Anytime that im looking at the labor request for the commission is that the commission exercises the power sparingly, and useds a balancing approach where you balance the need for the labor on the one hand with any danger of unfair advantage or undue influence on the other hand. And in cases where you find that the need for the labor outweighs the danger of impropriety, thats when the waiver is proper.
