Decision. first what the president just said, speaking live from the white house, i strongly, strongly disagree with the court s decision. he said the court walked away from decades of precedent and called this not a normal court. what was your reaction to what you just heard? my reaction is that actually the supreme court is finally bringing into alignment education law with employment law. for over 40 years the supreme court has been more conservative on employment law and has restricted use of race motivated by interests like diversity or equity or systemic racism or societal discrimination. so really, i find the court s opinion today really to just be reaffirming what the court has held in other areas the fact we should not use race as a justification for any decision-making. andrew, we got word from the justice department and the attorney general with a statement, the supreme court s decision undercuts efforts by universities across the country ....

Be getting a press conference top of the 2:00 hour, we have now learned on the group that brought this to the supreme court. the students for fair admissions. so we will see what they have to say live top of the hour. but first, your reaction to the attorney general s statement. yeah, i think that it to some degree it s a concession. only proceed on promoting diversity in legal means, that means race neutral characteristics like socioeconomic status or adversity or something else, and the court did indicate that as long as you are actually looking at those characteristics and not using them as proxy for race that could be ok. so i think the law is pretty clear now and the law is pretty clear in other contexts and people are just going to have to pivot away from using race to make decisions. so there s a lot of other ways to get at robust diversity that ....

Race conscious decision-making, race conscious actions in employment law, it s been illegal and still illegal. do you think with the supreme court ruling we will see challenges to that? yes. i have noticed an increasing number of challenges to corporate dei programs and i would expect this decision is going to shine even more of a spotlight about how out of alignment some of those programs are. and to be clear, i m not criticizing all diversity programs, it really depends on how they are structured, but the extent they are explicitly or implicitly taking race into decision-making for employment decisions, race restricted internships, race restricted mentoring, race focused promotion decisions, etc., there s a host of employment decisions, if you are using race as any factor in your decision-making, you are already violating the law. ....
