(Photos courtesy of Cebu provincial capitol) CEBU CITY - Presentation of vaccination cards is not required in schools, workplaces and government offices in Cebu province, Governor Gwendolyn Garcia said on Wednesday. In a memorandum, Garcia told the 44 mayors "to refrain from requiring the presentation of vaccination card as a requirement for any educational, employment, and other similar government transaction purpose". The memo was issued on Wednesday following reports that teachers and parents were made to present their vaccination cards before entering a school facility to get the modules of their children. There were also reports that some residents in towns and components cities of the province were required by their employers to submit a proof of vaccination before being allowed to enter their workplaces. The governor said her order is in observance of Republic Act (RA) 11525 or the Covid-19 Vaccination Program Act of 2021, Joint Administrative Order No. 2021-0001, and Department of Labor and Employment (DOLE) Labor Advisory No. 03, series of 2021 which states that "vaccine card shall not be considered as an additional mandatory additional requirement for educational, employment, and other similar government transaction purposes nor shall individuals vaccinated against Covid-19, as indicated in the vaccine card, be considered immune from Covid-19". In her memo, she said DOLE's advisory merely requires establishments to endeavor to encourage their employees to get vaccinated. "Any employee who refuses or fails to be vaccinated shall not be discriminated against in terms of tenure, promotion, training, pay, and other benefits nor shall they be terminated from employment," Garcia said. She reiterated that the "no vaccine, no work policy" is not allowed by the law. Lawyer Ben Cabrido Jr., a professor at the University of San Jose-Recoletos, said in a social media post under Section 12 of RA 11525, "it is illegal for anyone to require proof of vaccination through the presentation of a vaccination card in the exercise of his right to education, of employment, profession, vocation and other similar gainful activities". "Since one necessarily needs to travel in order to exercise these rights, it is thus illegal to restrict or prohibit a person from riding on a public transportation as his means of locomotion in pursuing these ends," Cabrido said. Garcia's memo, however, does not cover the policy issued by the Department of Transportation which requires commuters to present a vaccination card as requirement in riding public transport. (PNA) }
