Under current Virginia law, anyone who is convicted of a second misdemeanor larceny conviction is subjected to a mandatory jail sentence of at least 30 days (but not more than 12 months). A third misdemeanor larceny conviction is a Class 6 felony, punishable with at least a year in jail. Misdemeanor, or petit larceny, is defined as theft of items under $1,000.
