that is tonight s the last word. the 11th hour with stephanie ruhle starts now. tonight, donald trump met his probation officer. we will look at a key step as sentencing approaches. the fate of hunter biden is in the hands of a delaware jury. nba legend steve kerr is here and why he speaking out about the stakes in the election as the 11th hour gets underway. good evening once again. we are 148 days away from election. today, one of the leading candidates for president met with his probation officer. donald trump brush off his guilty verdict set for a standard presentencing interview this afternoon, there was nothing standard about how this interview was held. trump got special permission to attend virtually from florida and to have his attorney todd blanche present. he s been complaining for months about it two tiered system of justice and he is right. is new public defenders pointed out today, most people do not get to login remotely from a resort in florida to talk to their probation officers. as for is what happens in these interviews, probation officers generally ask about financial resources, mental health, and any links to other convicted criminals. they also have to ask if you feel remorse for the crime you were convicted of. meanwhile, in delaware, the hunter biden firearms case went to the jury after both sides made closing arguments. hunter biden chose not to take the stand. here is ryan nobles with more. reporter: tonight, it s in the hands of the jury. six men and six women deliberating the fate of hunter biden, the first child of a sitting american president to be charged with a crime. many members of the first family in the courtroom throughout the trial. all of this is not evidence. gesturing around the courtroom and in the direction of first lady jill biden in the first row. people sitting in the gallery are not evidence he said adding no one is above the law. the special counsel s office use the president s son of lying on a federal back on check by checking the box claiming he was not an active drug user to purchase a gun. prosecutors used evidence from his laptop and called 10 witnesses, many describing hunter biden s frequent drug use including around the time he filled out the background check in october 2018. hunter biden s ex-wife testified she found drug paraphernalia inside his car in october 2018. his ex-girlfriend who was dating him at the same time singing hunter was smoking crack every 20 minutes or so. the evidence was personal. it was ugly. it was overwhelming he told the jury today. it was also absolutely necessary. defense attorney abbe lowell argued they focus too much on his drug abuse over a four year period and saying no one witnessed actual drug use during the window of time he purchased the gun. with that, let s do smarter with the help of our leadoff panel. pulitzer prize for investigative reporter with the washington post sam stein acerra veteran federal journalist and white house editor for political and a neighbor of carol. former new york prosecutor and civil rights attorney charles coleman jr. is here. you know it s a big night so you get first crack. donald trump met with his probation officer. help us understand the purpose of these interviews and how do they go and what do we know about what was asked in this one? when your probation officer will ask you questions, what they re trying to understand is what your setup is around your life. how do you live. what your financial resources are and what would be the impact of a particular sentence of a judge decides to send you to jail. are there people who depend on you? are you associating with other criminals which we know in the case of donald trump, he is. we could go down the long list. steve bannon, roger stone, michael flynn, the list goes on and on. one of the things a probation officer is looking to ascertain, and you talked about this, is whether you have any understanding and/or appreciation for the crime you re actually committed up. i think donald trump has a difficult tightrope when it comes to everything he said in the public around this persecution rather than what he knows is actually in the prosecution by the das office, and that will be something that will be hard to get around. the probation report is going to be something the judge takes into account when they make their decision around what sentence they ultimate ultimately oppose. they will make the recommendation and trump s attorneys will argue for as lenient of a sentence as possible. sam, donald trump has been arguing for months and months that there s a two cheered data tiered justice system and its benefiting him. he got to meet virtually with his probation officer. his lawyer was there and when he speaks at his rallies he s always saying i am doing this for you. i am standing here for you. but any trump supporters were in his position, they would not get the special privileges. why do they keep buying this? you are right. when you think back to the gag order that was imposed on trump at various points in the criminal case, that was almost done with reluctance compared to what it would ve been for any other person in the justice system. obviously, donald trump is a unique person in the justice system that he s running for president currently. it makes sense that some leeway is given to him. the justice system works in his favor and i would argue the second story, hunter biden s story, it is not a justice system. the presidents own department of justice is bringing a case against his son. if there was a thumb on the scale of the justice system on the part of president biden, one thing he would do it to alleviate the burdens on his son and maybe let it go away and the president sat back and watched this progress to the point where we will probably get a verdict in the next day or so. carol, get it s been a crazy last eight years and people have become desensitized. it is not even remotely normal for the presumptive gop nominee to be meeting with his probation officer. what is your reaction to this extraordinary moment in american history? i ve thought a lot about that and how numb the country has become to everything that we have watched in the last eight years. nobody can forget and yet we almost act like it was no big deal when then republican nominee for president, donald trump, was caught on live tape talking about grabbing women in the using a course word and saying he could get away with it because he was a celebrity. starting then and continuing on, it was like a starting gun of every other week, every other two weeks, revelations about donald trump as candidate and as president that made us all gasp and wonder, can he survive this? donald trump is the republican nominee for president again. he is the front runner in this race by many polls, and he is a felon who has been convicted of 34 counts of crimes in the state of new york. the city and the town, where he once ruled. all of us are like, oh, yeah, that s how it is. that s sort of the standard now for the last eight years. it s important for us all to step back and remember that no president and no former president has ever been charged with a crime and now we have one who has been convicted and is seeking to return to the white house. charles, an appellate lawyer wrote that donald trump s chances of winning an appeal are pretty slim. what do you think? i think so. when you talk about what it is to appeal a jury verdict, the first thing people need to understand its an rare occurrence that the system will look at the decision that is made by our constitution where you get a chance to have your case heard in front of a jury of your peers, which donald trump did, and override that decision absent some extreme miscalculation by the judge or extreme actions by one of the attorneys. judge merchan does not get enough credit for the way he ran this trial. i think he was aware