms of preventing people who are subpoenaed by congress from speaking. So there is a coverup like we have never seen as it relates to this impeachment. You make a really interesting point just about that timeline that basically in the pendency, if you will, of this period that pelosi has been holding the articles, you had that breakthrough Public Statement by john bolton, a key witness, and that might have gone differently if mcconnell had immediately gotten the articles and announced the witnesses. Barrett is also with us. Hayes, when you look at the situation, it is rather striking to see the signs of Mitch Mcconnell having protested that he doesnt even want the darn thing. Right. How can there be leverage in what i do not want . Also getting a little impatient and saying get it over, we need to deal with this. He met with the president yesterday who wants to deal with it, shook or not, and he is saying, look, if you dont give it to me i am doing business next week, as though thats a threat to pelosi. He knows good and well any move to dismiss the trial before it happens is not going to fly with the moderate members, the ones whose votes he needs to keep during the trial once it starts. A majority of senators can vote to do basically anything during the senate trial. You dont need a 60 vote super majority like you do for most legislation in the senate. He knows he has to keep the moderates happy. He has to make sure that there is a trial, that it has the appearance of being fair, which is why he has had strategy of moving forward with what he is calling the clinton model of deciding on witnesses later. He is trying to kick that can down the road so he doesnt have to worry about his members taking crucial votes too soon, hopefully trying to block it at all. He doesnt want to have to have suzcollins, et cetera, have to vote on does john bolton have to testify. Right. We are going to dig into that with what i mentioned. We have this incredible panel of senators tonight who faced these questions in the clinton case. We are also obviously going to have to get into the Lindsey Graham of it all. Talking about people with different views. Here is Lindsey Graham today on all of this. If she doesnt deliver the articles of impeachment, my goal is to do it without her and get this thing done. How do you move forward with a senate trial without the articles of impeachment . You would have to change the rules. He is not going to be able to change the rules is the thing. Josh holly also said we would have to dismiss the trial if we dont get the articles of impeachment soon. To do that you do need 60 or 67 votes to actually get the rules to change. There is nowhere near that level of support for Lindsey Graham or josh holly. Senator mcconnell signed on to hollys proposal today saying if we dont get the articles by the 12th we are going to move to miss disthe case. But they are not going to actually be able to do that. Its political posturing at this point. Lindsey graham can say that all he wants, but there is going to be a trial. At some point depending what the package looks like, depending on what mcconnell has gathered his 53 republican votes to set up, there probably be a chance for democrats to force a vote on whether or not witnesses actually have to testify. You have done important trials, eastern district, as i remind folks, is one of the these places where you go after gangsters, el chapo, terrorists. Short question and then a longer one. When you have a trial about a week or two away, do you usually have the lawyers doing the oral argument set . Usually you have your trial team set. Ill tell you, you dont always have your evidence set. But you usually know who is arguing the darn case. Yeah. This is the about biggebigge Donald Trumps life. His supporters find it exciting and his detractors find it incredibly disorganized, both on a matter of state, the clumsiness of rapiran, or his o case. Let me read the debates still going on, trumps defense team will include the white house council, jay sekulow remains the lawyer. But it says the decisions been made on alan dershowitz, a potentially controversial pick who has been in talks with trump about joining the team and other debates about whether you bring in house members or not. What does to tell you that they havent finalized that . I think . An internal struggle of a lot of defense teams. Even in a regular criminal trial. This is why defendants recall not always the best judges of who the attorney is that they should have representing them. Like the president , some defendants will say i want the aggressive pit bull out there thats going to challenge every single thing and fight everything to the death. That may not always be the best approach. Sometimes having a more measured, more scholarly approach can actually go further for a defendant. So sometimes defendants dont necessarily know what at least either their jury or here the public is going to wouldnt to see from him. Lets dig into why this is. Look at what mike lee did yesterday. A conservative republican. No one is suggesting he is withdrawing his membership in the apartment or endorsement of donald trump. He upended, and people at the white house very upset, rattled to use the term of the day, over him simply saying in public this is the worst military briefing i ever got. Li likewise, as they go into the trial, if one or two or three republican senators get anywhere near that language let alone voting to try to remove the president from office, that could really cut into him in a way that shows why mcconnell is concerned about holding every vote, whereas donald trump as always, or as we say in the newsroom, duh, is concerned about programming a reality show. Do you think those goals are at odds . Shoit shows donald trump sho not presume to know everything about his jury. Its not a jury he has necessarily in his pocket for every single vote. He may have a sense of what the outcome of the trial will be. The senators are not ones that are just going to go along, you know, hook, line, and sinker. They may push on things. Mig mitt romney may want to hear from wbss. Other senators may want to make sure this looks like a fair trial and not a sham trial here. But i dont think anyone should presume all of these senators are abouting it to fall into line here. I completely agree with that. I think that the president , he is trying to go for a low road approach versus mcconnell who wants a high road approach. He wants to defend the dignity of the senate, saying there is no circus in play here. He is weary of having jim jordan or doug collins in there. During the impeachment hearings most of the time the members of the minority were not speaking to the people in the room. They were speaking to fox news. They were speaking out to the audience. And rallying around these conspiracy theories that the president believes. They were speaking to the president himself.
