Supreme Court has said that EWS quota does not violate basic structure.
Justice Trivedi said that if a time limit was prescribed for special provisions in respect of reservations under Article 15 and Article 16, it could lead to an egalitarian, casteless and classless society.
“It may be perceived as a first step in the process of doing away with caste-based reservation," Justice Pardiwala said while upholding the Constitution (103rd Amendment).
The 103rd Constitutional Amendment provides for reservation of 10 per cent seats in public and private educational institutions, and in public employment, for the “economically weaker sections” of citizens.
