The court is going to take the case up once again on tuesday. The ruling is expected sometime in june. Recent polling shows that half of americans now endorse the idea. About onethird say they oppose. None the less, it will be contentious. Joining us to talk about the details and what we can expect this week is kate. She is the Legal Council for lbgt rights. First of all, when the u. S. Supreme court shut down dome a, the defensive marriage act, they said it was unconstitutional. Gay marriages sky rocketed across the ups. Are they going to review now . Two questions before the Supreme Court right now. The first is whether or not its constitutional for states to not recognize samesex marriage. The second is whether its constitutional for the states to not recognize samesex marriages that have been performed legally in other states. Would you say this is a states rights issue facing off against the federal government . Some judges are saying, look, i know what the federal government says. I am going to instruct my people under me to do something differently. Is this basically on states rights . There is certainly people who would call this a states rights issue. There are certainly folks who feel strongly that because the voters of these states have passed these marriage bans, these constitutional bans, that those should stand. On the other hand, there are those and my organization is one of them who feel that the United States constitution protects people from faceing that kind of discrimination. K. So considering the decisions we have seen before from the Supreme Court on gay rights and other states rights casees is there any indication the way the court is going to go . This is something thats right in your field. Yeah. We feel very hopeful that the court will decide in favor of equality for everyone. There are obviously no guarantees. They are the Supreme Court and they get to decide what this he do. We are feeling hopeful we will have a ruling of Marriage Equality across the nation. There was a debate or speculation there could be a compromise. The compromise being that where legal where its legal to be married, gay couples to get married would stay that way and other states would have to recognize it. Sort of a compromise instead of making other states accept it. Is that likely do you think . I do not think it is likely. There are two questions in front of the Supreme Courtment and one of them is whether or not states have to recognize hurricanes that have been performed in other states. Its possible that the Supreme Court could say no, that the states dont have to recognize samesex marriages that have been legally performed in other states. Its unlikely. It would set up a untenable situation in terms of logistics . Exactly, of having samesex marriages recognize bid a state but not others could be very challenging. Thank you.
