San francisco line of coalition. On the subject of the minutes, i was alerted to this issue by one of my fellow San Francisco coalition activists that unfortunately our comments were not reflected in the minutes from the last time september 15th. And these were important comments. This is not a vanity project for us and if we come every once in awhile to bring something to your attention it is something we home be of use to yourself and the public. The minutes are captured for the future user and future interested parties to look and see what was brought up and said. Usually the 2 minutes a lotted or 3 minutes goes over like 3 paragraphs or 2. How could my 2 minutes of comment capture in the the motion was not captured to vicks burg. The problem we had and brought up to your attention this was in the first time this happened and we would like our the motion to be captured in its entirety. What i referenced was the things that are very jermaine to the tenants and the situation in sb330. I would appreciate it if you would add what i made comments on the 15th. And also well bowen referenced the issue with the adus. Jerry referenced capturing the motion. So, on behalf of San Francisco coalition i appreciate if you go back and capture our comments were not examining every verb and sentence to be captainured but certainly we would like to see the essence of when we said to be captured for the public for public record. Thank you very much. Seeing no members of the public here requesting to speak well do to remote callers. When your sideline unmuted, begin speaking. Hello im [inaudible] and i the owner and ocpant of 45 brent are and like an opportunity to speak as my neighbor on the topic of the [inaudible]. We are concerned [inaudible] at least one private call and one private meeting directly with the apparently the meetings requested more information from the dr requestor. We were not pritow and not privy to. Feed on the communication with supervisor [inaudible] personnel or [inaudible]. More questions about the nature of the meeting it is alarming the private conversation were not disclosed at our before the hearing and not afforded the same opportunity. This raises ethical concern and believe we are never afforded due process on this matter. The City Attorneys good guidance is clear about the ethics in the commission. I when act nothing a quasi judicial capacity members of the commission [inaudible] must take care to ensurety parties [inaudible] due process. Due process requires fair [inaudible] free of bias. Numbers of commissions must have listen to the evidence before making decisions and base the decisions on the [inaudible] before them. [difficult to understand speaker, echo]. One Interested Party when the other party or parties are not present. It continues if the commission not adopted a rule with ex parte communication. Member when is elect to engage to the communication prior to the hearing disclose the substance of the communication on the record at the start of the public hearing. All we wanted was due process. I asked were we afforded it and impartial hearing on this matter. Does anything he said matter. The condition of the property. Designs. Tenant spchlt family needs and occupants needs. Is this action in the ethics code. Thank you for your time. Good afternoon. This is anatasia, and piggybacking on ha[inaudible] has said, about capturing things in the minutes i know that i used to participate in the bic meeting in the 90s and appreciated that the essense of what was said was captured in the minutes and that was a record that people could look at in case they did not attends the meeting and you know, i dont see that happening here at the Planning Commission. When we have 2 minuteses to speak it is the duty of the person listening the secretary to capture what has been said. Not just this. Boom. No. Get kernel the jist of what has been said. So that it is in the record. Thank you. Sdwroo last call for Public Comment on the minutes. Press star 3 if you are call nothing remote. If you are here, come forward. Seeing no requests to speak. Public ment is closed the minutes are before you. Is a late request to comment. Go ahead, please. Hi. [inaudible] neighbor in the area and i like to understand why due process is not provide in the this case. It seems like an overly aggressive implementation and has been for example, somebody can have a roof deck everybody around im trying to understand why due process is not followd and no implementation is discussed here. Thank you. Final last call for comment. Seeing no requests. Commissioners, Public Comment is closed on the minutes and they are before you. Commissioner imperial. To your next hearing october 6. Commissioner braun. Aye commissioner ruiz. Aye commissioner diamond. Aye imperial. Aye. Koppel. Aye tanner. Aye. And chair moore. Aye. That motion passes unanimously 7zero and under item 2, commission comments and questions. Commissioners i like to first of all see the full commission. Some of us have