CNN The Situation Room With Wolf Blitzer June 4, 2024 23:27:00

Has been really moving swiftly, and with great speed here. we know that he subpoenaed our team reported earlier today that he had subpoenaed the former national security advisor, robert o brian, but this subpoena to the former vice president, mike pence, it comes after months of negotiations that our team has previously reported on with the former vice president s team, and now, we understand that, in fact, the special counsel wants documents and testimony all related to january 6th. wolf, the question will be, how exactly this plays out, because presumably, the former vice president will be exerting executive privilege at least in some sense here. so, unclear exactly how much he ll be able to comply with this subpoena if he does assert executive privilege. wolf? there s no doubt he could be a very, very key witness in these ongoing proceedings. jessica, stand by for a moment. i want to bring in our legal analyst, elliot williams. give us your reaction to this breaking news, elliot ....

Isn t ship that we deal with today? or is it somehow warranted? i think in the short term, it s hyperpartisanship. there was a decision, apparently, by pentagon officials to not shoot this down, because the lower part of it, the machinery that clint was just talking about, is roughly the size of three buses. and there was a concern that you could, you know, have this debris hit people on the ground. but i don t think president biden can sort of be passive here. because there s a lot of jury question. how did this happen, why is china doing this the speculation that maybe this was some sort of mistake by the chinese. it s very strange to sign this balloon in when secretary of state blinken is supposed to gather for a visit. so biden needs to sort of assert himself in terms of our relationship with china in the long term. he s gonna rebuke the chinese for this incident, and stand up to them. so, again, republican exaggeration, but i think biden is sort of if he sits back too much, ....

The first batch of document. and lawyers have been involved through in this throughout, if i m a prosecutor looking at this, those lawyers are witnesses. and if a lawyer is doing something like packing up a residence or locating documents, you don t have attorney/client privilege to decline to answer questions about that. moreover, the white house counsel who has been involved in this, mr. silver, who has also gotten himself entangled in the chain of these documents, there is case law that goes back to the clinton scandal in the 90s in the lindsey case which goes to the point that the white house counsel doesn t have an ability to assert executive privilege to avoid testifying about these sorts of things at least in a criminal investigation. so i think they will have plenty of witnesses. bill: stand by. mark meredith in a moment from the white house. ....

Terrific as they were and as elucidating as they were as to what is going on, that is very different types of evidence than you need in a court of law to prove a case beyond a reasonable doubt. if i were still in the department i d certainly be working damn hard on the case, but it would be also in the back of my head, there is nothing worse than bringing the case and losing. so the goal is to make sure that if you re in the department, if you re in manhattan, if you are in georgia, you are bringing a case that will stick. i think that is the phase we re in now. i know people may be tired of hearing that, but i think that all signs are that things are really ramping up and i think that s why you re seeing donald trump assert the fifth amendment so many times. one final thought, nicole. please. not to put anybody who s on the air right now, but would anyone here if we asked them a question of did you commit ....

Look, there s no doubt about this. this is a major shift in the investigation into the president s handling of the classified documents for the simple fact that this is the first time that we know about that the department of justice has actually searched one of president biden s properties. so, his personal lawyer put out that statement last night about 7:00 p.m. acknowledging that there was a department of justice search, the property that they did find those additional items. six of them with classified markings on them. now one thing that he was very quick to assert is the fact that this was done in complete cooperation with the department of justice, no subpoenas, no warrants an official told us afterwards. instead, president biden offered up his home for the department of justice to search. now, sources told cnn that it was actually conducted by the fbi for 13 hours, as you can see on the screen there. 9:45 a.m. to 10:30 p.m. while the president s personal legal team and white ho ....
