And i ll just add, i think some people said is this obstruction of congress, i don t think so because he s claim i think because there is a litigation strategy here, i think it would be hard to say that this is obstruction of justice in some criminal sense or prove it in that way. bigger question, we re nine months out from january 6th and all the evidence of the weeks of efforts to overturn an election, by president and many allies and trying to use the justice department, et cetera, in one has been charged with anything, nine months in. 500 people charged or more with assaulting the capitol, none of the ring leaders faced any sort of legal consequences. will this he? where is most likely? and when? it is a great question, jim. so i ll give the the department of justice the benefit of the doubt and a critique. the benefit of the doubt to charge those people at the highest level would involve having to charge a conspiracy. and that will take a long time ....

Republican party that is malevolent no doubt but extremely effective in using their power in statehouses? well, i think for democrats, the default in these situations is to fall back on two types of strategy. a litigation-focused strategy, so to maybe find a different way to articulate the harm and take another bite at the apple at seeking at getting this law enjoined or an electoral strategy. you re seeing a lot of democratic politicians say the solution is to register more voters and outorganize the opposition and win more seats in the 2022 election. i think both of those strategies will fall short. for one thing we did just outorganize the other side and won both chambers of congress and the white house in 2020 so it s very frustrating to hear we always need to look towards the next election to solve these problems. the litigation strategy is not going to work because the judiciary has been rigged with trump appointees unfriendly to any of these claims that groups ....

Apparently just think about just how odd and absurd this is. they re saying the government should have no part in trying to tell you to wear a mask, even though it might negatively impact unvaccinated children. that same argument about the whether the government has a right to control your body or your health decisions in some form or fashion, that doesn t apply at all when you re talking about abortion apparently, even though the same logic should apply if you re speaking about concern for presumed children. so this notion here is so inconsistent. and why you also know that this is really not founded in logic. there is as reva so brilliantly said, the wicked brilliance of the litigation strategy, but that is obviously countered by the absurdity of the hypocrisy that s involved here. it should not go unnoticed that remember the supreme court has not as its current composition, has not demonstrated an overwhelming love and appreciation for roe v. wade. ....

A voting rights bill unless manchin changes his mind without ten republicans. it seems like less of a chance of that now than before. right? i think so. i mean, look, the democrats are hitting the reality they don t have the votes to do all of these things they want, whether it s prevent republicans from passing laws in the states, whether it s get either of their legislative approaches through the senate. so i think when you hear kamala harris making the announcement, talking about putting money into voter registration and turnout, that s a tacit acknowledgement the legislative strategy is going nowhere at the federal or state level. we saw with the recent supreme court decision a growing acceptance among democrats that the litigation strategy also is probably not going to achieve any kind of dramatic overturning of the status quo. so the solution is a political one. the solution is to try to register and turn people out to vote, despite these restrictions ....
