Isnt being regulated in common carrier starting in the 70s under democrat and republican controlled fcc. They operated different than phone records. And it was under the chairman in the second clinton term where the pass was made to insulate the internet from common carriage. And so those types of communications were never regulated and didnt grow up from title two. They have always been out of title twos reach. That is what helped grow the internet we have today.