that all eyes needed to be dotted and all his teas needed to be crossed and that s why he did on such a run such a tight ship to make sure there were as few issues for appeal as possible. that doesn t mean donald trump s attorneys won t seek to find an issue but the likelihood of being successful is slim to none. sam, dal bragg says he will testify before the house about the trump case but most likely not until after donald trump gets sentenced. he knows what he is going to face with house republicans. how do you think he will handle this? i mean, we knew the house republicans were going to do this. they signaled they want to protect donald trump and want to go after the prosecution. there has been overtures they want to defund jack smith for instance. bringing alvin bragg to the hill is something we should ve expected a long time ago. i m surprised they didn t push harder prior to this. i would point to the fact that a jury trumps peers made the determination he was guilty of 34 counts. that s the aspect of the american justice system that trump was right to defense and he was given defense. there will be questions about, who was on his team and funding them? what it comes down to is this is how the american justice system is designed to work. trump at his day in court and had his defense. that is that. the decision was made by a jury of 12 and you have to live with it that s what we do. charles, let s shift to what sam was talking about. the hunter biden case. what did you make of both sides, closing arguments, and hunter not taking the stand? it didn t surprise me that hunter biden did not take the stand for a number of reasons. number 1 comments difficult for hunter biden to give testimony in any way that will try to exonerate him or at least defend against those charges without either incriminating him or at least admitting publicly about his substance abuse. i think that is something he wanted to avoid. i think his team wanted to avoid that and if you are looking at this, it s something that would not of been well for the biden administration to have in the headlines. not that that has an impact on hunter s actual case or charges per se, but i think it was part of the calculus here. with respect to what you heard from the prosecution, this was straightforward. many legal experts myself included understand that when the special prosecutor on the case that joe biden allowed to stay on the case brought the charges, that is, if anything that we ve seen recently is a mass political prosecution we have seen. i say that because for these federal charges to be brought, you typically don t see that absent some additional violent events involving the actual handgun or the weapon that is in question. that s not the case here. hunter biden is not charged with that because we don t have those facts. robert hur decided to bring the charges against hunter biden and the case for the prosecution is relatively straightforward. none of this surprises me. what the defense did a closing argument is you work with the facts you have. they don t have gray facts so they have to call into question the time line. i don t know if that will be enough for a jury to either acquit him or result in a mistrial. sam, the president has already said he will not pardon his son. if he is found guilty, he could be taken into custody . how is the administration, campaign, going to react to this? they have been hands-off about a. they are not hiding the fact this is taking an emotional cole, mental pool, on the president. he is a there. when you ask about present enough, they are hands off. there s discomfort in the white house to even talk about the issue with the president himself. he does not want to discuss it. it s not that he doesn t think it s a political fallout but it s too raw for him. the question, will republicans tried to capitalize on a guilty verdict, and if so, what manifestation? we have a debate coming up. it s not beyond the realm that donald trump will not try to use something during the debate and what we ve been surprised to see is how little republicans are talking about the hunter biden trial including trump himself. it doesn t come up that much. it used to be a topic of discussion but not recently. you wonder if that s because they don t want to draw attention to trump s own legal mishaps or tested it out and realize there might be boomerang effect where people are sympathetic or empathetic to joe biden if you go after his son, part of what the issue is, issue of addiction. carol, no topic. your paper, the washington post , has this story out over the weekend about the trump ally with a quote post constitutional vision for a second term. the man s name is russell, what can you tell us about this? beth reinhard on our national investigative team for this great reporting that presages the future and right donald trump presidency. the kinds of people he is entrusting to make the plans for his new administration. he was a deputy omb director and had been in congress as a staffer for a long time and other federal agencies. he knows his way around the legislative and the executive parts of our government. he is using that knowledge to broadly expand the powers of the executive, if trump takes office. to the point of saying he will find a way for the justice department to prosecute and imprison those who he feels is wrongly gone after the president in the past including journalists. that includes political figures think the biden family members. he has said rather he is said to confidantes that he would work very hard to loosen the military s ability to take action at the president s command to stop protests that are against the president. to interfere perhaps in elections. the military would be an entity the president could send it to domestic situations and something we have avoided ever since the horrors of kent state for example. it s a person who believes in the unitarian executive theory but is proposing things behind closed doors. he may end up being the chief of staff for the president. he is proposing things that send a chill up the spine of those who really study democracy and its norms. here s my head scratcher. there s a lot of conservatives who say they do not like trump what they like his policies. these are the same people who are all about small government with limited power. this, this man and this plan. isn t that the complete opposite of small government, limited power? this is big government with ultimate power. well, i think one thing you have highlighted on your program consistently, if i can give you a hat tip, is the idea of the hypocrisy. the republican party for as long as i have been a reporter which i m embarrassed to tell you how long it has been, has always been about criminal justice and serious tough law enforcement. it s been the party of being concerned about foreign adversaries, rough it russia chief among them but that s all out the window now with trump as president. putin is a great guy and the new republican party. he is a fan of donald trump therefore he is awesome. getting tough on criminals? obviously, it s been nine months and these american hostages have been there the entire time. the american government has deferred to the israeli government when it comes to dealing with the hostages. they have dual citizenship and israel is on the ground and united states is not. it suggests an in patients with the biden administration that its own hostage, american hostages, remain in limbo while netanyahu and hamas remain at odds over the cease-fire proposal. you heard secretary blank and say that it s hamas that has yet to accept this proposal. i think that s important point they want to make that israel has agreed to this despite the public ambiguity. right now, they re frustrated it s taking so long and seems to not be heading toward a conclusion and they seem to be willing to