She was convicted in April 2019 and sought lenient sentencing under the Domestic Violence Survivors Justice Act. That was denied by Judge Edward McLoughlin, who had heard the case and ultimately sentenced her. Members of the New York Senate and Assembly who worked on the law have filed an amicus brief in support of the appeal. McLoughlin is at the center of Addimando s appeal. That has Dutchess County agencies eager to implement IPVI, as it s known, facing opposition from the county Public Defender s Office. The public defender has a mandate to protect the constitutional rights of our clients. Foremost among those rights is the presumption of innocence of the accused. KINGSTON, N.Y. â Two city men have been indicted on a charge of murder in connection with the fatal shooting of a 12-year-old girl, according to the Ulster County District Attorneyâs Office. Gilbert Thomas, 24, 9 Franklin and Robert âNikkiâ James, 46, both of 49 Franklin St. were indicted by an Ulster County Grand Jury, according to the DAâs office. The indictment was handed up Wednesday, Dec. 30, the office said. Thomas and James are accused of second-degree murder for âacting in concert under circumstances evincing a depraved indifference to human life while recklessly engaging in conduct which created a grave risk of death to another person and causing the death of that person or a third person,â a press release issued Wednesday says. ....
