Nicole Addimando murder conviction, sentencing appeal to be heard


Addimando is now in Bedford Hills Correctional Facility.
Addimando never denied shooting Grover, but claimed she did so in self-defense, after years of physical and emotional abuse. She was convicted in April 2019 and sought lenient sentencing under the Domestic Violence Survivors Justice Act. That was denied by Judge Edward McLoughlin, who had heard the case and ultimately sentenced her.
Members of the New York Senate and Assembly who worked on the law have filed an amicus brief in support of the appeal.
McLoughlin is at the center of Addimando s appeal.
The judge granted a motion from the Putnam County District Attorney’s Office’s to disqualify Addimando s attorney of roughly eight months, Kara Gerry, due to a perceived conflict of interest with her position in the Dutchess County Public Defender’s Office ....

IPVI, domestic violence intervention program in Poughkeepsie faces dispute


However, in many of these cases the subject will not have been convicted of any crime before the program s intervening steps begin.
That has Dutchess County agencies eager to implement IPVI, as it s known, facing opposition from the county Public Defender s Office.
The public defender has a mandate to protect the constitutional rights of our clients. Foremost among those rights is the presumption of innocence of the accused. The IPVI program’s request for our involvement undermines our mandated duties, said Thomas Angell, Dutchess County s public defender.   
Angell s office said it had provided Family Services with suggestions on how the two offices could work together, but those recommendations were not accepted.  ....

Murder indictment accuses two Kingston men of 'depraved indifference' in killing of 12-year-old girl


KINGSTON, N.Y. – Two city men have been indicted on a charge of murder in connection with the fatal shooting of a 12-year-old girl, according to the Ulster County District Attorney’s Office.
Gilbert Thomas, 24, 9 Franklin and Robert “Nikki” James, 46, both of 49 Franklin St. were indicted by an Ulster County Grand Jury, according to the DA’s office. The indictment was handed up Wednesday, Dec. 30, the office said.
Thomas and James are accused of second-degree murder for “acting in concert under circumstances evincing a depraved indifference to human life while recklessly engaging in conduct which created a grave risk of death to another person and causing the death of that person or a third person,” a press release issued Wednesday says. ....