think of ways to get the americans at this point out if there s a way to do it. president biden is not the only one expressing frustration. benny gantz just resigned from israel s work cabinet saying it s a prime minister and he is standing in the way a real victory. what does that signal to you about the state of the war effort and prospects for new elections over there? it s a big deal and it s been remarkable to work cabinet has hung together as long as it did. benny gantz has run against netanyahu multiple times and the idea they sat together in this work cabinet is a remarkable situation. it s hard to imagine joe biden and donald trump sitting together in a unity government. at this point, he s decided enough is enough and it s not working. the prime minister netanyahu is an obstacle toward a resolution to the conflict rather than a leader. that puts netanyahu in an awkward position but it may require him to rely even more so on his far right-wing coalition to stay in power. he has to appeal to the parts of his coalition that he himself might affect comfortable in order to keep his majority they can avoid further elections. we will have to see where it leads. there s not much chance or at least not a lot of optimism for prime minister netanyahu they could win another election but he s been an enduring figure for a long time and israeli politics. let s stick with the right wing and change locations. you were just in france and when president biden was there, he spent a lot of time trying to reassure nato allies who are nervous about a second trump term. i want to know how his message was received and we keep hearing about our european allies, worried about trump, but there were a bunch of elections that took place last week in europe and they were big winds for the far right. it s not just a u.s. issue but it s happening over there as well. it s not just a u.s. issue. the european elections on sunday were a remarkable shift in power toward the right. you saw macron of france who host a president biden the night before at the state dinner where they held hands and effect in favor of establishment politics, and also rock that he s calling new elections in france himself to see if he cannot win over his own public where he is not very popular re-there. these guys will get together in italy at a g7 meeting and they will talk about these issues like gaza, ukraine, do. president biden has a low approval rating, his at home is higher than some of the other leaders who will be at the summit. there s a time when the establishment politicians of the major industrial powers are on their back heels a little bit amid this right-wing populism we are seeing in europe and the united states. peter, you always make a smarter. thank you for being here. when we come back, stubborn polls and has the biden campaign getting a read data revving up the race in the 11th hour. hour. if you re one of the millions of people with diabetes who suffer from low and high blood sugar, dexcom g7 is one of the easiest ways to take better control of your diabetes. my blood sugar would suddenly spike or really go low out of nowhere. it was really scary. i think it is smart. reach people where they are. people are getting their news from less traditional outlets and people are watching the news less frequently anyway and people are checking out. it s smart to reach these people where they are and find them where they are not paying attention to the more traditional issues. the biden campaign recognizes whatever it has to do as we head toward crunch time. this is not just about his base. it s nikki haley voters, independence, and never trumper s. the people who could make or break the election which is currently by a lot of polls in a dead heat while press former president trump is not looking beyond his base. will this work for biden? well, yeah, he has to look beyond the base. that s where the election will be decided. i remember when the bush campaign was in trouble in 2000. we had to do a reset and we got pushed into it. we didn t want to do it and ultimately we decided we needed to because we had to. part of it was making changes but a big part is doing a reset for the press and the larger public to say, we heard the message. we are doing things differently. it makes sense practically speaking and make sense of the speaking that you are sending a message that you heard the message and we are doing things differently. in this campaign, it s so razor thin that biden has to do everything right and this is one of them. this is good. one of the things he needs to do is turn up the volume on the things donald trump is saying. they are seizing on some of the comments that trump made it his nevada rally this weekend. i will share a bit. you feel that? i don t want anybody going we need every vote. i just want your vote. i don t care about you. what i just heard him say, i don t care about you. i just want your vote. did the rally attendees here this? what? did they hear that? they have selective hearing. donald trump can say anything on god s green earth and they will cheer on cue. it s important that americans more broadly here it because that s him giving the game away. he doesn t care about anybody. trump s only goal is to keep himself out of prison. to make prosecutions against them go away. he has brought forward no plans to lower costs. nothing to lower health care costs. nothing to increase the amount of jobs. he has no plans for housing or inflation. his campaign is predicated on keeping himself out of prison, out of the courtrooms, and making the cases go away. and a revenge tour against the people who deign to hold him accountable for his crimes. it s a rare instance, less rare these days because he has a proclivity to see the quiet part out loud. he is saying it. if you want an example of someone who treats supporters with nothing but contempt, it someone like donald trump standing there on that stage and basically telling them what he thinks about them. what i like to hear about is the truth mark and billions of dollars in infrastructure funding has made its way across the country thanks to president biden s massive infrastructure bill now law. suddenly, we are seeing some house republicans taking credit for these jobs that were created but for facts say, the same republicans voted against the bill. to their constituents who might not pay attention to traditional politics or watch the news, do they know the new truth? these guys are taking credit for things they voted against. they are not going to hear the truth. let me make another point on the las vegas speech and the ad. there is another ad i think the biden campaign which is the best of the campaign which is donald trump in his voice talking about veterans. i think they should leave that up through election day. it s spectacularly good and impactful. trump has been complaining about it and we call that as hit dogs barking. you know he s feeling the pain so it is working. as a former ad guy, the most effective thing you can do is not say what you think the person said but let them say what they said themselves. it is great. brian, i want to go back to the infrastructure point. if you the biden campaign are running and local elections, what do you do about the fact that you have some house republicans patting themselves on the back, taking credit for passing things they voted against? i think they done an effective job at exposing these people. biden said it out loud when he was in lauren boebert s district that she tried to take credit for the infrastructure plan. it s getting into these districts and doing the side-by- side. the media has been great about showing side by sides where it s donald trump railing against toilets not flushing and trying to keep himself out of prison and biden talking about $35 inhalers. $35 insulin and $2000 a month health care plans and things