The Michigan Court of Appeals recently held that assessments on a property under a development agreement between a city and the property's former owner did not survive a tax foreclosure and therefore were not liens against the property in the hands of the party that purchased it at tax auction.

etersen Financial, LLC v. City of Kentwood and Kent County Treasurer, docket no. 350208, 2021 WL 1582835 (unpublished). The former owner of a property had entered into a Voluntary Special Assessment Development Agreement (VSADA) with the City prior to its tax foreclosure by the County. The question was whether the lien granted by agreement between the City and prior owner survived the tax foreclosure.

HOLLAND, MI — The co-owner of Brann’s Steakhouse and Grille in Holland has paid a $1,750 state fine for COVID-19 workplace violations at his restaurant.
Violations at the restaurant, co-owned by state Rep. Tommy Brann, R-Wyoming, include failing to require face masks when social distancing could not be maintained and lacking protective barriers at the bar and hostess station, according to the Michigan Occupational Safety and Health Administration (MIOSHA).
The fine, issued Feb. 11, was originally for $3,500. The inspection that led to the fine occurred in response to an employee complaint.

LANSING — Governor Gretchen Whitmer today announced the dates for special elections to fill vacancies in the 8th and 28th Districts of the Michigan Senate. A special primary election to fill the vacancy will be held on Aug. 3, and the general election will be held on Nov. 2.
“The 8th and 28th Senate Districts deserve representation in the legislature, and voters will have an opportunity to make their voices heard at the ballot box in the August 3rd primary and the November 2nd general election,” said Governor Whitmer. “Secretary of State Jocelyn Benson and I remain committed to ensuring fair and secure elections that reflect the will of the people, and I look forward to working with her to ensure the people of Michigan have a voice in Lansing.”
