in office. we'd have to litigate it. we don't definitively know the answer but i think mueller wins this one, aaron. >> in sort of a last act before they lose control of the house, republicans want the former fbi director james comey and former attorney general loretta lynch to testify behind closed doors about hillary clinton's e-mails. is there any significance in your mind to the timing of these subpoenas? >> well, clearly house republicans want to get this done before they're in the minority starting next year and this investigation would seemingly have to wrap up. comey himself has pushed back strongly on this since getting a subpoena. he wants to testify out in the open. republicans are saying if you testify out in the open, there's only going to be so much you can possibly say. behind closed doors we could go much deeper into this. his thought process is i've seen the selective leaking and distortion in his own words from those sessions so i don't want to be a part of it. so we're going to see that battle play out here in the next couple of weeks.