that will impact regular people. they been good about that side- by-side but it s getting out there and hammering the message over and over and over again. they often say what is the one thing that a politician did to change your life or help you in some way? it s clear that president biden is interested in implementing gun safety measures. common sense gun violence prevention measures. i have been doing a lot of work the last 10 years with a lot of different gun safety prevention people like brady, giffords, sandy hook promise, march for our lives. i have learned so much and i know we can prevent lives. president biden is adamant that he is going to push for commonsense laws that can do that. i know trump will not do that, and so it s a simple choice for me. are you voting for joe biden against donald trump? i am voting for joe biden. i think the biggest thing for me, everybody needs to vote their conscience. i am voting on a few issues, but this is the main one. i lost my father to gun violence when i was 18 years old so i know how much pain people go through every single day in this country. i know gun violence is the number 1 killer of children in america. i know there is so much we can do about this. i think most people out there agree with me whether you are republican or democrat. 80% of people in this country want universal background checks , doesn t matter your political affiliation. we can do this but we have to steer the cruise ship. it will take time. we need to implement laws that the vast majority of our country want and president biden is willing to do the work to try to get those changes. you have said in the past that before you lost your father, as you said when you were only 18, you felt her life was impenetrable. nothing could get you down and bad things did not happen to you. what do you say to the folks out there who thinks gun violence is a problem but it will not affect their life so they don t make it a voting priority. you just don t know. it s such a common occurrence. the chances are likely that you will not be impacted, but there s a good chance that you will also. that is a scary thought. i have a granddaughter who is 18 months old. i am thinking about when she goes to kindergarten and she will have to go through mass shooting drills, and the trauma the kids all across america go through just from those drills and the possibility of facing that kind of situation. it is so traumatizing, and it s a terrible thought that all our children are feeling this way. again, we know that comm laws save lies. they absolutely do. there s so much we can do and it s my civic project that i like to work on is trying to help get, as i said, the ship moving. it will take a lot of work. it s up to us as private citizens to insist the government take the necessary moves to make that happen. there s a lot of public figures who share your views. many did endorse president biden in 2020, but many are staying quiet now. expressing public views right now is getting more and more difficult. the backlash is real. this is not going to be easy for you and you will get heat by all sorts of people. why did you decide to speak out? it s too important to save lives and it s important to do something that s important for our country. not that i can do anything by myself, but i do have a platform. if i can get the message out there, it is so important for families to talk about this issue. neighbors, friends, this is not an attack on the second amendment. this is about implementing things that can save lives. again, it could be your own child. your own mother or father, could be you. we have to understand the gravity of gun violence in our country and not just pass it off as this is the price of freedom. that s what a lot of people say. we have to have the freedom that the second amendment provides us, but it should be kids able to go to school and not being afraid. there are ways to do this. we can protect the second amendment and protects citizens with simple laws. we just have to get everybody on board. it is such a political hot button but it s not a common thought in our country that this is a controversial issue. it is not. 80% of people want universal background checks. we should have that, and that alone would save hundreds if not thousands of lives every year in america. you said it right there. it s a political hot button but not when you go in people s homes and use it other tables and talk about what matters to them. i do want to talk about something else that matters to you that you know a lot about and that s obviously basketball. you played with michael jordan. you know how this superstar was treated early, and the attention he got. given your first-hand knowledge, what do you think of caitlin clark s treatment so far in the wnba? i think it is a rite of passage for young players whether the wnba or nba. other players will test you. she reminds me a lot of steph curry. a lot of people may not remember this but in his first couple of years he was not a superstar. he is not who he is now. he had to get stronger and had to understand people were coming after him. that is what is happening with caitlin right now . it s all in the name of competition. she is handling herself beautifully. she is an amazing player but like every college player who comes in, it takes time and they ve got to get stronger and more used to the contact, physicality and athleticism. she will be fine and everything she s going through now is part of being a pro. what do you think of the fact she won t be at the olympics? what s your reaction is a impudence to the sacrifice of many of the officers who risk at all to defend those electoral facial from the both parties we will protecting both nancy pelosi and kevin mccarthy the same thing. same way. we protect chuck schumer s much mechano and all the electrification from both party regardless of how political views. so we were actually doing our job and to hear those type of connotations coming from the foreign president is a desecration to a service we of officer who validly and bailey, definitely the kaprow a day. yeah. i mean, certainly going to you and i ve talked about this. i mean, one of the things that worries me about january 6 is that people are just sort of erasing it from their memories there s a lot of talk about whether we have trump amnesia going on. it sounds like there s a little bit of trump acceptance in january 6 upset acceptance what do you think is going on? why do you think there are people who go out to these rallies and applaud and shear when they hear him call people hostages. and in this case, warriors i mean, it s these are the same people that claim to be supported. the police officers. but yet they don t see us. the capitol police and metropolitan police those who defend the capital and our democracy on, that day as such they see us as an impediment to what they set out themselves to do, which was overthrown the world of people on jeremy six. and part of, part of that is the same people who we protect it. they had sided with the what the talking points, the foreign presence says that nothing happened if it did something did happen is not as bad as we say, but on jeremy six, there were scared. so scale of the mob that they ran for further live in fear. and that s unfortunate because he s talked about pardoning. yes some of these folks, all of them, i think what do you say about that? i mean, it s it s very unfortunate. again, we protected both parties the same. we were actually doing our job and those people who are in jail right now has been converted. i have been processed through the court system some of them today we re on trial and they were found guilty in a later date. they re going to be sentenced and some of the same people who assaulted me personally i ve gone through core multiple times, 23 so far and two weeks ago, one of them