never met before and like to welcome commissioner tanner and braun. [spelling . ]. Great to be back here come almost being in a new room and new experience. Trying to make the bestment before we get in commissioners comments and call on fellow commissioners, join me in the land acknowledgment we read in the record every week. Ramaytush ohlone acknowledgement the Planning Commission acknowledges that we are on the unceded ancestral homeland of the Ramaytush Ohlone, who are the original inhabitants of the San Francisco peninsula. As the indigenous stewards of this land and in accordance with their traditions, the Ramaytush Ohlone have never ceded, lost, nor forgotten their responsibilities as the caretakers of this place, as well as for all peoples who reside in their traditional territory. As guests, we recognize that we benefit from living and working on their traditional homeland. We wish to pay our respects by acknowledging the ancestors, elders, and relatives of the Ramaytush Ohlone community and by affirming their sovereign rights as first peoples thank you. Commissioner tanner. Thank you. Did you want to Say Something. When you are done i have House Keeping items i want to address you on. Great. Im glad to be back here. Good to see everyone in person. Missed being here with you all. Excited be back and have a great robust agenda of matters to take up. An item that came up do you recall rules the discussion of the rule of the Commission Secretary and the commissioners and i wanted to state that we did talk about that role and so supervisor peskin asked for that. We had a conversation and i think it was helpful for both of us. Ment to commends for his work and service to the commission and i think it has been wonderful to have you shepherd us through uncharted territory. And i know you continue to serve United States and thank you for your service. Thats my comments on that i dont know if there are others who have comments, got to be back here secretary lonin, i had a conversation good understanding this ultimately the subtlety of words matter and we had ambigutey in the past motion making well Pay Attention we all agree on every word used to avoid confusion. We come from different back groundses and use language differently. That is for a motion basic semi legal statement a conclusion of the body we need to be as precise as possible it results from using the City Attorney and expressions to avoid or insert. Or pay tension to professional acronyms and words like architect terms. We will try and we have a good understanding to cooperatively work to bring that forward and avoid lengthy conversations, for long are unnecessary prolong our meetings. Im sure you would agree with what i said, secretary. I like to ask that am we please schedule for next meeting the election of offices. We need to elect a president. Im not sure it reaffirming the role of the Vice President but we need to elect a new president. If you could schedule that for next week secretary lonin, consensus from the commission . Seeing no opposition, i will schedule the election of officers for next weeks hearing. Thank you. Commissioner diamond. I wanted explain the use of the head set in case you wonder im not listen to music. Im hearing impaird and wear hearing aids and find the closed captioning to be delayed and not useful and i want to make sure im hearing everything that everybody has to say. I found that on zoom, the quality of the sound was so much better. And im work width Tech Department to try to come up with a solution in the hearing chambers that allows me to hear every word. We are trying a head set clip in the a loud speaker that allows the mics to be fed directly in my ears. And so far it is a big improvement. Thank you. Commissioner diamond. If there are no other commissioner comments, there is one more House Keeping item i wanted address the commission on. The castro theatre was scheduled come observe you next week we received a request to continue that item into december. And after conversations internally, we thought it might be prudent for us to sort of consolidate our resources and allow the public to make a single comment on one day and so what im asking, would you be available for a joint hearing with Historic Preservation commission at 10 a. M. On december eighth . I pulled the history irk preservation commissioners, we are able to have a quorum. They will have backtoback hearingos their regular day on wednesday and then join us here on thursday morning december 8 at 10 a. M. We do expect a very, very large number of speakers on that matter. I think the indication through the number of e mails we have been receiving associated with this project indicates strong low that a large number of people. To really prevents public to have to queue up twice in a row on 2 days we thought we may accommodate them and hold a joint hearing on that matter . And then we would set a time specific for your remainder calendar after that. We might bleed over but at least we could do that. So, if