Opinion. So overtime the judges begin to think these cases are trivial. They cannot imagine what discrimination is because they are constantly dismissing the cases. It to get in the habit of saying no, you lose the ability to see what yes looks like. Ive seen that now across the spectrum from discrimination cases for criminal cases. If you constantly are excusing air, harmless error, balancing, you lose the ability to be able to see and are when it happens. For me it was even more clear.