got 14 years for assault, multiple officers at the same time these are the type of people that he says that he s going to pardon rising up, telling them they are hostile years political prisoners and who are we the officers to them yeah. well, i think one of the things that is really disturbing about him referring to these individuals as warriors is it s almost as it sounds like he s thinking he sending these people into battle. well than sending them off to war against fellow americans. exactly. and that s the other thing is like he says, i think the same statement that it was oh, i set up well, who invoke them? to be there? the kaprow in the first place it wasn t capitol police. it wasn t metropolitan police. it was in the sayyed arms or anything like that jerry six wouldn t happen if he had not told those people in the middle of december 2020 to be at the end the capital for jeremy six, because i worked several chamfer power situation anyway, know that that was happening. that event was the last point of certification. i didn t know that. but i doubt that majority of the people in the american people knew that at all follower knew that onto he said such thing to bring him to invoke them, to come here to the capital four general six. well, certainly going now we cannot ever thank you enough for your bravery. what you did on january of six, what s your fellow officers? people like mike for now and harry dunn? we ve talked to them so many times over the year, over the years i really appreciate what you did that day. thank you so much. we can t forget and i know you and i were talking about this before the segment. you d like to see a plaque hanging in that tunnel at the capital that you and others defended that day, just so there is this recognition? correct. and this is something that was passed into law two years ago republican speaker of the house, mike johnson, continued to hold that plaque. approval in committee. and i want that plaque to be put in place for the next president, future president, to say. so they could see how a group officer, the name, read the names of the authors who risk at all to preserve our democracy and a day and very shameful for them to continue to hold it up. the same way that they say that they claim to be supported the police. but yet well, another thing that happened was somebody police officers, the capitol police union put a a proposal for two count some of the overtime service that they had done since january 6, to count tours, their retirement and republican on the senate, they blocked. all right we re going to continue to follow that as well. we ll stay on top of it. certainly can now great to see you. thanks for having so much today, donald trump clearing a hurdle on his way to being sentenced in new york city. he took part in a court-mandated pre-sentencing interview with a probational officer. normally they are done in person, but trump attended at virtually from florida, were told that took less than 30 minutes at a source told us that trump answered all the questions he was described as accommodating, respectful, and polite. that s quoting from that source, the probation department did not rule out the possibility of a follow-up meeting before his july 11 sentencing for falsifying business records and joining me now to talk about this, cnn legal commentator and former trump attorney chimp tim parlatore. and former commissioner of new york city s department of probation, martin horn. gentlemen, thanks for being with us late on this monday night. appreciate it, martin. this was bit of an unprecedented meeting today. a walk us through the kind of questions that the former president was likely asked well, he was sure asked to give his version of the offense. he was confronted with the charge against him and asked for his side of the story he was given an opportunity to put forth any mitigating factors that the judge should take into account in imposing sentencing. and i m sure or at least he was supposed to have been asked about his family situation is financial situation his education is employment history whether or not he s had any physical or mental issues that would interfere with his ability to support himself and i m sure that he answered them in a way that was favorable to himself yeah. and tim, 30 minutes. that seems kinda brief why do you suppose that is? well, the new york state presents interviews are much less involved than the federal ones. and so in particular, when you have a case like this where a defendant has been convicted after trial, but they do intend to appeal. they retain their fifth amendment rights through that those appeals. so i have no doubt that his attorneys advised him don t answer any questions regarding the offense and probably hold the probation officer look, he s invoking his fifth amendment. see, you can skip that part of the interview and just go straight to family history and things like that that really shortens the process. and martin, how much will the judge judge merchan take all of this into account hard to say. certainly this judge knows this defendants it s rare in new york for there to be situation where the defendant has been found guilty by a verdict at trial 95% of the findings of guilt or the result of a plea deal where the sentence has already been negotiated. so this is relatively rare, but again there may be factors that a defendant would want to bring to the judge s attention that has not previously been known. and remember, this interview is confidential, so it s an opportunity for the defendants to share with the judge mitigating factors that he or she might not i want to share with the general public and tim, what about all the comments that trump made outside the courtroom where he railed against the judge, blamed president biden for the prosecution, doesn t that get taken into consideration? and i have to ask you when here from sources that trump was bribed as a polite and cooperative sort of thing that doesn t sound like the donald trump that we saw outside the courtroom during the course of that trial. what do you make that? distinction there? for one thing, when he s outside of the courtroom in front of the cameras, he is both defendant trump, but he s also candidate trump. he s definitely playing it up for the purposes of the campaign. whereas he doesn t have to do that behind closed doors with a probation officer, a lot of the things that he said during those press conferences wouldn t be relevant at all. yeah. to this interview. so in fact, i m sure that todd blanche said we re not answering any questions about his opinions about the judge or anything like that. let s just stick to his history. and so to the extent that they re asking him questions about his family history is education is business history? i think that that s something that he would be very very common, very accommodating on. so i don t it doesn t surprise me at all, given the narrow scope of what they would be talking about. all right. will martin, tim? i mean, he s he s basically saying we can t compromise, won one side or the other is going to win here. is that, is that how a supreme court justice should know? i mean, it would seem to me that supreme court justices, when they deliver eight, they compromise all the time as they should. and i think his comments, when contrasted two chief justice roberts are unmeasured. roberts was very careful in how he responded. these types of leading questions and, you know, alito was just at the very least, very sloppy in his answers, but i don t know that it revealed a lot other than the fact that justice alito has a very conservative viewpoint that came across, but he shouldn t be. necessarily articulating it in the manner he he just did. yeah, maria, this filmmaker, laura in windsor, we should though, she s the one who went out and did this she went on to say this to justice alito. we