The Massachusetts Superior Court Business Litigation Session will see personnel changes in 2021. In the BLS-2 Session, Judge Michael D. Ricciuti will replace Judge Janet L. Sanders, who is nearing retirement. Judge Ricciuti will share BLS-2 with Judge Kenneth W. Salinger, who will also serve as the BLS’s administrative judge. Meanwhile, Judge Karen F. Green and Judge Brian A. Davis have returned to the BLS-1 Session. And Gloria Brooks and Brenda Shisslak now serve as clerks for BLS-1 and BLS-2, respectively.

On February, 3, the highest court in Massachusetts, the Supreme Judicial Court (“SJC”) will hear two cases involving municipalities’ scope of authority in allowing adult-use cannabis businesses,
Mederi Inc. v. City of Salem and
CommCan, Inc. v. Town of Mansfield.
The facts leading up to the
Mederi case began nearly three years ago in 2018 when Mederi Inc. was denied a host community agreement (“HCA”) with the city of Salem following a Committee of applications for more than the City’s five allotted marijuana retailer slots. The Superior Court held that Salem did not act arbitrarily or capriciously in declining to execute an HCA with Mederi. The Superior Court also ruled that G.L. c. 94G, § 3 also gives municipalities broad discretion to determine with whom to execute an HCA, and that the Legislature did not intend for the Cannabis Control Commission (“CCC”) to be the sole cannabis licensing authority. Mederi filed an appeal. The appeal was set to be heard before the Massachusetts Appeals Court when the SJC

Top 10 in 2020: Marijuana businesses growing in Attleboro area


Four years after recreational marijuana sales were approved by Massachusetts voters, Nova Farms LLC opened the first retail pot shop in Attleboro.
The shop, located in a renovated jewelry factory, started doing business on May 25, Memorial Day, a little more than three years after the company submitted its first application for a license. Nova Farms initially applied for a “registered marijuana dispensary” license, or RMD, which was to sell medical marijuana.
Over the years that changed to recreational pot, but the coronavirus pandemic nearly ruined it.
Nova Farms was slated to open in March but was stopped by restrictions put in place by Gov. Charlie Baker to stop the spread of the disease.
