The Court said that as per the settled law, a woman, who has already been married to another person, cannot be treated as a legally-wedded wife of the second husband without divorce from her first husband.
"Considering the serious nature of offence to create communal disturbance the occasion of Sinhast at Ujjain, this Court does not find any case for grant of suspension of jail sentence," the Court said.

The Court further observed that compelling a married woman to live in her parental home on account of non-fulfillment of demand of dowry would also amount to mental harassment.