put it up on screen people in this country who believe in god have got to keep fighting for that, to return our country to a place of godliness to that justice alito replied, i agree with you. i agree with you. now, again, she was posing as somebody who was supportive of him and but she was able to extract some very notable comments and pretty remarkable comments. it is disturbing on so many levels because he is in a position we already saw what he did. he was the one who wrote the argument that got rid of roe v. wade. and he used in at some arcane 18th century law that essentially said that women should be subservient, that we don t have the ability to make these decisions. and what he just said to ms windsor i mean, it reminded me of i don t know if you all have washed your feet. audience has watched handmade, stale yeah. that was gilead but he was described as one thing i was terrifying. there s one thing i wanted to talk about and i don t want to jam the segment because there s other stuff i want to get to, but what s fascinating about this audio of sam alito is in charlie, you know this from these confirmation hearings that make headlines up on capitol in the senate when supreme court justices go through that process there, so choreograph there, so scripted they re told what to say, what not to say, and they re very careful and answering all these questions here is just like a few minutes of audio. got probably more candor from justice alito that we got during the confirmation process. yeah. i was just shocked by how unguarded he was. yeah again, these you re right. you ve watched these confirmation hearings and they are so scripted, they are so careful not to say anything that might impact how they would have to rule on some matter before them in this case? you just do that all away he thought he was just talking to a friendly audience here and was surprised by the by the recording. but again he s gotten himself in trouble for a number of reasons now, just because he s not careful. yeah. marie, i do want to ask you about this. there s new video tonight of rudy giuliani speaking at a christian event at a church where he speaks in very derogatory terms about the fulton county attorney, fani willis. let s listen to this then. i ve got to prosecutors. sandi the whole i mean, you know wow. america s mayor, ladies and gentlemen, that well, yeah. i mean, once upon a time. yeah. i mean it s almost unfortunate to even bring this up because obviously it s just a horrendous thing to say. but i mean, it also speaks at what in the world has happened to read giuliani the fall from grace was fast and furious and it you know, talking to so many people who used to work with him and know him. they don t know who this person is. they don t know who that man. i ve known this guy for over 25 years and i don t know that could all i don t recognize them. it sad. this is a man who was, he was pro-choice on abortion. he was pro gay rights and but he got swept up with all this. trump s stuff and you just can t is it something about there are so many of them. they just feel like they have to slothouber all over donald. it s like it s it s cultish is held. but it s also kind of want to be relevant to add and pathetic, like kinda hanging on kinda clam and he s getting older. you want to be relevant, you want to be in the conversation. and so you go down this row, you don t want to just be the guy that goes to denny s for the grand slam special. you want to still be invited to speak at events and stuff. i don t almost wonder if there s any sort of mental decline there because he had he s commanded such respect at one point in his life. is this all worth it now, like is this the legacy? i mean, a lot of people have sympathy for folks who were battling drug addiction in the prosecution kind of going after hunter biden on addiction in that way could backfire with at least a couple of the jurors in a way that might. not bode well for the prosecution i think you can. i mean, it s something that we saw during the trial with jurors reacting to this they ve made him a sympathetic character, which is not something the prosecution normally, once do something also that they didn t really address so much during closing arguments, but i think that may affect the jurors is if you hit him so hard on his drug use do you undermine his ability to really think through and form the requisite criminal intent. so i do think that that could be something that would backfire. yeah. and perry, the prosecution during one moment, pointed to the three rows and the courtroom taken by the biden family biden supporters, including the first lady, saying that people sitting in the gallery are not evidence in the case, do we know how that played with the jury? and i mean, obviously that goes without saying, but how did that go over in the courtroom? yeah i mean, we don t write we don t know, but obviously the fact that prosecutors did that to me suggests that they feel at least that having the first lady right? the first lady always a pretty popular figure. jill biden is a popular figure, so they obviously were at least fearful of how that would play with the jury, right? this is a pretty remarkable thing. he s the charges themselves aren t the case is not it s a gun case, but the fact that you have the first lady, this this man s mom sitting there every day of the trial and it wasn t just her. i mean, this is, a jury of dealt people from delaware, wilmington city council person, a very popular are from what i understand a well-known pastor and wilmington as that first, there were lots of people that the jury could recognize and people do this all the time. obviously, they re there for support for hunter biden, but i don t know what the family exactly was thinking, but in lots of defendant s bring family with them, people that know them to show that the jury that they are loved supported person have people that early think they re good members good yeah. and tim, i was wondering about i ve been wondering about this the entire trial, whether or not the biden family s trying to send the message to the jury to the judge, to the courtroom. this is a personal matter this is a biden family matter what did you make of the family being there in the first lady i mean, being there throughout this case. i mean, it s certainly is a lot more sympathetic than back when i used to represent wise guys with their families there are but i think it is one the trump case. i mean, you saw some family members were there somewhere? captivity. among those rescued 26-year-old noa argamani, who is abduction during the october 7 attack was captured on tape. noa screamed for help as she was forced by hamas members onto the back of a motorcycle. and driven into gaza. the idf raid also resulting in the deadliest day of the war in six months. at least 274 people killed according to gazan health officials the idf disputes those numbers, saying that the number of casualties was under 100 cnn cannot independently verify the death toll and we don t yet know how many of those killed were hamas fighters and how many were civilians. but we do know that the hostages were being held in residential homes in a densely populated area cnn also learning this morning that some idf soldiers disguise themselves as hamas fighters folks just tuning in after the weekend. a very dramatic time for the israelis here at with this raid. how do you see the fallout here as we see these hostages reunited with their families, but we also try to figure out to count the dead among the palestinians good morning, casey. and i think you ve captured it right? it was an incredibly dramatic weekend. and i think there are three salient points about the rescue. the first is the operation itself was a miracle of terrific intelligence, great covert work, and getting in there and getting them out. then certainly something to be