we can get a quorum for 10 a. M. And if we agree here to do that, we can get that going. That way the public will know as well. Do you want to nod for us or ask anybody individually. If anyone i think easy if someone said they cant make 10 a. M. On third degree december 8 that would be easy. If not i assume you all can. Okay. Fan testifyic. Thank you, commissioners. If there is no commission comments and questions item 3. Case 2021009977crv remote hearing adopt a resolution in the event none of you can appear in person we continue remote. Take Public Comment. Members of the public if you wish to comment come forward or press star 3. No requests. Public comment is closed. And this resolution is before you. Commissioners. Commissioner tanner . I support the resolution. I have a question i dont know if the staff or attorney aware regarding the state of california emergency Covid Response i think this is a great thing to go can we do this as long as we want or have there a larger state policy that would prevent us from continuing to adopt this resolution . Okay if no one knows im out of the loop that is happening policy wise regarding covid policies commissioner tanner. Great question. I have not looked at the bill since last year i will follow up on that. Great. Thank you very much. I make a motion to adopt the resolution. Second. Thank you on the motion to adopt the resolution. Commissioner braun aye ruiz. Aye. Diuponmonthold. Aye. Imperial aye. Commissioner koppel. Aye tanner. Aye. Chair moore. Aye. That motion passes upon 7zero and places us under item 4 directors announcements. No formal announcements welcome commissioner braunful happy to have you and welcome back commissioner tanner item 5. Review of past events of the board of supervisors and appeals. No Historic Preservation hearing yesterday. Good afternoon. Welcome back, everyone it is unusual to see you all here. So this week the finance committee was cancelled last week they did hold 1. First on left week was the tenderloin neon sign direct. You heard in item on august 25th and recommended recommendation with modifications more restrictive than existing regulations and allow legal neon signs to be physically renewd and returned for maintenance. Amend the code language to change projecting sign temperature is consistent and 4, Residential Hotels clarify the signs are identifying signs and projecting. All of your amendments were included in the revises version on september 12 and conditioned to september 19th. On the 19th, the revised ordinance was heard this time no commenters and the item was forwarded to the board as a committee report. Next supervisor waltons ordinance remove the industrial protection zones so pdr controls would govern the land use. Add social services and philanthropic uses. Ure heard this on march 24 of this year and voted recommend approval with modifications. That modification was to allow grandparenting claudz for self service if sillities this amendment was added the final ordinance at lands use. There was no Public Comment and it was forwarded to the full board. Last but not least the commission again considered, committee considered mandelmans ordinance. As you recall the mayor vetoed the original ordinance revocabularied all rh1 to 2 and allow 4 units and 6 on corner lots. This density exception came with limitations. Applicants had to have owned the property for 5 years before they could take advantage of the density bonus. It limited the number of Housing Units the city would get and issue the revocabularying from rh1 to 2 to avoid sb9 it would allow the same number of units as 9 without subdivision did not come with improvements. Project maximize density would be subject to section 315 in drs. Projects under sb9 would not. Planning staff and the commission recommend rezoning and include per nance to avoid section 317. Board dear not take this recommendation. Land use mandelman split his ordinance in 2 pieces. One to allow 4 plexes and one to allow the density one to allow up zoning from rh1 to rh2 and the Density Bonus Program in hopes it would receive voteo proof majority at the board. Added language to the ordinance finding expressing concern about development and discussed whether they should reduce the 5 Year Holding Period and the end it was continued to october third to allow for conversations on this point. Its the full board this week the tenderloin neon sign district ordinance by preston passed the second read and the designate nigz for the citys cemetery by melgar. Supervisor waltons lpz ordinance passed the first read and the mayors 2 appointments to Planning Commission rachael tan and Derrick Braun both were approved. Congratulations and welcome to you both. And last week the one item would be supervisor peskin extending his interim controls that would require projects in rcr districts to maximize density or receive cu authorization that concludes my report im happy to take questions. Seeing no questions from the commission. The board of appeals did