celebrated. there are more than 100 hostages left, but this was clearly a big win on saturday morning when when this all took place. the second is at once again, it came at a great human cost as many israeli operations in gaza have and this is the sort of brutal calculus of this, which is maybe it was under 100 pounds justinian s dead. maybe it was over 200 is a palestinian say, but the fact of the matter is that we saw a huge number of palestinian deaths in order to accomplish the long-sought release of these four and that seems to sum up much of what s happened during the war. i think the third thing snap elections situ in situation. one like it is a situation to which i cannot resign myself. the rise of nationalists and demagogues is a danger not only for our nation but also for our europe and for francis place in europe and the world. they don t all right, joining us now is cn an international anchor, max foster who joins us now, live from london max, good morning to you. this is a bit of a complicated situation for folks in the us who don t necessarily follow the ins and outs of the european parliamentary elections. but big picture is that we have seen kind of a across the continent these far right parties surging in a way that has really concerned the sort of center right? majority governing parties. and it so much so that you saw emmanuel macron take this pretty significant action. it s a risk for him to do this. why is he doing it and how does it help explain the big picture of what we re seeing here? hi, a lot of people quite baffled because off the back of a european election where in france at least the far-right, did extremely well he s now going into another election. he called it and it s going to benefit the right. many would argue because they can ride on that momentum, but he is effectively saying he wants to hand it over to the french people who he believes are generally moderate. and of his point of view. so he can prove that the european election, which is often a protest vote for european voters, won t actually hold in a national election. so a massive risk, and i think even the people closest to them realize that, but we ll see he, how marine le pen does out of that steadily over recent years she s been increasing in authority and power and she s doing what many of the european parties are doing, which is focusing on immigration. and ukraine and also environment. but on this basis that really resonates with a lot of people, which is that the cost of living is getting worse and worse inflation s going up. we can not afford to do all of those things. we have to hunker down a look at nationalism. and i think if you look at the overall parliamentary picture, then the moderate still hold it. but in the key country, the big economies, france, germany, and italy, the far right? excelled. so it s going to have a huge influence. yeah, we can put up on the screen for people to kind of see in color the way that this broke down in france. so let s set aside the yellow that s other, but that red piece which is clearly the most significant one for a named party, is the national all rally. those are the right wingers that 15% purple that you see the renaissance party, purple, blue. that s macron s party. and max, to be clear, we saw something similar play out in germany and in italy can you talk a little bit about how this strengthens the more right-leaning leaders who are in office in europe well you know, it s already got a right-wing prime minister. so she s empowered and marine le pen, as i say, he s been climbing steadily in germany. a lot of people would view that party. now the second most powerful party in the country as traditionally a very far right party. so it has huge influence because germany and france and italy are the three countries that have most influence over the european union i was interviewing a us expert based here in the. uk earlier on, and she was talking about how this will empower trump effectively. a lot of the wright was rising in europe before trump, but chump managed to popularize a messaging and they ve adopted a lot of that. so he certainly added energy to the rise of the right here in europe and it also means that the more senior these right-wing politicians become, the more contacts and power he has within europe. so it s very empowering to him and his foreign policy. he creates alliances specifically for him within countries which were traditionally us allies. so it has a it will have a big impact on trump if he gets into power and it will cause a problem for biden if it gets into power bi, it s going to be much less supportive of him and his policies going forward. yeah it s an interesting way to think about it. and i also think one of the things that donald trump has done that we remark on it, but i think perhaps not enough. and that is to normalize things that previously were considered out of bounds. and the politics and the way we re thinking about politics. and you can really see that in some of these right-wing up pushes, bringing things in that previously were considered to be verboten are not acceptable on our stages. max israeli military appears to show helmet camera from israeli soldiers coming under fire while rescuing those hostages. one resident of a refugee camp in gaza claims he saw special forces with the israeli military disguise themselves as hamas fighters. and palestinian civilians during the operation the operation did come at a great human cost. scores of palestinians dead, just how many? we don t know. gaza s health ministry says the numbers, at least 274. israel says it s fewer than 100. i am joined now by joel rubin. he is the former deputy assistant secretary of state in the obama white house. joel, good morning to you. wonderful to see you this morning let s start with the raid for people who are two doubt on a summer weekend, just waking up to this news, these four hostages rescued this clearly was something that i mean israeli families of hostages have been increasingly more and more upset about the fact that their loved ones have remained in captivity. what does this mean for them? yeah, it was a dramatic rescue without a doubt and have very high costs as you described with a palestinian loss of life what it means is that the israeli defense forces for a day for a moment, restored confidence in the israeli public about their capacity to deliver and to get their people out. but in the big picture, the best way to get israeli hostages out has been through deals, through a cease fire for hostage exchange, like one that we saw back in november. so a good day for israel, a unity didn t last long. obviously, the politics in israel very, very dicey with benny gantz. now exiting the coalition government. but it was something that the israeli public has been demanding. and now they want more action. they want to see the prime minister lean-in on getting a deal to get these hostages out. of course the toll here was very high in terms of palestinian life. it all so served to highlight some of the tactics that hamas uses talk a little bit more about where these hostages were found. and why there was perhaps so much collateral damage. obviously, much of it should be laying at the feet of the israeli forces that invaded here. but that s not the only thing at play, not at all. the case you re right, it was despicable. display of how hamas d values palestinian life. so many very clear these hostages were held in private civilian homes they were there for months and they were in the midst of what everyone in those areas new was a civilian areas. so israel, by finding these individuals, by rescuing them, it was clear that there were going to be civilian casualties. hamas doesn t care about palestinian civilian life. i i know we ve talked about this before, but this is perhaps one of the most a stark examples of that. if they cared about palestinian civilian life, they would be agreeing to the ceasefire proposal that has been out there and discuss secretary blinken s going out to the region to try to push for this, but in the meantime, hamas is embedding hostages in civilian areas with the clear understanding, this will cause palace let s see any civilian lives for a propaganda bonus may be for hamas, but i don t see how this is a real bonus for anybody in the middle of this conflict. they clearly are not looking at civilians as something to protect inside of gaza. so let s talk big picture for a second. you mentioned benny gantz, of course, announcing over the weekend and he s going to leave the war cabinet. he is, of course, someone that the us has really relied on in the course of these negotiations in this push for a ceasefire that president biden actually announced on a recent i ve friday. here s what jake sullivan, the national security adviser, had to say over the weekend. let s watch keith thinks the best way to get all of vestiges home is in a deal where they re brought out diplomatically, where there s no need for military operations to get every last hostage out. what we would much prefer to see is a ceasefire where the hostages come out peacefully. that is available. israel has said yes to it. now hamas needs to say yes to it. that s where president biden full effort, energy and attention is so bottom line, draw what s the holdup? while the holdup is hamas? the holdup is that hamas is i want to agree to a ceasefire that essentially pushes them out of the power. and that s the genius of this proposal, which is that it lays out a roadmap for preventing at the end state of resurgence of hamas in the gaza strip. and now that, that is, of course, very frustrating as well to the white house, because what we re seeing is the far-right ministers in israel s government rejecting that proposal as well. and now with ben against leaving the coalition it gives them a little more power in the near term, but it also puts the question to the israeli public. and i think this is why the president did go public with his proposal to get the israeli public to recognize the stakes, to put it back in the political arena. this question about how to end this war in a manner that we don t see a hamas resurgence in gaza and so the holdup right now is that hamas understands this proposal is against their interests and that s why we see the secretary going out. that s why it s frustrating that it s not yet done. but hamas, they re hoping for more days of violence, like on saturday where they don t have to make this agreement. and that means more palestinian lives are put at risk. machel rubin for us this morning, joel, always appreciate your experiments for being here all right, let s go now to politics. donald trump, tried to win over voters in nevada. a key swing state with his first official campaign rally since he was convicted on felony charges i tell you what? no third world country in during triple digit temperatures as trump rally them in an outdoor event in las vegas, nevada. of course, one of a handful of states that could help to decide the presidential election this fall, a new cbs poll shows trump in a virtual tie and a head-to-head race with president biden, both nationally and in these key swing states. today, trump is scheduled to have a hearing with his probation publisher of axios nick. good morning. great to hear so yeah, probation hearing for a presumptive sentencing name. you d sentenced you just read off the teleprompter there, i think speaks to the kind of interesting election where in, where that sentence one interest hide across as the country tied and state sentenced to one of the candidates will have a virtual interview with his probation officer. today yeah that s seen as pool. actually interesting because it s one of the first things, places where we seem to see maybe a little bit of movement. obviously the official way we talk about it is that it s tied. there s no clear leader, but there is a little bit get over movement toward biden compared to where this pole previously was. what does that tell you? it s pretty clear across the board that again, within the margin of error is and all of these poles we ve seen a slight polling bump four biden, and then a lot of the surveys were the vast majority of people say that conviction won t have any impact. there is 20, 30% of republicans who say it well, and remember, we ve been talking about for months and months it s in a month. this is a very tight election for donald trump to win. he needs to get more voters and he needs to get the last time. and so far, being convicted of a felony in new york is not leaving more voters for that. but again, all of these are the margin of error. it s like going from trump up to two biden up one that is essentially a coin flip election still. yeah, it is yes. very, very, very close. so let s listen a little bit to some of what trump had to say in this rally over the weekend because is there are a couple of things that stood out to us, including how the former president talked about, well, i mean, he he always uses very often inflammatory language about joe biden. but in this case, he was talking about suicide as well let s watch this du are there this is a front row joe. he said everyone this guy wouldn t it be incredible. he s gone to 250 if he voted for biden, even for by now, i don t think so. i think it would be suicide before by dry a bit extreme i don t know how a front row you thought about that. i think we re seeing that this is trump being trump, like they re even though there s a big conversation a lot about how much will they stick to the issues there s pulling out over the weekend that shows what a strong conjugation issue the economy is as opposed to conviction. and so can trump come out and just talk about the economy and immigration for the next six months. i think that little snippet shows that will been a challenge for some of the president s former president s advisers. they gotta to do that. yeah, let s talk about nevada specifically for a second at trump also was up there. this is sort of a typical line, but he said it in front of it. a crowd. again, it s a very heavily hispanic at stateless watch. what trump had to say about hispanic and african-american voters joe biden is also weighed. you re going all out war on the workers have america, especially african americans and hispanic in america i spanish americans and african americans are the ones suffering most with his incredible illegal alien group that s coming in so this is, this is pretty typical for how trump talks about this kind of thing. but i think what s going on in nevada is particularly interesting. i will say i have okay to a lot of sources recently who think that it actually may go for trump. this time around and it s part of it s part of the reason is because of some of the themes that he is talking about. there, there are a lot of workers that tourism economy, cassino workers, who in the past had gone for democrats who may actually go republican this time you hear this was a big, i mean, again, this is a point-slope election. there s a lot of things happening that people don t really understand because this is such a different election than ones previously. and i think one of the ones that republicans are trying to capitalize as those capitalizes, in row on minority voters with hispanic americans or african americans, as well. that s clear on the polling data that donald trump is doing better with those groups in previous republican candidates. and i think his campaign, his advisers, he, that is a huge, massive opportunity. again, the same way that if a small amount of those republican voters are moved by the conviction, if a small amount of minority voters are moved by some of the present former president s economic arguments that the election right, they
